Tradisi Bhurcabbhur dalam pernikahan ditinjau dari kaidah Al-'adah Muhakkamah studi pandangan MWCNU di Kecamatan Modung Kabupaten Bangkalan Madura

ABSTRAK

Manusia diberikan karunia oleh Allah SWT berupa pernikahan untuk memasuki kehidupan baru yang bertujuan untuk melanjutkan dan memperbaiki keturunannya. Indonesia merupakan negara besar yang memiliki keanekaragaman adat dan budaya. Mempelajari atau memahami hal ini juga dapat menambah wawasan kepada masyarakat Islam di Indonesia tentang adat. Tradisi yang ada di masyarakat Kecamatan Modung khususnya di desa Langpanggang yaitu Bhurchabbur. Tradisi ini merupakan serangkaian acara dalam pernikahan yang dilakukan setelah proses akad nikah yang mana mempelai wanita dijemput atau diarak oleh keluarga mempelai pria ke tempat kediaman mempelai pria. Penelitian ini bertujuan untuk mendeskripsikan dan menganalisis pendapat ulama MWCNU Kecamatan Modung tentang tradisi bhurcabbhur dalam pernikahan ditinjau dari kaidah al-‘adah muhakkamah serta mengkaji nilai-nilai keyakinan dalam rumah tangga terhadap tradisi bhurcabbhur.

Penelitian ini termasuk jenis penelitian empiris atau penelitian lapangan dengan menggunakan pendekatan kualitatif. Sedangkan sumber data yang digunakan adalah sumber data primer dan sumber data sekunder. Pengumpulan data dalam penelitian ini adalah melalui wawancara dan dokumentasi. Medote analisis data yang digunakan pada penelitian ini adalah analisis deskriptif.

Hasil penelitian ini adalah pertama, nilai-nilai keyakinan dalam rumah tangga terhadap tradisi bhurcabbhur menurut masyarakat desa Langpanggang tidak terdapat nilai-nilai keyakinan apapun jika tidak melakukan tradisi bhurcabbhur akan berakibat pada berlangsungnya pernikahan mereka, karena tradisi ini hanya bersifat sebagai pemberian hadiah untuk pasangan perempuan dari pasangan laki-laki. Bahkan salah satu pengurus MWCNU Kecamatan Modung juga berpendapat bahwa tradisi ini tidak ada konsekuensinya, sekalipun tidak melaksanakan tradisi ini juga tidak apa-apa dan bebas dari anggapan negatif dari masyarakat. Kedua, jika ditinjau dari kaidah al-‘adah muhakkamah bahwa tradisi bhurcabbhur yang dilaksanakan oleh masyarakat desa Langpanggang relevan dan berkaitan dengan kaidah tersebut. Karena dalam kaidah al-‘adah muhakkamah dijelaskan bahwa perbuatan apapun jika tidak bertentangan dengan dalil nash maka hukumnya tidak apa-apa. Adapun pelaksanaan tradisi bhurcabbhur menurut pandangan MWCNU juga tidak bertentangan dengan dalil nash dan tidak ada akibat hukumnya.

ABSTRACT

Man is given a gift by Allah Almighty in the form of marriage to enter a new life aimed at continuing and improving his offspring. Indonesia is a large country that has a diversity of customs and cultures. Learning or understanding this can also add insight to the Islamic community in Indonesia about customs. The tradition that exists in the people of Modung District, especially in Langpanggang village, is Bhurchabbur. This tradition is a series of events in weddings that are carried out after the marriage contract process in which the bride is picked up or paraded by the groom's family to the groom's residence. This study aims to describe and analyze the opinion of the MWCNU scholars of Modung District about the tradition of bhurcabbhur in marriage in terms of the rules of al-'adah muhakkamah and examine the values of belief in the household towards the bhurcabbhur tradition.

This research is a type of empirical research or field research using a qualitative approach. While the data sources used are primary data sources and secondary data sources. Data collection in this study was through interviews and documentation. The data analysis method used in this study is descriptive analysis.

The results of this study are first, the values of belief in the household towards the bhurcabbhur tradition according to the people of Langpanggang village do not have any belief values if they do not carry out the bhurcabbhur tradition will result in their marriage, because this tradition is only as a gift to the female partner of the male partner. Even one of the administrators of MWCNU Modung District also argued that this tradition has no consequences, even if it does not carry out this tradition, it is also okay and free from negative assumptions from the community. Secondly, when viewed from the rules of al-'adah Muhakkamah that the bhurcabbhur tradition carried out by the people of Lang panggang village is relevant and related to these rules. Because in the rules of al-'adah muhakkamah it is explained that any act if it does not contradict the nash proposition then the law is okay. As for the implementation of the bhurcabbhur tradition according to the view of MWCNU, it also does not contradict the nash proposition and there is no legal repercussion.

هذا البحث هو نوع من البحث التجريبي أو البحث الميداني باستخدام نهج نوعي. في حين أن مصادر البيانات المستخدمة هي مصادر البيانات الأولية ومصادر البيانات الثانوية. تم جمع البيانات في هذه الدراسة من خلال المقابلات والتوثيق. طريقة تحليل البيانات المستخدمة في هذه الدراسة هي التحليل الوصفي.
