Implementasi PKPU nomor 13 tahun 2024 terhadap pelanggaran kampanye pada pelaksanaan pilkada 2024 di Kota Batu perspektif Maslahah Mursalah

ABSTRAK

Pilkada Serentak 2024 merupakan momentum penting dalam memperkuat demokrasi lokal di Indonesia. Di Kota Batu, pelaksanaan kampanye secara umum berjalan tertib dan kondusif sesuai dengan ketentuan PKPU Nomor 13 Tahun 2024, meskipun masih ditemukan pelanggaran administratif terkait pemasangan Alat Peraga Kampanye di area terlarang seperti fasilitas pemerintah, lembaga pendidikan, dan pepohonan. Penelitian ini bertujuan untuk menganalisis implementasi regulasi kampanye serta meninjau pelanggaran yang terjadi dari perspektif Maslahah Mursalah dalam hukum Islam. Jenis penelitian yang digunakan adalah yuridis empiris dengan pendekatan yuridis sosiologis, melalui metode observasi, wawancara, dan studi dokumentasi terhadap Komisi Pemilihan Umum Kota Batu dan Badan Pengawas Pemilihan Umum Kota Batu.
Tujuan dari penelitian ini adalah untuk menganalisis bagaimana implementasi Peraturan Komisi Prmilihan Umum Nomor 13 Tahun 2024 diterapkan terhadap pelanggaran kampanye dalam pelaksanaan Pilkada 2024 di Kota Batu, mengidentifikasi berbagai kendala yang ditemukan dalam proses penerapan aturan tersebut, serta meninjau kesesuaiannya dengan prinsip-prinsip Maslahah Mursalah dalam hukum Islam. Penelitian ini menggunakan metode yuridis empiris dengan pendekatan yuridis sosiologis, melalui wawancara, observasi, dan studi dokumentasi terhadap pihak-pihak terkait di Komisi Pemilihan Umum dan Badan Pengawas Pemilihan Umum Kota Batu.
Hasil penelitian menunjukkan bahwa koordinasi antar lembaga seperti Komisi Pemilihan Umum Kota Batu dan Badan Pengawas Pemilihan Umum, telah berjalan efektif dengan menerapkan pendekatan preventif dan represif secara seimbang. Namun, tingkat kepatuhan peserta terhadap aturan kampanye masih perlu ditingkatkan. Dari perspektif Maslahah Mursalah, penerapan Perturan Komisi Prmilihan Umum Nomor 13 Tahun 2024 mencerminkan upaya menjaga kemaslahatan umum (al-maṣlaḥah al-‘āmmah) dengan menegakkan nilai keadilan, keteraturan, dan integritas pemilu, serta menolak kemudaratan politik, sosial, dan moral. Regulasi ini sejalan dengan prinsip maqāṣid al-syarī‘ah, yaitu menjaga agama, jiwa, akal, keturunan, dan harta, sehingga pelaksanaan Pilkada dapat memberikan manfaat nyata bagi masyarakat serta memperkuat kepercayaan publik terhadap proses demokrasi yang berkeadilan dan berintegritas.

