Abstract
INDONESIA:
Islam telah banyak mengajarkan untuk membina rumah tangga atas dasar saling ridho dan musyawarah. Agar dalam mengarungi bahtera rumah tangga antar pasangan suami istri senantiasa disertai dengan penuh kasih, baik dikala senang maupun susah, karena pada dasarnya semua manusia menginginkan pernikahan yang abadi. Pada dasarnya, pernikahan bukanlah hanya pertemuan lahir laki-laki dan wanita, akan tetapi dalam pernikahan juga untuk mendapatkan kebahagiaan, ketenangan dan kedamaian jiwa.
Dalam mayarakat Indonesia, khususnya di wilayah pedesaan, kawin paksa ternyata masih banyak terjadi. Semua itu disebabkan karena banyak faktor, salah satu alasan terbesar yaitu faktor ekonomi. Para wali mengawinkan anaknya dengan tujuan memperbaiki ekonomi keluargayang kekurangan, sehingga dengan dengan orang yang lebih kaya agar bisa membantu menyukupi kehidupan sehari-hari. Adapun Salah satu contoh desa yang penduduknya banyak di dapati praktik kawin paksa yaitu Desa Gampingan Kecamatan Pagak Kabupaten Malang.
Dari fakta diatas, peneliti ingin mengetahui mengenai kasus kawin paksa, faktor-faktornya, serta pandangan tokoh masyarakat, wali nikah, pelaku kawin paksa serta sebagiann masyarakat setempat Desa Gampingan Kecamatan Pagak Kabupaten Malang dan tinjauan maqashid al-syari’ah mengenai kasus tersebut.
Penelitian ini menggunakan jenis penelitian lapangan. Adapun pendekatan yang digunakan dalam penelitian ini adalah pendekatan sosiologis empiris, yaitu dengan cara turun langsung ke lapangan dan melakukan pengamatan, wawancara, atau penelaahan dokumen.
Hasil penelitian menyimpulkan bahwa awalmula terjadinya kawin paksa diawali dari kesulitan warga dalam mencukupi kebutuhan sehari-hari dan adanya pendatang dari Madura yang membawa tradisi kawin paksa. Terdapat 7 faktor yang dijadikan alasan wali dalam melakukan kawin paksa, diantaranya ialah: ekonomi, pergaulan bebas/tingkah laku, tidak setuju dengan pilihan anak, perjanjian, ikatan persaudaraan, balas budi, adat perjodohan, hamil di luar nikah. Dalam pandangan maqashid al-syariah, praktik kawin paksa ini tidak diperbolehkan untuk dilakukan, karena lebih banyak mengandung unsur negatifnya (kemudharatan) dari pada unsur positifnya (maslahah). Diantara unsur negatifnya seperti: hilangnya hak perempuan dalam memilih pasangan, psikologi yang tertekan sebab tidak ada kerelaan, serta juga akan berpeluang besar terjadi penindasan karena tidak sederajat dan akan banyak terjadi pertengkaran karena pemikiran yang tidak selaras sehingga tidak jarang berujung kepada perceraian.

Islam has a lot to teach us in the household on the basis of fostering mutual ridho and deliberation. So that in wading through the ark households between married couples are always accompanied by a loving, while at the break happy nor difficult, because basically all human beings want a lasting marriage. Basically, the marriage is not only the meeting was born the man and woman in marriage, but also to get happiness, serenity and peace of the soul.
In Indonesian society, especially in rural areas, forced marriages was still a lot going on. All of that is due to many factors, one of the biggest reason i.e. economic factors. The Trustees gave her son with the aim of fixing the family economy which is very less, so make a marriage with the richer people in order to help fullfill the needs of everyday. As for one example of many of the inhabitants of the village is found the forced marriages practices i.e. Gampingan –Pagak-Malang.
From the facts above, researchers want to find out about cases of forced marriages, the factors, as well as the views of community leaders, caregivers, the perpetrator of forced marriages as well as local community atGampingan–Pagak- Malang, and preview of Maqashid Al-Syari’ahregarding such cases.
This research use this type of field research. As for the approach used in this study is the empirical sociological approach, that is by the way down directly to the field and conducting observation, interview, or review documents.
Results of the study concluded that the occurrence of forced marriages starts beginning of trouble citizens in sufficient daily necessities and the madurese settlers brought the tradition of forced marriages. There are 7 factors which excuse the forced marriages in the conduct of guardians, among which are: the economy, the free association, did not agree with the choice of the child, the agreement, the bonds of brotherhood, favors, custom of arranged marriages, pregnant outside of marriage. In view of maqashid al-syariah, practice of forced marriages is not allowed to do, as more negative elements contains than on positive elements. Among its negative elements such as: the loss of women's rights in choosing a spouse, psychology is depressed because there was no readiness, as well as a great opportunity will also happen because of oppression are not equal and will happen many quarrels because of thinking that is not aligned so there rarely led to divorce.
