Ketentuan waktu pisah tempat tinggal sebagai syarat perceraian dalam sema nomor 3 tahun 2023 perspektif teori keadilan John Rowls dan Maslahah Mursalah Imam As Syatibi: Studi putusan PA Bojonegoro tahun 2023-2024

INDONESIA:

Perceraian adalah penghentian hubungan perkawinan antara seorang laki laki dan perempuan (suami dan istri). Dalam konteks agama islam menyebutkan bahwa perceraian ini dikenal sebagai at talaq yang artinya pelepasan atau kebebasan suami dari istrinya. Dalam istilah fiqih bahwa percerain itu “at talaq” atau “al furqoh” yang artinya membuka ikatan perjanjian, sedangkan furqah artinya bercerai.

Penelitian ini menggunakan jenis penelitian yuridis normatif yaitu berupa penelitian yang fokus ada regulasi yang menjadi obyek penelitian, karena penelitian ini dilakukan dengan mengumpulkan data sekunder melalui jelajah pustaka. Pendekatan penelitian yang digunakan dalam penelitian ini ialah pendekatan perundang undangan (Statute Approach). Metode penelitian hukum yang dilakukan dengan menelaah regulasi dan undang-undang yang berkaitan dengan isu hukum yang sedang dibahas

Berdasarkan Penelitian yang telah dilakukan penulis, maka dapat ditarik kesimpulan bahwa Peraturan SEMA Nomor 3 Tahun 2023 ini jika dilihat dari paradigma Teori John Rawls tidak memiliki 2 unsur (1) The Greatest Equal Principle kebebasan untuk semua orang untuk memiliki hak yang sama secara luas, (2) The different principle of fair equality of opportunity ketidaksamaan atau prinsip berbeda yang mana dalam konsepnya perbedaan social dan ekomi harus sama sama memberikan manfaat kepada mereka yang kurang beruntung dapat menguntungkan satu sama lain. Sehingga peraturan SEMA Nomor 3 Tahun 2023 ini perlu adanya pembaharuan hukum untuk tidak dikasih batasan permohonan perceraian akan tetapi melihat kondisi permasalahan yang terjadi saja.

Sehingga dari kasus tersebut kajian maslahah Imam As Syatibi yang hadir untuk menjadi solusi dari permasalahan percerain, dan harus segera diputuskan perceraiannya karena untuk tidak menjadi mudhorot bagi suami maupun istri dari banyaknya kasus di Pengadilan Agama Bojonegoro ini masuk dalam kategori daruriyat yang mengakomodir 3 maqosidus syari’ah menjaga jiwa (hifdz nafs). (Hifdz nasab), menjaga harta (Hifdz mall).

Divorce is the termination of the marital relationship between a man and a woman (husband and wife). In the context of Islam, it is stated that this divorce is known as at talaq which means the release or freedom of the husband from his wife. In fiqh terms, divorce is "at talaq" or "al furqoh" which means to open the bond of agreement, while furqah means to divorce.

This research uses a type of normative juridical research, which is in the form of research that focuses on regulations that are the object of research, because this research is carried out by collecting secondary data through literature exploration. Based on the research that has been conducted by the author, it can be concluded that SEMA Regulation Number 3 of 2023, when viewed from the John Rawls Theory paradigm, does not have 2 elements: (1) The Greatest Equal Principle, freedom for all people to have the same rights broadly, (2) The different principle of fair equality of opportunity, inequality or different principles, which in the concept of social and economic differences must equally provide benefits to those who The disadvantaged can benefit each other. So that SEMA regulation Number 3 of 2023 needs to be updated to not be given restrictions on divorce applications, but only look at the conditions of the problems that occur. So that from this case, the study of the maslahah of Imam As Syatibi who was present to be a solution to the problem of divorce, and the divorce must be decided immediately because it is not to become mudhorot for the husband and wife from the many cases in the Court