ABSTRACT

The 2024 Simultaneous Regional Elections are an important moment in strengthening local democracy in Indonesia. In Batu City, the campaign generally ran in an orderly and conducive manner in accordance with the provisions of PKPU Number 13 of 2024, although there were still administrative violations related to the installation of campaign materials in prohibited areas such as government facilities, educational institutions, and trees. This study aims to analyze the implementation of campaign regulations and review violations from the perspective of Maslahah Mursalah in Islamic law. The type of research used is empirical juridical with a sociological juridical approach, through observation, interviews, and documentation studies of the Batu City General Election Commission and the Batu City Election Supervisory Agency.
The purpose of my research is to analyze how General Election Commission Regulation Number 13 of 2024 is implemented in relation to campaign violations in the 2024 regional elections in Batu City, identify various obstacles encountered in the process of implementing these regulations, and review their compatibility with the principles of Maslahah Mursalah in Islamic law. My research uses an empirical juridical method with a sociological juridical approach, through interviews, observations, and documentation studies of relevant parties in the General Election Commission and the Election Supervisory Agency of Batu City.
The results of the study show that coordination between institutions such as the Batu City General Election Commission and the General Election Supervisory Agency has been effective by applying a balanced preventive and repressive approach. However, the level of compliance of participants with campaign regulations still needs to be improved. From the Maslahah Mursalah perspective, the implementation of General Election Commission Regulation Number 13 of 2024 reflects efforts to maintain the public interest (al-maṣlaḥah al-‘āmmah) by upholding the values of justice, order, and electoral integrity, as well as rejecting political, social, and moral harm. This regulation is in line with the principle of maqāṣid al-syarī‘ah, namely protecting religion, life, reason, lineage, and property, so that the implementation of regional elections can provide tangible benefits to the community and strengthen public trust in a fair and honest democratic process.

تعد الانتخابات الإقليمية المتزامنة لعام ٢٠٢٤ لحظة مهمة في تعزيز الديمقراطية المحلية في إندونيسيا. في مدينة باتو، كانت الحملة الانتخابية بشكل عام منظمة ومواتية وفقًا لأحكام لائحة اللجنة العامة للانتخابات رقم ١٣ لعام ٢٠٢٤، على الرغم من استمرار وجود مخالفات إدارية تتعلق بتركيب مواد الحملة الانتخابية في مناطق محظورة مثل المرافق الحكومية والمؤسسات التعليمية والأشجار. تهدف هذه الدراسة إلى تحليل تنفيذ لوائح الحملة الانتخابية ومراجعة الانتهاكات من منظور المصلحة المرسلة في الشريعة الإسلامية. نوع البحث المستخدم هو البحث التجريبي القانوني مع نهج قانوني اجتماعي، من خلال الملاحظة والمقابلات ودراسات التوثيق للجنة الانتخابات العامة لمدينة باتو ووكالة الإشراف على الانتخابات في مدينة باتو.
الغرض من بحثي هو تحليل كيفية تنفيذ لائحة لجنة الانتخابات العامة رقم ١٣ لعام ٢٠٢٤ فيما يتعلق بانتهاكات الحملة الانتخابية في الانتخابات الإقليمية لعام ٢٠٢٤ في مدينة باتو، وتحديد العقبات المختلفة التي واجهت عملية تنفيذ هذه اللوائح، ومراجعة مدى توافقها مع مبادئ المصلحة المرسلة في الشريعة الإسلامية. يستخدم بحثي طريقة قانونية تجريبية مع نهج قانوني اجتماعي، من خلال المقابلات والملاحظات ودراسات التوثيق للأطراف ذات الصلة في لجنة الانتخابات العامة ووكالة الإشراف على الانتخابات في مدينة باتو.
تظهر نتائج الدراسة أن التنسيق بين مؤسسات مثل لجنة الانتخابات العامة لمدينة باتو ووكالة الإشراف على الانتخابات العامة كان فعالاً من خلال تطبيق نهج متوازن بين الوقاية والقمع. ومع ذلك، لا يزال مستوى الامتثال للوائح الحملة الانتخابية بين المشاركين بحاجة إلى تحسين. من منظور المصلحة المرسلة، يعكس تنفيذ لائحة لجنة الانتخابات العامة رقم ١٣ لعام ٢٠٢٤ الجهود المبذولة للحفاظ على المصلحة العامة (الماصلة العامة) من خلال التمسك بقيم العدالة والنظام ونزاهة الانتخابات، فضلاً عن رفض الأضرار السياسية والاجتماعية والأخلاقية. يتماشى هذا القانون مع مبدأ مقاصد الشريعة، وهو حماية الدين والحياة والعقل والنسب والمال، بحيث يمكن أن يوفر تنفيذ الانتخابات الإقليمية فوائد ملموسة للمجتمع ويعزز ثقة الجمهور في عملية ديمقراطية عادلة ونزيهة.
