Penerapan pemeriksaan Psikologi pan bimbingan perkawinan dalam sidang dispensasi kawin perspektif Maqâşid Syarî`ah: Studi di Pengadilan Agama Maumere, Kabupaten Sikka, Nusa Tenggara Timur

ABSTRAK

Peningkatan batas usia minimal perkawinan melalui Undang-Undang Nomor 16 Tahun 2019 yang menyetarakan usia 19 tahun bagi laki-laki dan perempuan bertujuan melindungi kesehatan reproduksi serta memastikan kematangan psikologis calon pengantin. Namun, perubahan regulasi tersebut justru diikuti oleh lonjakan signifikan permohonan dispensasi kawin. PERMA No. 5 Tahun 2019 menegaskan pentingnya pemeriksaan psikologi dalam proses dispensasi kawin sebagai upaya perlindungan anak, sejalan dengan urgensi bimbingan perkawinan untuk membekali calon pengantin dengan kesiapan emosional dan pemahaman mengenai kehidupan rumah tangga.

Penelitian ini menggunakan pendekatan empiris dan kualitatif. Data diperoleh melalui observasi, wawancara, dan dokumentasi di Pengadilan Agama Maumere untuk mengkaji penerapan pemeriksaan psikologi dan bimbingan perkawinan dalam sidang dispensasi kawin. Data primer dan sekunder dianalisis menggunakan pendekatan sistem Jasser Auda melalui tahap pemeriksaan, klasifikasi, verifikasi dengan triangulasi, hingga analisis deskriptif sebelum ditarik kesimpulan penelitian.

Hasil penelitian menunjukkan bahwa pemeriksaan psikologi dan bimbingan
perkawinan berperan penting dalam memastikan implementasi asas the best interest of the child sebagaimana diatur dalam PERMA No. 5 Tahun 2019. Meskipun pelaksanaannya belum optimal karena keterbatasan tenaga profesional, rekomendasi psikolog dan nasihat hakim memberikan kontribusi signifikan dalam menilai kesiapan mental anak serta potensi risiko perkawinan usia dini. Analisis menggunakan pendekatan sistem Jasser Auda menegaskan bahwa hakim menerapkan fitur kognitif, multidimensionalitas, kemenyeluruhan, keterbukaan, kebermaksudan, dan hirarki saling berkaitan dalam pertimbangannya. Hakim tidak hanya merujuk pada hukum positif, tetapi juga mempertimbangkan aspek psikologis, sosial, budaya, ekonomi, serta tujuan maqâşid Syarî`ah, yakni menjaga jiwa, akal, keturunan, dan kehormatan.

ABSTRACT

Increasing the minimum age limit for marriage through Law Number 16 of
2019 which equalizes the age of 19 for men and women aims to protect reproductive health and ensure the psychological maturity of the bride-to-be. However, the change in regulations was followed by a significant surge in marriage dispensation applications. PERMA No. 5 of 2019 emphasizes the importance of psychological examination in the marriage dispensation process as an effort to protect children, in line with the urgency of marriage guidance to equip prospective brides with emotional readiness and understanding of domestic life.

This research uses an empirical and qualitative approach. Data were obtained through observations, interviews, and documentation at the Maumere Religious Court to examine the application of psychological examination and marriage guidance in the marriage dispensation session. Primary and secondary data were analyzed using the Jasser Auda system approach through the stages of examination, classification, verification by triangulation, and descriptive analysis before drawing conclusions from the study.

The results of the study show that psychological examination and marriage
guidance play an important role in ensuring the implementation of the principle of the best interest of the child as stipulated in PERMA No. 5 of 2019. Although the implementation is not optimal due to the limited number of professionals, the recommendations of psychologists and the advice of judges make a significant contribution in assessing the mental readiness of children and the potential risks of early marriage. The analysis using the Jasser Auda system approach confirms that the judge applies cognitive features, multidimensionality, comprehensiveness, openness, intentionality, and hierarchy are interrelated in their considerations. The judge not only refers to positive law, but also considers the psychological, social, cultural, economic, and purpose of the sharia maqashid, namely to protect the soul, intellect, heredity, and honor.

زيادة الحد الأدنى للعمر للزواح من خلال القانون رقم 16 لعام 2019 الذي يعادل سن 19 للرجال والنساء يهدف إلى حماية الصحة الإنجابية وضمان النضج النفسي للعروس المستقبلية. ومع ذلك، تبع التغيير في اللوائح زيادة كبيرة في طلبات إعفاء الزواج. يؤكد قانون بيرما رقم 5 لعام 2019 على أهمية الفحص النفسي في عملية إعفاء الزواج كجهد لحماية الأطفا, تماشيا مع ضرورة توجيهات الزواج لتزويد العرائس المحتملين بالاستعداد العاطفي وفهم الحياة المنزلية.

تظهر نتائج الدراسة أن الفحص النفسي والإرشاد الزوجي يلعبان دورا مهما في ضمان تنفيذ مبدأ مصلحة الطفل الفضلى كما هو منصوص عليه في قانون بيرما رقم 5 لعام 2019. على الرغم من أن التنفيذ ليس مثاليا بسبب قلة عدد المتخصصين، إلا أن توصيات علماء النفس ونصائح القضاة تساهم بشكل كبير في تقييم الجاهزية النفسية للأطفال والمخاطر المحتملة للزواج المبكر. يؤكد التحليل باستخدام نهج نظام جاسر عودة أن القاضي يطبق السمات الإدراكية، والتعددية الأبعاد، والشمولية، والانفتاح، والنية، والتسلسل الهرمي مرتبطة ببعضها في اعتباراتها. القاضي لا يقتصر الأمر على القانون الإيجابي، بل يأخذ أيضا في الاعتبار الجوانب النفسية والاجتماعية والثقافية والاقتصادية والهدف من الشريعة المقاشيد، وهو حماية الروح والعقل والوراثة والشرف.
