Keabsahan akad jual beli dengan sistem Coin Flip perspektif KUH Perdata dan Fikih Muamalah

ABSTRAK

Sistem Coin Flip merupakan inovasi dalam akad jual beli yang digunakan untuk menentukan harga melalui lemparan koin. Sistem ini diterapkan saat negosiasi antara penjual dan pembeli menemui kebuntuan. Sistem ini menarik perhatian karena melibatkan elemen acak dalam penentuan harga, yang berbeda dari cara jual beli pada umumnya, serta memberikan fleksibilitas dalam menyelesaikan kebuntuan negosiasi. Penelitian ini bertujuan untuk menganalisis keabsahan akad jual beli dengan sistem Coin Flip berdasarkan perspektif hukum positif (KUH Perdata) dan fikih muamalah. Fokus utama penelitian ini adalah untuk menentukan apakah sistem tersebut memenuhi syarat sah perjanjian dalam KUH Perdata dan rukun serta syarat sah jual beli dalam Islam. Selain itu, penelitian ini juga mengkaji unsur maisir yang terkait dengan sistem ini, yang merupakan salah satu aspek penting yang perlu diperhatikan dalam akad jual beli.

Penelitian ini dilakukan menggunakan metode yuridis normatif dengan pendekatan konseptual dan pendekatan perundang-undangan. Bahan hukum yang digunakan meliputi bahan primer, sekunder, dan tersier. Pengumpulan data dilakukan melalui studi kepustakaan, yang dianalisis menggunakan metode analisis normatif kualitatif. Penelitian ini mengkaji keabsahan sistem Coin Flip dari segi hukum Islam dan hukum positif.

Hasil penelitian menunjukkan bahwa akad jual beli dengan sistem Coin Flip sah menurut KUH Perdata, karena memenuhi syarat subjektif dan objektif. Transaksi ini didasarkan pada kesepakatan sukarela antara penjual dan pembeli yang cakap hukum, dengan harga yang jelas dan objek yang sah. Namun, akad jual beli ini tidak sah menurut fikih muamalah karena tidak memenuhi syarat sah jual beli yang mengharuskan adanya harga yang jelas dan pasti, serta mengandung unsur maisir (perjudian) di dalamnya, yang dilarang dalam Islam.

ABSTRACT

The Coin Flip system is an innovation in the sale and purchase contract that is used to determine the price through a coin toss. This system is applied when negotiations between sellers and buyers are deadlocked. This system attracts attention because it involves a random element in determining the price, which is different from the usual way of buying and selling, and provides flexibility in resolving negotiation deadlock. This research aims to analyze the validity of the sale and purchase contract with the Coin Flip system based on the perspective of positive law (Civil Code) and fiqh muamalah. The main focus of this research is to determine whether the system meets the legal requirements of an agreement in the Civil Code and the pillars and conditions of a valid sale and purchase in Islam. In addition, this research also examines the element of maisir associated with this system, which is one of the important aspects that need to be considered in a sale and purchase contract.

This research was conducted using a normative juridical method with a conceptual approach and a statute approach. The legal materials used include primary, secondary, and tertiary materials. Data collection was carried out through literature studies, which were analyzed using qualitative normative analysis methods. This research examines the validity of the Coin Flip system in terms of Islamic law and positive law.

The results showed that the sale and purchase agreement with the Coin Flip system is valid according to the Civil Code, because it fulfills the subjective and objective conditions. This transaction is based on a voluntary agreement between a legally capable seller and buyer, with a clear price and a valid object. However, this sale and purchase contract is not valid according to muamalah fiqh because it does not fulfill the legal conditions of sale and purchase which require a clear and certain price, and contains elements of maisir (gambling) in it, which is prohibited in Islam.

نظام رمي العملة المعدنية هو ابتكار في عقد البيع والشراء يُستخدم لتحديد السعر من خلال رمي العملة المعدنية. ويتم تطبيق هذا النظام عندما تصل المفاوضات بين البائعين والمشترين إلى طريق مسدود. ويحظى هذا النظام بالاهتمام لأنه يتضمن عنصر العشوائية في تحديد السعر، وهو يختلف عن الطريقة المعتادة في البيع والشراء، ويوفر مرونة في حلّ مأزق المفاوضات. يهدف هذا البحث إلى تحليل مدى صلاحية نظام قلب العملة من منظور القانون الوضعي (القانون المدني) والمعاملات الفقهية. وينصب التركيز الرئيسي لهذا البحث على تحديد ما إذا كان النظام يفي بالشروط القانونية للاتفاق في القانون المدني والأركان والشروط الشرعية للبيع والشراء في الإسلام. بالإضافة إلى ذلك، يدرس هذا البحث أيضًا عنصر الميسر المرتبط بهذا النظام، وهو أحد الجوانب المهمة التي يجب مراعاتها في عقد البيع والشراء.
وقد تم إجراء هذا البحث باستخدام المنهج القانوني المعياري مع المنهج المفاهيمي والمنهج القانوني. وتشمل المواد القانونية المستخدمة مواد أولية وثانوية وثالثية. تم جمع البيانات من خلال دراسة الأدبيات التي تم تحليلها باستخدام أسلوب التحليل المعياري النوعي. يبحث هذا البحث في مدى صلاحية نظام بيع وشراء العملات من حيث الشريعة الإسلامية والقانون الوضعي.
وتظهر النتائج أن اتفاقية البيع والشراء بنظام قلب العملة صحيحة وفقاً للقانون المدني، لأنها تفي بالمتطلبات الذاتية والموضوعية. وتستند هذه المعاملة إلى اتفاق طوعي بين بائع ومشترٍ قادرين قانوناً، بثمن واضح ومحل صحيح. ومع ذلك فإن عقد البيع والشراء هذا غير صحيح وفقاً لفقه المعاملات؛ لأنه لا يستوفي الشروط الشرعية للبيع والشراء التي تتطلب ثمناً واضحاً ومحدداً، ويحتوي على عناصر الميسر (القمار) المنهي عنه شرعاً.
