Pola pengawasan terhadap peredaran makanan dan minuman kedaluwarsa perspektif Maqashid Syariah:Studi di Kabupaten Kediri

Pengawasan terkait peredaran makanan dan minuman kedaluwarsa yang dilaksanakan oleh pihak berwenang, yaitu BPOM, Dinas Kesehatan, dan Kepolisian. Kasus-kasus peredaran makanan kedaluwarsa yang pernah terjadi di Kabupaten Kediri. Hal ini menunjukkan salah satu lemahnya pengawasan di tingkat daerah. Oleh karena itu, penelitian ini bertujuan untuk mengkaji sejauh mana pola pengawasan hukum telah dijalankan oleh pihak berwenang dan bagaimana kesesuaiannya dengan nilai-nilai maqashid syariah.

Penelitian ini menggunakan jenis penelitian ini yuridis empiris dengan pendekatan kualitatif. Data dikumpulkan melalui wawancara dan dokumentasi terhadap instansi terkait, yaitu BPOM, Dinas Kesehatan, dan Kepolisian Resor Kediri, serta masyarakat dan pelaku usaha di wilayah penelitian. Penelitian dilakukan secara langsung di lapangan guna memperoleh gambaran faktual mengenai implementasi pengawasan hukum terhadap peredaran makanan dan minuman kedaluwarsa di Desa Krecek, Kecamatan Pare, Kabupaten Kediri.

Hasil penelitian menunjukkan bahwa pola pengawasan dilakukan oleh BPOM, Dinas Kesehatan, dan Kepolisian berbeda-beda. Setiap instansi memiliki program-program dalam pencegahan peredaran makanan dan minuman kedaluwarsa. Pelaksanaan pengawasan rutin belum optimal akibat keterbatasan sumber daya manusia, sehingga belum menjangkau seluruh pelaku usaha dan distribusi pangan. Berdasarkan perspektif maqashid syariah, pengawasan terhadap makanan dan minuman yang beredar di masyarakat sangat penting guna menjaga keselamatan jiwa (hifdz an-nafs) konsumen. Dalam perspektif maqashid syariah, pengawasan ini sejalan dengan prinsip perlindungan jiwa. Meski demikian, dibutuhkan penguatan peran dan koordinasi antar lembaga untuk mewujudkan pengawasan yang lebih merata dan efektif.

Supervision related to the circulation of expired food and beverages is carried out by the authorities, namely BPOM, the Health Office, and the Police. Cases of expired food circulation that have occurred in Kediri Regency. This shows one of the weaknesses of supervision at the regional level. Therefore, this study aims to examine the extent to which the pattern of legal supervision has been carried out by the authorities and how it is in accordance with the values of maqashid sharia.

This research uses this type of research juridical empirical with a qualitative approach. Data was collected through interviews and documentation of related agencies, namely BPOM, the Health Office, and the Kediri Resort Police, as well as the community and business actors in the research area. The research was conducted directly in the field to obtain a factual picture of the implementation of legal supervision of the circulation of expired food and beverages in Krecek Village, Pare District, Kediri Regency.

The results of the study show that the pattern of supervision carried out by BPOM, the Health Office, and the Police is different. Each agency has programs in preventing the circulation of expired food and beverages. The implementation of routine supervision has not been optimal due to limited human resources, so it has not reached all business actors and food distribution. Based on the perspective of maqashid sharia, supervision of food and beverages circulating in the community is very important to maintain the safety of the lives (hifdz an-nafs) and intellect (hifdz al-'aql) of consumers. From the perspective of maqashid sharia, this supervision is in line with the principles of protecting the soul and mind through education and prevention carried out by each agency. However, it is necessary to strengthen the role and coordination between institutions to realize more equitable and effective supervision.

يتم إجراء الإشراف المتعلق بتداول الأطعمة والمشروبات منتهية الصلاحية من قبل السلطات ، وهي BPOM ، ومكتب الصحة ، والشرطة. حالات انتهاء صلاحية تداول الأغذية التي حدثت في Kediri Regency. وهذا يدل على إحدى نقاط الضعف في الإشراف على المستوى الإقليمي. لذلك تهدف هذه الدراسة إلى دراسة مدى قيام السلطات بنمط الرقابة القانونية ومدى توافقه مع قيم الشريعة المقصودية.

تظهر نتائج الدراسة أن نمط الإشراف الذي تقوم به BPOM ومكتب الصحة والشرطة مختلف. كل وكالة لديها برامج لمنع تداول الأطعمة والمشروبات منتهية الصلاحية. لم يكن تنفيذ الإشراف الروتيني على النحو الأمثل بسبب الموارد البشرية المحدودة ، لذلك لم يصل إلى جميع الجهات الفاعلة في مجال الأعمال وتوزيع الأغذية. بناء على منظور المقاشيد الشرعي ، فإن الإشراف على الأطعمة والمشروبات المتداولة في المجتمع مهم للغاية للحفاظ على سلامة حياة المستهلكين (حفظ النفس) والعقل (حفظ العقل). ومن منظور الشريعة المقصيدية، فإن هذا الإشراف يتماشى مع مبادئ حماية النفس والعقل من خلال التثقيف والوقاية التي تقوم بها كل جهاز. ومع ذلك، من الضروري تعزيز الدور والتنسيق بين المؤسسات لتحقيق إشراف أكثر إنصافا وفعالية.
