Implementasi asas peradilan cepat, sederhana, dan biaya ringan Pengadilan Agama dalam menyelesaikan perceraian di Kepulauan Masalembu: Studi di Pengadilan Agama Kabupaten Sumenep

Penelitian ini membahas implementasi asas peradilan cepat, sederhana, dan biaya ringan dalam penyelesaian perkara perceraian oleh Pengadilan Agama Kabupaten Sumenep di wilayah terpencil Kepulauan Masalembu. Penelitian ini dilatarbelakangi oleh kondisi geografis Masalembu yang sulit diakses serta keterbatasan infrastruktur yang menyebabkan terhambatnya akses masyarakat terhadap layanan peradilan. Dalam konteks ini, asas peradilan cepat, sederhana, dan biaya ringan menjadi sangat relevan untuk dikaji guna mengidentifikasi sejauh mana asas tersebut benar-benar dapat diterapkan secara optimal dalam kondisi yang menantang.

Penelitian ini menggunakan pendekatan hukum empiris dengan metode sosiologi hukum untuk menggambarkan kenyataan di lapangan. Data diperoleh melalui wawancara dengan pihak-pihak terkait seperti hakim, pegawai Pengadilan Agama Sumenep, perangkat desa, tokoh masyarakat, dan warga Masalembu yang pernah berperkara.

Temuan penelitian menunjukkan bahwa (1) meskipun prinsip asas tersebut telah menjadi pedoman normatif, implementasinya masih menghadapi kendala signifikan, seperti akses transportasi terbatas, rendahnya literasi hukum masyarakat, ketergantungan pada jasa pengacara, serta tingginya biaya tidak resmi akibat perantara. (2) Melalui analisis teori sistem hukum Lawrence M. Friedman yang mencakup substansi hukum, struktur hukum, dan budaya hukum, penelitian ini menyimpulkan bahwa keberhasilan implementasi asas peradilan di wilayah terpencil memerlukan sinergi antara kebijakan hukum yang responsif, dukungan infrastruktur yang memadai, serta peningkatan pemahaman hukum masyarakat. Penelitian ini diharapkan menjadi dasar dalam merumuskan kebijakan peradilan yang lebih inklusif dan adaptif, khususnya dalam menjamin akses keadilan yang merata bagi masyarakat di daerah terpencil seperti Kepulauan Masalembu.

ENGLISH:

This study discusses the implementation of the principles of fast, simple, and low-cost justice in the settlement of divorce cases by the Religious Court of Sumenep Regency in a remote area of the Masalembu Islands. This research is motivated by the geographical condition of Masalembu, which is difficult to access, and the limited infrastructure that hampers public access to judicial services. In this context, the principles of fast, simple, and low-cost justice become particularly relevant to be studied to identify the extent to which they can truly be optimally applied in challenging conditions.

This study uses an empirical legal approach with legal sociology methods to describe the reality in the field. The data were obtained through interviews with related parties, including judges, employees of the Sumenep Religious Court, village officials, community leaders, and Masalembu residents who had had cases.

The findings of the study (1) show that although these basic principles have become normative guidelines, their implementation still faces significant obstacles, such as limited access to transportation, low public legal literacy, dependence on the services of lawyers, and high unofficial costs due to intermediaries. (2)Through an analysis of Lawrence M. Friedman's legal system theory that includes legal substance, legal structure, and legal culture, this study concludes that the successful implementation of judicial principles in remote areas requires synergy between responsive legal policies, adequate infrastructure support, and improved public legal understanding. This research is expected to be the basis for formulating more inclusive and adaptive judicial policies, especially in ensuring equitable access to justice for people in remote areas such as the Masalembu Islands.

تناقش هذه الدراسة تطبيق مبدأ العدالة السريعة والبسيطة والمنخفضة التكلفة في تسوية قضايا الطلاق من قِبل المحكمة الدينية في مقاطعة سومينيب في منطقة جزر ماسالمبو النائية. وتستند هذه الدراسة إلى الموقع الجغرافي لماسالمبو، الذي يصعب الوصول إليه، ومحدودية البنية التحتية التي تعيق وصول الجمهور إلى خدمات العدالة. في هذا السياق، يصبح مبدأ العدالة السريعة والبسيطة والمنخفضة التكلفة ذا أهمية بالغة، ويستحق الدراسة لتحديد مدى إمكانية تطبيقه على النحو الأمثل في ظل الظروف الصعبة

يستخدم هذا البحث المنهج القانوني التجريبي مع المقاربة السوسيولوجية القانونية، والتي تجمع بين الدراسات القانونية والواقع الاجتماعي في المجتمع. تم جمع البيانات من خلال المقابلات والتوثيق، مع تحليل البيانات عبر الفحص، والتصنيف، والتحقق، والتحليل، واستخلاص النتائج.
