Pembagian waris pra-kematian pada masyarakat Jawa perspektif teori Hukum Progresif: Studi di Desa Pehserut, Kecamatan Sukomoro, Kabupaten Nganjuk

ABSTRAK

Praktik pembagian waris pra kematian di Desa Pehserut ini merupakan sebuah fenomena waris yang mengikuti hukum adat jawa dengan mengedepankan beberapa aspek kemanfaatan bersama, namun model pembagian waris yang terjadi pada masyarakat Desa Pehserut ini tidak mendapatkan legalitas dalam hukum positif Indonesia. Apalagi semestinya masyarakat Islam secara legalitas mengikuti ketentuan waris yang ada di dalam KHI, namun justru melakukan cara yang sebaliknya.

Tujuan penelitian ini, mendeskripsikan aspek yang menjadi latar belakang masyarakat desa Pehserut melaksanakan pembagian harta warisan pra-kematian pewaris, serta memahami pembagian waris pra-kematian pada masyarakat Desa Pehserut dari perspektif teori hukum progresif. Jenis penelitian ini yaitu penelitian empiris dengan pendekatan kualitatif. Adapun sumber datanya adalah sumber data primer dan data skunder. Metode pengumpulan data dengan wawancara, dokumentasi. Metode pengolahan data adalah pemeriksaan ulang, kategorisasi, mengecek keabsahan data, analisis, dan kesimpulan.

Penelitian ini terdapat dua kesimpulan; Pertama, Hal yang melatar belakangi masyarakat Desa Pehserut melakukan pembagian waris pra kematian karena melihat dari berbagai aspek, yakni 1) pengalaman pribadi, 2) melihat kondisi sosial sekitar, 3) pesan dari orangtua terdahulu. Dari ketiga aspek tersebut semuanya bermuara agar tidak terjadi perpecahan antar keluarga pasca dibaginya harta warisan. Hal ini juga tidak ada yang menyimpang dari ketentuan hukum adat jawa maupun Islam, karena dengan cara demikian pembagian itu lebih mengutamakan kemashlahatan dengan mengedepankan cara musyawarah dan persetujuan anggota keluarga. Sehingga perselisihan antara ahli waris dapat dihindari, seperti sengketa harta benda dan penguasaan harta oleh ahli waris tertentu. Pembagian waris pra-kematian dapat melindungi hak dan kepentingan ahli waris.. Kedua, Metode pembagian harta waris pra-kematian sudah sesuai dengan karakter hukum progresif karena telah memenuhi 4 indikator hukum progresif. Terlihat bahwa masyarakat memilih cara kreatifnya sendiri melakukan pembagian dengan asas kekeluargaan dan keadilan, tidak berpacu pada ketentuan waris dalam KHI bahwa waris dilakukan disaat pewaris wafat dan bagian yang telah ditentukan, serta tidak mengikuti ketentuan hibah dan wasiat yang memberi batas maksimal 1/3, karena hal ini akan menciderai dari tujuan waris itu sendiri bagi masyarakat Jawa Desa Pehserut.

ABSTRACT

The practice of pre-death inheritance distribution in Pehserut Village is an inheritance phenomenon that follows Javanese customary law by prioritizing several aspects of mutual benefit, but the inheritance distribution model that occurs in the Pehserut Village community does not get legality in Indonesian positive law. Islam legally follows the provisions of inheritance in the KHI, but actually does the opposite.

The purpose of this study is to describe the aspects that This is the background for the Pehserut village community to carry out the distribution of the pre-death inheritance of the heirs, and understand the distribution of pre-death inheritance to the Pehserut Village community from the perspective of progressive legal theory. This type of research is empirical research with a qualitative approach. The data sources are primary data sources and secondary data. Methods of data collection with interviews, documentation. Data processing methods are re-examination, categorization, checking the validity of the data, analysis, and conclusions.

