Implementasi Pasal 11 Ayat 3 Peraturan Menteri Keuangan Nomor 146 Tahun 2023 dalam pencegahan Stunting perspektif Maslahah Mursalah: Studi kasus di Desa Giripurno Kota Batu

ABSTRAK

Stunting merupakan masalah sosial yang berdampak pada berbagai aspek pendidikan, kesehatan, dan ekonomi. Desa Giripurno menjadi salah satu desa dengan angka stunting tertinggi di Kota Batu pada tahun 2023. Hal ini menjadi masalah sosial yang harus diatasi bersama oleh seluruh elemen pemerintahan dan non pemerintahan di Desa Giripurno. Mengatasi dan mencegah stunting di Desa Giripurno merupakan upaya untuk mencetak generasi muda yang lebih baik di masa depan. Dalam mengatasi permasalahan ini pemerintah telah mengeluarkan anggaran untuk pencegahan stunting yang diatur dalam Peraturan Menteri Keuangan No. 146 tahun 2023. Penelitian ini bertujuan untuk mendeskripsikan dan menganalisis implementasi Pasal 11 Ayat 3 Peraturan Menteri Keuangan Nomor 146 tahun 2023 perspektif Maslahah mursalah.
Penelitian ini merupakan penelitian hukum yuridis empiris dengan metode pendekatan kualitatif. Lokasi penelitian di Desa Giripurno Kota Batu. Data dan sumber yang digunakan meliputi sumber data primer berupa hasil wawancara dan dokumentasi, dan data sekunder berupa buku, e-book, e-journal, dan peraturan perundang-undangan. Teknik pengumpulan data dalam penelitian ini melalui dokumentasi dan wawancara. Kemudian metode pengolahan data dengan tahap pemeriksaan data, klasifikasi, analisis data dan kesimpulan.
Hasil penelitian menemukan bahwa implementasi Pasal 11 Ayat 3 Peraturan Menteri Keuangan Nomor 146 Tahun 2023 di Desa Giripurno telah berjalan sesuai sebagaimana ketentuan dalam Peraturan Menteri Keuangan tersebut. Namun, dalam pelaksanaannya masih terdapat berbagai tantangan dan hambatan baik dari pemerintah desa, tenaga kesehatan maupun masyarakat. Menurut Lawrance M. Friedman implementasi hukum melibatkan elemen struktur hukum yaitu para penegak hukum, substansi hukum yaitu peraturan yang mengatur, dan budaya hukum dalam hal ini yaitu masyarakat Desa Giripurno. Dalam pandangan perspektif Maslahah Mursalah untuk mengatasi dan mencegah terjadinya stunting agar mencapai kemaslahatan umat diperlukan peningkatan edukasi dan akses terhadap sumber daya manusia dengan fokus pada kepentingan umum dan kesejahteraan anak. Dengan demikian, pencegahan stunting diharapkan dapat menghasilkan generasi yang lebih sehat dan produktif, serta memenuhi prinsip keadilan sosial.

ABSTRACT

Stunting is a social problem that has an impact on various aspects of education, health, and the economy. Giripurno Village is one of the villages with the highest stunting rate in Batu City in 2023. This is a social problem that must be overcome together by all elements of government and non-government in Giripurno Village. Overcoming and preventing stunting in Giripurno Village is an effort to produce a better young generation in the future. In overcoming this problem, the government has issued a budget for stunting prevention as regulated in Minister of Finance Regulation No. 146 of 2023. This study aims to describe and analyze the implementation of Article 11 Paragraph 3 of the Minister of Finance Regulation Number 146 of 2023 from the perspective of Maslahah Mursalah.
This research is an empirical juridical legal research with a qualitative approach method. The location of the research is in Giripurno Village, Batu City. The data and sources used include primary data sources in the form of interview and documentation results, and secondary data in the form of books, e-books, e-journals, and laws and regulations. The data collection technique in this study is through documentation and interviews. Then the data processing method with the stages of data examination, classification, data analysis and conclusion.
The results of the study found that the implementation of Article 11 Paragraph 3 of the Minister of Finance Regulation Number 146 of 2023 in Giripurno Village has been carried out in accordance with the provisions of the Minister of Finance Regulation. However, in its implementation there are still various challenges and obstacles from both the village government, health workers and the community. According to Lawrance M. Friedman, the implementation of the law involves elements of the legal structure, namely law enforcers, legal substance, which is the regulating regulations, and legal culture in this case, namely the people of Giripurno Village. From the perspective of Maslahah Mursalah to overcome and prevent stunting in order to achieve the benefit of the ummah, it is necessary to increase education and access to human resources with a focus on the public interest and children's welfare. Thus, stunting prevention is expected to produce a healthier and more productive generation, as well as meet the principles of social justice.
