Penerbitan sertifikat hak atas tanah pada tanah bekas jalan melalui Regulasi Agraria dan Perspektif Maslahah Mursalah: Study di Jl. Bunga Matahari Kota Malang

ABSTRAK

Tanah merupakan salah satu faktor penting dalam kehidupan manusia yang telah dikaruniakan oleh Tuhan Yang Maha Esa. Dalam arti Yuridis pengertian tanah telah dibatasi dalam Undang-Undang Nomor 5 Tahun 1960 Tentang Dasar Pokok-Pokok Agraria (selanjutnya disebut UUPA), Salah satu bentuk pemindahan hak yang dipraktekkan dalam masyarakat adalah pemindahan hak melalui tukar menukar tanah untuk akses jalan, seperti yang terjadi di Kelurahan Jatimulyo Kecamatan Lowokwaru Kota Malang. Proses tukar menukar akses jalan tersebut dilakukan oleh perorangan dengan masyarakat setempat. Hal ini dilatarbelakangi oleh keinginan sebagian masyarakat yang menginginkan akses jalan ke tempat tinggalnya dipindahkan dan ditukar dengan tanah milik perorangan tersebut dengan cara meminta pihak pemilik lahan itu untuk merelakan tanahnya dipotong untuk dijadikan akses jalan.

Fokus penelitian dalam penelitian ini yaitu Proses Tukar menukar Tanah Bekas Jalan dan proses penerbitan sertifikat tanah bekas jalan yang kemudian dianalisis menggunakan Hak Kepemilikan Atas Tanah Kosong (komparasi Undang-Undang Pokok Agraria No 5 tahun 1960 dan hukum islam.

Jenis penelitian ini merupakan penelitian hukum empiris. Data yang dikumpulkan berupa data primer yang diperoleh melalui proses wawancara. Adapun data sekunder berasal dari Undang-Undang Pokok Agraria No 5 tahun 1960 dan hukum islam.

Dari penelitian tersebut terdapat beberapa Permasalahan akibat dari tukar menukar tanah yang akhirnya muncul sertifikat keterangan bekas jalan. Sehingga penulis mengambil kesimpulan berdasarkan undang-undang dan landasan teori tentang perlindungan konsumen. Bahwasanya tukar menukar tersebut sudah sah akan tetapi kekuatanya hukumnya kurang kuat terkait bekas jakan tersebut tidak bisa di jadikan sertifikat akan tetapi Pihak BPN menyarankan untuk di kembalikan ke asalnya dengan memberikan pemberitahuan kepada warga sekitar dan mendaftarkan kembali sesuai Undang-Undang yang telah di tetapkan.

ABSTRACT

Land is one of the important factors in human life that has been granted by God Almighty. In a Juridical sense the meaning of land has been restricted in Law No. 5 of 1960 on Basic Agrarian Principles (hereinafter referred to as LoGAA). One form of transfer of rights practiced in the community is the transfer of rights through land swaps for road access, in Kelurahan Jatimulyo Kecamatan Lowokwaru Malang City. The process of swapping road access is done by individuals with the local community. This is motivated by the wishes of some people who want access to the residence of the place moved and exchanged with the land owned by the individual by asking the landowner to give up the land cut to be access road.

The research focus of this research is the process of exchanging Land Used Road and the process of making land certificate of the former road which then analyzed using the Right of Ownership on Empty Land (comparation of Basic Agrarian Law No. 5 year 1960 and Islamic law.

This type of research is an empirical law study. The data collected in the form of primary data obtained through interview process. The secondary data comes from the Basic Agrarian Law No. 5 of 1960 and Islamic law

From the research there are several problems resulting from the exchange of land that eventually emerged certificate of information of the former road. So the authors draw conclusions based on the law and the theoretical basis of consumer protection. That exchange is legal but the strength of the law is not strong related to the former can not be made a certificate but the BPN suggested to return to its origin by giving notice to the local residents and register again according to the law that has been set

الأرض هي واحدة من العوامل الهامة في الحياة البشرية التي تم منحها من قبل الله سبحانه وتعالىو في المعنى القضائي تم تقييد معنى الأرض في القانون رقم 5 لعام 1960 بشأن المبادئ الزراعية الأساسية (المشار إليها فيما يلي باسم "قانون"). أحد أشكال نقل الحقوق التي تمارس في المجتمع هو نقل الحقوق من خلال تبادل الأراضي للوصول إلى الطرق كما حدث في Kelurahan Jatimulyo Kecamatan Lowokwaru Malang City. تتم عملية مبادلة الوصول إلى الطرق من قبل الأفراد مع المجتمع المحلي. هذا هو الدافع وراء رغبة بعض الناس الذين يرغبون في الوصول إلى مسكن المكان الذي تم نقله وتبادله مع الأرض التي يملكها الفرد عن طريق مطالبة مالك الأرض بالتخلي عن قطع الأرض ليصبح طريق الوصول.