This research has two conclusions; First, the background of the people of Pehserut Village in distributing pre-death inheritance from various aspects, namely 1) personal experience, 2) seeing the surrounding social conditions, 3) messages from previous parents. From these three aspects, it all boils down to preventing divisions between families after the division of inheritance. This also does not deviate from the provisions of Javanese and Islamic customary law, because in this way the distribution prioritizes the benefit of the benefit by prioritizing the method of deliberation and approval of family members. So that disputes between heirs can be avoided, such as property disputes and control of property by certain heirs. The distribution of pre-death inheritance can protect the rights and interests of the heirs. Second, the method of dividing pre-death inheritance is in accordance with the character of progressive law because it has fulfilled 4 indicators of progressive law. It can be seen that the community chooses their own creative way of doing distribution based on the principles of kinship and justice, does not rely on the provisions of inheritance in the KHI that inheritance is carried out when the heir dies and the portion that has been determined, and does not follow the provisions of grants and wills which give a maximum limit of 1/3, because this will injure the purpose of inheritance itself for the Javanese people of Pehserut Village.

إن ممارسة توزيع الميراث قبل الوفاة في قرية فهسروت هي ظاهرة ميراث تتبع القانون العرفي الجاوي من خلال إعطاء الأولوية للعديد من جوانب المنفعة المتبادلة ، لكن نموذج توزيع الميراث الذي يحدث في مجتمع قرية فهسروت لا يحصل على شرعية في إندونيسيا القانون الوضعي: يتبع الإسلام قانونا أحكام الميراث في المملكة الأردنية الهاشمية ، لكنه في الواقع يفعل العكس ،

والغرض من هذه الدراسة هو وصف الجوانب التي هذه هي الخلفية لمجتمع قرية فهسروت للقيام بتوزيع ميراث الورثة قبل الموت ، وفهم توزيع ميراث ما قبل الوفاة على مجتمع قرية فهسروت من منظور النظرية القانونية التقدمية. هذا النوع من البحث هو بحث تجريبي ذو نهج نوعي. مصادر البيانات هي مصادر البيانات الأولية والبيانات الثانوية. طرق جمع البيانات مع المقابلات والتوثيق. طرق معالجة البيانات هي إعادة الفحص والتصنيف والتحقق من صحة البيانات والتحليل والاستنتاجات.

هذا البحث له نتيجتان ؛ أولاً، خلفية أهالي قرية فهسروت في توزيع ميراث ما قبل الوفاة من جوانب مختلفة ، وهي ١) التجربة الشخصية ، ٢) رؤية الظروف الاجتماعية المحيطة ، ٣) رسائل من الآباء السابقين. من هذه الجوانب الثلاثة ، يتلخص الأمر كله في منع الانقسامات بين العائلات بعد تقسيم الميراث. وهذا أيضًا لا يحيد عن أحكام القانون العرفي الجاوي والإسلامي ، لأن التوزيع بهذه الطريقة يعطي الأولوية للاستفادة من خلال إعطاء الأولوية لطريقة التداول والموافقة على أفراد الأسرة. بحيث يمكن تجنب الخلافات بين الورثة ، مثل النزاعات على الملكية والسيطرة على الممتلكات من قبل ورثة معينين. يمكن أن يحمي توزيع الميراث قبل الوفاة حقوق ومصالح الورثة وثانيًا، أن طريقة قسمة الميراث قبل الوفاة تتوافق مع طبيعة القانون التقدمي لأنه حقق ٤ مؤشرات من القانون التقدمي. يمكن ملاحظة أن المجتمع يختار طريقته الإبداعية الخاصة في التوزيع على أساس مبادئ القرابة والعدالة ، ولا يعتمد على أحكام الميراث في تجميع الشريعة الإسلامية التي تتم الميراث عند وفاة الوريث والجزء الذي تم توفيره. محددة ، ولا تتبع أحكام الهبات والوصايا التي تعطي حدًا أقصى قدره ٣/١، لأن هذا سيضر بالغرض من الميراث نفسه لشعب قرية فهسروت الجاوي.
