Eksekusi hak asuh anak di dua wilayah Yuridiksi prespektif undang-undang perlindungan anak no 35 tahun 2014: Studi putusan nomor 1813/Pdt.G/PA.Kab.Kediri

ABSTRAK

Hadhonah adalah memelihara seseorang (anak) yang tidak bisa mandiri, mendidik, dan memeliharanya untuk menghindari dari segala sesuatu yang dapat merusak dan mendatangkan mudlarat kepadanya. Adapun rumusan masalah dalam penelitian ini adalah : 1. Dasar hukum eksekusi hak asuh anak pada Putusan no.1813/Pdt.G/2015/PA.Kab.Kediri di wilayah yuridiksi PA Kabupaten Kediri dan PA Kota Malang, 2. Eksekusi hak asuh anak pada Putusan no.1813/Pdt.G/2015/PA.Kab.kediri menurut Undang-Undang No.35 tahun 2014 tentang Perlindungan Anak.

Adapun Metode Penelitian yang digunakan adalah Metode Penelitian hukum Normatif atau Kepustakaan. Dan pendekatan Penelitiannya adalah menggunakan pendekatan kasus dan pendekatan perundang-undangan. Jenis penelitian kepustakaan (Library reasearch) dengan bantuan pendekatan perundang-undangan dan kasus. Bahan hukum yang digunakan adalah pasal 105 KHI,156 KHI, Undang-Undang No 35 tahun 2014 Perlindungan Anak dan Putusan nomor 1813/Pdt.G/2015/PA.Kab.Kediri sebagai bahan hukum primer dan didukung oleh literatur-literatur atau tulisan yang sesuai dengan tema yang dibahas. Selanjutnya data diolah dan dianalisis dengan menggunakan metode Deskriptif Analitis.

Dasar hukum Majelis hakim dalam memutus perkara ini yaitu menggunakan pasal 105 Kompilasi Hukum yaitu Pemeliharaan anak yang belum mumayis atau belum berumur 12 tahun adalah hak ibunya, Pemeliharaan anak yang sudah mumayiz diserahkan kepada anak untuk memilih diantara ayah atau ibunya sebagai pemegang hak pemeliharaannya, Biaya pemeliharaan ditanggung oleh ayahnya Islam, dan pasal 156 Kompilasi Hukum Islam yaitu: Anak yang belum mumayyiz berhak mendapatkan hadhanah dari ibunya. Eksekusi hak asuh anak pada putusan Nomor 1813/Pdt.G/2015/ P.A.Kab.Kediri sudah sesuai Menurut Undang-Undang Nomor 35 Tahun 2014 Tentang Perlindungan Anak yaitu pasal 6 dan 9 ayat (1), (1a),(2).

ABSTRACT

Hadhanah is caring for a person (child) who cannot be independent, educate, and maintain to avoid everything that can damage and bring harm to himself.As for the formulation of the problems in this study are 1. Legal basis for the execution of child custody on a Verdict No. 1813/Pdt.G/2015/PA District of Kediri in the area of jurisdiction of the PA District of Kediri and PA Malang City. the execution of child custody in two areas of jurisdiction (The Study's Verdict Number 1813/Pdt. G/PA. District of Kediri)according to Law No.35 of 2014 concerning Child Protection.

The research method used is the normative legal research or library research method. And the research perspective is use a case approach and a legislative approach.Types of library research (library reasearch) with the help of legislation and case approaches. The legal material which used is Article 105 KHI, 156 KHI, Law No. 35 of 2014 Child Protection and Verdict number 1813/Pdt. G/PA. District of Kedirias primary legal material and supported by literatures or writings that are in accordance with the themes discussed. Furthermore, the data was processed and analyzed using Analytical Descriptive methods.

The legal basis of the court of judges in deciding this case is using Article 105 of the Law Compilation, namely the maintenance of a child who has not mumayyizyet or not turned 12 years yet is his mother's rights, while the maintenance of a child who is mumayyiz, is given to the child himself to choose between his father or mother as his maintenance right holder. Maintenance costs are borne by his father who is a Muslim, and Article 156 of the Compilation of Islamic Law, that is, a child who has not been mumayyizyet due to have hadhanah from his mother. The execution of child custody in Verdict number 1813/Pdt. G/PA. District of Kedirialready in accordance with Law Number 35 of 2014 concerning Child Protection, namely articles 6 and 9 paragraph (1), (1a), (2).

الحضانة هي الصيانة الشخص (الطفل) الذي يمكن أن لا يكون مكتفية ذاتيا وتثقيف ورعاية لتجنب أي شيء يمكن أن يلحق الضرر، وجلب مضارات له.صياغة المشكلة في هذه الدراسة هي: ١. الأساس القانوني لتنفيذ حضانة الأطفال في القرار رقم ١٨١٣/ Pdt.G / PA. منطقة كديريفي مجال اختصاصPAمنطقة كيديري و PAمدينة ماﻻنج؛ ٢.تنفيذ حضانة الطفل في القرار الحكم رقم ١٨١٣/ Pdt.G / PA. منطقة كديريوفقًا للقانون رقم ٣٥ لعام ٢٠١٤ بشأن حماية الطفل.

أما طريقة البحث المستخدمة هي طريقة البحث القانوني المعياري أو الطريقة المكتبات. ونهج البحث هو استخدام نهج الحالةونهج التشريعي.بحوث المكتبة (Library reasearch) بمساعدة التشريعات ونهج الحالات. المواد القانونية المستخدمة هي المادة ١٠٥ من KHI، ١٥٦KHI، القانون رقم ٣٥ لعام ٢٠١٤ لحماية الطفل و الحكم رقم ١٨١٣/ Pdt.G.PA / منطقة كديريكما المواد القانونية الأولية وتدعمها الآداب أو الكتابات التي تتفق مع الموضوعات التي نوقشت. علاوة على ذلك ، تمت معالجة البيانات وتحليلها باستخدام أساليب وصفية تحليلية.

الأساس القانوني مجلس المحكمة لقطع هذه الحالة هي باستخدام المادة ١٠٥ من تجميع القوانين، إلا وهي الحفاظ على طفل لم يكون مميزا أو لم يبلغ بعد ١٢ سنة كان من حق والدته، وفي حين الحفاظ على الطفل الذي قد وصل بالفعل السن فتسليم الأطفال لاختيار بين الأب أو الأم كصاحب الحقوق للصيانة. تكاليف الصيانة التي تكبدتها والده المسلم، والمادة ١٥٦ تجميع للشريعة الإسلامية هي طفل الذي وصل بالفعل السن ذلك يحق الحضانة من والدته.تنفيذ حضانة الأطفال في القرار رقم ١٨١٣/ Pdt.G / PA. منطقة كديرييصلح الفعل وفقا القانون رقم ٣٥لعام٢٠١٤ حول حماية الطفل، وهي المادة ٦ و ٩ الفقرة (١)، (١أ)، (٢).
