Implementasi konsep smart city menurut peraturan walikota Surabaya nomor 61 tahun 2016 dalam Perspektif Maslahah Mursalah

ABSTRAK:

Didalam smart city yang telah berkembang di Kota Surabaya maka perlu sebuah kebijakan implementasi untuk melihat atau menilai tentang berjalannya smart city. Langkah utama Pemerintah Kota Surabaya di dalam membangun smart city ialah mengalangkan Pemerintah Kotanya, yang kemudian dapat dikembangkan lagi ke masyarakat melalui pelayanan yang diberikan secara teknologi dan praktif inovatif yang berdasarkan dalam perspektif maslahah mursalah. Namun dengan konsep ini mampukah pemerintah Kota Surabaya mewujudkan smart city dengan berpedoman pada peranturan Walikota Surabaya Nomor 61 Tahun 2016 yang semana mestinya telah diatur didalam Peraturan sehingga dapat dijalankan dengan baik dan efisien.

Penelitian ini berfokus pada Peraturan hukum 1) implemetasi konsep smart city menurut Peraturan Walikota Surabaya Nomor 61 Tahun 2016, 2) Tahapan konsep Smart city menurut Peraturan Walikota Surabaya dalam perspektif Maslahah Mursalah.

Metode penelitian ini mengunakan Yuridis empiris dengan pendekatan penelitian mengunakan Yuridis Sosiologis hukum sebagai Law In action. Sedangkan metode penelitian mengunakan Yuridis Kualitatif dengan teknik pengumpulan data berupa wawancara, observasi dan dokumentasi.

Hasil penelitian ini, pertama menegaskan bahwa implementasi konsep Smart city sudah dijalankan sesuai ketentuan Perwali 61 Tahun 2016 tentang kedudukan, Susunan Organisasi, Uraian Tugas dan Fungsi serta Tata Kerja Dinas Komunikasi dan Informatika Kota Surabaya dalam mengatur dan menempatkan Dinas Komunikasi dan Informatika atau lembaga lainnya sesuai dengan Peraturan yang telah ditetapkan perihal struktur kinerja, bidang pemberdayaan, rincian tugas dalam aspek legalitas berstruktur. Alhasil dari serangkaian tugas organisasi yang diberikan oleh pihak wewenang dapat mengevaluasi tugas harian maupun tahunan bagi aparat dapat memajukan smart city Kota Surabaya. Kedua menurut pandangan perspektif Maslahah Mursalah dalam kebijakan smart city Kota Surabaya sudah termasuk kedalam yaitu mendatangkan manfaat dan menolak kemudharatan, dilihat dari segi fungsi smart city semuanya memiliki keuntungan dan manfaat bagi seluruh masyarakat Kota Surabaya.

In a smart city that has developed in the city of Surabaya, an implementation policy is needed to see or assess the running of the smart city. The main step of the Surabaya City Government in building a smart city is to mobilize the City Government, which can then be developed again to the community through services provided by technology and innovative practices based on the perspective of maslahah mursalah. However, with this concept, can the Surabaya City government realize a smart city based on the Surabaya Mayor Regulation Number 61 of 2016 which should have been regulated in the Regulations so that it can be run properly and efficiently.

This study focuses on legal regulations 1) the implementation of the smart city concept according to the Surabaya Mayor Regulation Number 61 of 2016, 2) the stages of the Smart city concept according to the Surabaya Mayor Regulation in the perspective of Maslahah Mursalah.

This research method uses empirical juridical research approach using sociological juridical law as law in action. While the research method uses qualitative juridical with data collection techniques in the form of interviews, observations and documentation.

The results of this study, firstly, confirms that the implementation of the Smart city concept has been carried out in accordance with the provisions of Perwali 61 of 2016 concerning the position, organizational structure, job descriptions and functions as well as the work procedure of the Surabaya City Communication and Information Office in regulating and placing the Communication and Information Office or other institutions in accordance with the regulations. with the regulations that have been set regarding the performance structure, the field of empowerment, the details of the task in the aspect of structural legality. As a result, from a series of organizational tasks given by the authorities, they can evaluate daily and annual tasks for the apparatus to advance the smart city of Surabaya.
