Penghapusan praktik Khitan bagi perempuan dalam peraturan pemerintah no.28 tahun 2024: Perspektif pengurus cabang lembaga Bahtsul Masail Nahdlatul Ulama Kota Malang dan Dokter Sp.OG Fakultas Kedokteran dan Ilmu Kesehatan Universitas Islam Negeri Maulana Malik Ibrahim Malang

ABSTRAK

Khitan merupakan suatu praktik yang termasuk fitrah dalam Islam dengan tujuan menjaga kebersihan dan kesehatan. Khitan tidak hanya dilaksanakan oleh kaum pria melainkan juga wanita. Pembahasan mengenai khitan perempuan kembali mencuat setelah terbitnya Pasal 102 huruf (a) Peraturan Pemerintah Nomor 28 Tahun 2024 Tentang Peratura n Pelaksanaan Undang-Undang Nomor 17 Tahun 2023 Tentang Kesehatan. Terbitnya peraturan tersebut memicu perdebatan dari berbagai kalangan, terutama dari kalangan kaum Muslimin dan juga kalangan medis.
Adapun rumusan masalah pada penelitian ini adalah Bagaimana latar belakang diterbitkannya Peraturan Pemerintah Nomor 28 Tahun 2024? Bagaimana pandangan Pengurus Cabang LBMNU Kota Malang dan dokter Sp.OG pada Fakultas Kedokteran dan Ilmu Kesehatan UIN Maulana Malik Ibrahim Malang mengenai penghapusan praktik khitan bagi perempuan?
Peneliti menggunakan jenis penelitian yuridis empiris dimana peneliti mengambil tiga informan yang berkompeten pada bidangnya masing-masing untuk menanggapi penghapusan praktik khitan dalam peraturan tersebut. Pendekatan yang digunakan oleh peneliti merupakan pendekatan kualitatif. Selanjutnya metode pengumpulan data dengan wawancara dan dokumentasi. Hasil dari pengumpulan data tersebut kemudian diolah dengan tahapan pemeriksaan data, klasifikasi, verifikasi, analisis data dan kesimpulan.
Hasil penelitian ini menunjukkan bahwa latar belakang Pasal 102 huruf (a) Peraturan Pemerintah Nomor 28 Tahun 2024 tidak lepas dari beberapa peraturan yang berlaku sebelumnya.Selain itu, makna penghapusan pada Pasal 102 huruf (a) berarti pemerintah tidak lagi meregulasi terkait praktik tersebut, dimana ketiadaan peraturan tersebut berbeda dengan makna pelarangan. Ketua LBMNU Kota Malang menegaskan bahwa peraturan tersebut dinilai berlebihan. Kemudian dokter Sp.OG pada FKIK UIN Maulana Malik Ibrahim Malang menyatakan tidak menolak sepenuhnya peraturan tersebut, semua kembali kepada definisi operasional terkait jenis khitan perempuan yang dihapus oleh peraturan tersebut.

ABSTRACT

Circumcision is a practice that includes fitrah in Islam with the aim of maintaining cleanliness and health. Circumcision is not only carried out by men but also women. The discussion about female circumcision resurfaced after the issuance of Article 102 letter (a) of Government Regulation Number 28 of 2024 concerning Implementation Regulations of Law Number 17 of 2023 concerning Health. The issuance of the regulation sparked debate from various circles, especially from Muslims and also the medical community.
The formulation of the problem in this study is What is the background of the issuance of Government Regulation Number 28 of 2024? What is the view of the Branch Management of LBMNU Malang City and the Sp.OG doctor at the Faculty of Medicine and Health Sciences UIN Maulana Malik Ibrahim Malang regarding the elimination of the practice of circumcision for women?
The researcher used an empirical juridical research type in which the researcher took three informants who were competent in their respective fields to respond to the elimination of the practice of circumcision in the regulation. The approach used by the researcher is a qualitative approach. Furthermore, the method of data collection is by interviews and documentation. The results of the data collection are then processed by the stages of data examination, classification, verification, data analysis and conclusion.
The results of this study show that the background of Article 102 letter (a) of Government Regulation Number 28 of 2024 cannot be separated from several regulations that applied previously. In addition, the meaning of the abolition in Article 102 letter (a) means that the government no longer regulates the practice, where the absence of the regulation is different from the meaning of the prohibition. The Chairman of the Malang City LBMNU emphasized that the regulation was considered excessive. Then the Sp.OG doctor at FKIK UIN Maulana Malik Ibrahim Malang stated that he did not completely reject the regulation, all returned to the operational definition related to the type of female circumcision removed by the regulation.
