Tinjauan hukum terhadap peran Lembaga Amil Zakat dalam peningkatan kesejahteraan yatim dan dhuafa di masa pandemi Covid-19: Studi kasus di Lembaga Amil Zakat Nasional Yatim Mandiri Tuban

ABSTRAK

Lembaga Amil Zakat dalam melaksanakan tugas tertuang pada pasal 17 UU No. 23 Tahun 2011 dalam proses pengumpulan, pendistribusian, dan pendayagunaan zakat. LAZNAS Yatim Mandiri Tuban dipercaya oleh muzakki dalam mengelola dana zakat yang dititipkan muzakki agar dapat bermanfaat dan mensejahterakan mustahik. Akan tetapi menjadi tantangan tersendiri bagi LAZNAS Yatim Mandiri Tuban ketika muncul permasalahan global yakni pandemi covid-19. Pandemi covid-19 berdampak pada berbagai sektor, khususnya di bidang ekonomi. Akibat covid-19 mempengaruhi perzakatan di Indonesia yang disebabkan krisis ekonomi. Berhubungan dengan hal itu diharapkan LAZNAS Yatim Mandiri Tuban menjadi agen perubahan ekonomi bagi masyarakat Tuban di masa pandemi covid-19 melalui program-program yang dimiliki LAZNAS Yatim Mandiri Tuban. Penelitian yang digunakan adalah jenis penelitian yuridis empiris yaitu untuk mengkaji ketentuan hukum yang berlaku dengan apa yang terjadi dalam kenyataan di masyarakat, dengan cara melakukan wawancara. Tujuan dari penelitian ini adalah untuk mengetahui peran Lembaga Amil Zakat Nasional dalam pengelolaan zakat produktif untuk meningkatkan kesejahteraan yatim dan dhuafa di masa pandemi covid-19 serta berbagai kendala yang menyertainya.

Hasil penelitian menunjukkan bahwa Lembaga Amil Zakat Nasional (LAZNAS) Yatim Mandiri Tuban dalam pendistribusian zakat dilakukan dengan dua metode, yakni konsumtif dan produktif. Dan pendayagunaan zakat dilakukan melalui dua program yang dimiliki LAZNAS Yatim Mandiri Tuban yakni program pendidikan dan pemberdayaan (ekonomi). Program pendidikan dilaksanakan melalui kegiatan “Sanggar Genius” dan program pemberdayaan (ekonomi) dilaksanakan melalui kegiatan “Bunda Yatim Sejahtera”, dan di masa pandemi covid-19 ada inovasi di bidang pemberdayaan yakni “UMKM Bangkit”. Dalam praktiknya LAZNAS Yatim Mandiri Tuban banyak mendistribusikan zakat dengan metode produktif yang bertujuan untuk memandirikan mustahik dengan kegiatan produktif. Pengelolaan zakat yang dilakukan LAZNAS Yatim Mandiri Tuban telah sesuai dengan Undang-Undang Nomor 23 tahun 2011. Walaupun dalam proses pendayagunaan zakat yang dilakukan belum berhasil sepenuhnya, yang disebabkan oleh kendala di masa pandemi yakni adanya pembatasan sosial di masa pandemi berpengaruh pada sistem pengelolaan zakat produktif.

ABSTRACT

The Amil Zakat Institution in carrying out its duties is stated in Article 17 of Law Number 23 of 2011 in the process of collecting, distributing, and utilizing zakat. LAZNAS Yatim Mandiri Tuban is trusted by muzaki in managing zakat funds that muzaki has entrusted so that it can be useful and prosper mustahik. However, it became a challenge for LAZNAS Yatim Mandiri Tuban when a global problem emerged, namely the Covid-19 pandemic. The Covid-19 pandemic has had an impact on various sectors, especially in the economic sector. As a result of Covid-19 affecting zakat in Indonesia due to the economic crisis. In this regard, it is hoped that LAZNAS Yatim Mandiri Tuban will become an agent of economic change for the people of Tuban during the Covid-19 pandemic through programs owned by LAZNAS Yatim Mandiri Tuban. The research used is a type of empirical juridical research, namely to examine the applicable legal provisions with what happens in reality in society, by conducting interviews. The purpose of this study was to determine the role of the National Amil Zakat Institution in the management of productive zakat to improve the welfare of orphans and poor people during the Covid-19 pandemic and the various obstacles that accompany it.

The results showed that the National Amil Zakat Institution (LAZNAS) Yatim Mandiri Tuban in the distribution of zakat was carried out by two methods, namely consumptive and productive. And the utilization of zakat is carried out through two programs owned by LAZNAS Yatim Mandiri Tuban namely education and empowerment (economic) programs. The education program is carried out through the "Sanggar Genius" activity and the empowerment (economic) program is carried out through the "Bunda Yatim Sejahtera" activity, and during the Covid-19 pandemic there was an innovation in the field of empowerment namely "UMKM Bangkit". In practice, LAZNAS Yatim Mandiri Tuban distributes zakat with productive methods that aim to make mustahik independent with productive activities. The zakat management carried out by LAZNAS Yatim Mandiri Tuban is in accordance with Law Number 23 of 2011. Although the zakat utilization process has not been fully successful, due to obstacles during the pandemic, namely the social restrictions during the pandemic, it affects the productive zakat management system.

وأظهرت النتائج أن المؤسسة الوطنية للزكاة يتيم منديري توبان عامل في توزيع الزكاة نفذت بطريقتين هما الاستهلاكي والإنتاجي. ويتم الاستفادة من الزكاة من خلال برنامجين مملوكين لمؤسسة عامل الزكاة الوطنية يتيم مانديري توبان ، وهما برامج التعليم والتمكين (الاقتصادي). يتم تنفيذ برنامج التعليم من خلال نشاط "استوديو عبقري" ويتم تنفيذ برنامج التمكين (الاقتصاديات) من خلال نشاط "أم يتيم مزدهرة" ، وخلال جائحة كوفيد -۱۹ كان هناك ابتكار في مجال التمكين وهو "ارتفاع المشروعات متناهية الصغر والصغيرة والمتوسطة ". من الناحية العملية ، توزع مؤسسة عامل الزكاة الوطني في توبان يتيم منديري الزكاة بأساليب إنتاجية تهدف إلى جعل مستحيق مستقلاً من خلال الأنشطة الإنتاجية. تتماشى إدارة الزكاة التي تنفذها مؤسسة العامل الوطني للزكاة يتيم منديري توبان مع القانون رقم ۲۳ لسنة ۲۰۱۱. على الرغم من أن عملية الاستفادة من الزكاة لم تكن ناجحة بالكامل ، بسبب العقبات أثناء انتشار الوباء ، وهي وجود قيود اجتماعية خلال فترة انتشار الوباء. وباء يؤثر على نظام إدارة الزكاة المنتجة.
