Implementasi pasal 8 dan pasal 9 Permenkeu RI nomor 7/PMK.07/2020 dalam mewujudkan kesadaran hukum masyarakat : Studi di Kecamatan Gondanglegi Kabupaten Malang

ABSTRAK:

Implementasi Peraturan Menteri Keuangan Republik Indonesia Nomor 7/PMK.07/2020 Tentang Penggunaan, Pemantauan, dan Evaluasi Dana Bagi Hasil Cukai Hasil Tembakau yang berisikan meningkatkan efektifitas penggunaan BDH CHT untuk menanggulangi dampak negatif rokok. Terutama Pasal 8 dan Pasal 9 yang berisikan tentang program penyampaian informasi ketentuan perundang-undangan di bidang cukai kepada masyarakat dan program pemberantasan peredaran barang kena cukai ilegal yang dilakukan oleh pemerintah daerah yang berkoordinasi dengan bea cukai setempat. Tujuan dilakukan penelitian ini adalah untuk mengetahui apa partisipasi masyarakat dalam pemberantasan peredaran rokok ilegal dan apakah upaya pemerintah daerah dan Bea Cukai setempat dalam memberikan pemahaman kepada masyarakat mengenai pemberantasan peredaran rokok ilegal berjalan dengan baik dilapangan atau belum.

Jenis penelitian ini merupakan penelitian yuridis empiris. Kemudian pendekatan yang digunakan adalah pendekatan yuridis sosiologis. Lokasi penelitian dalam penelitian ini adalah Kecamatan Gondanglegi Kabupaten Malang. Sumber data yang digunakan dalam penelitian ini adalah diperoleh dengan cara observasi, wawancara dan dokumetasi, perundang-undangan, buku-buku, dan sumber data tertulis yang berkaitan dengan bea dan cukai, dan kesadaran hukum.

Hasil dari penelitian ini menyimpulkan bahwa, partisipasi masyarakat pedagang (pemilik Toko/Warung) di Kecamatan Gondanglegi dalam pemberantasan peredaran rokok ilegal masih rendah, hal itu ditandani dengan sekitar 56% sampel terlibat dalam praktik peredaran rokok ilegal dari kesuluran 50 sampel yang penulis tentukan, dan upaya Pemerintah Kabupaten Malang dan KPPBC Tipe Madya Malang menjalankan sosialisasi ketentuan di bidang cukai dan penindakan pelanggaran di bidang cukai berupa pengumpulan informasi, penyampaian informasi yang meliputi forum tatap muka, sosialisasi sobo pasar, penyebaran informasi berupa pamphlet, baliho ataupun melalui penayangan videotrone, dan penindakan berupa operasi pasar dan penangkapan bertujuan untuk mewujudkan kesadaran hukum masyarakat terhadap pemberantasan peredaran rokok ilegal.

ABSTRACT:

Implementation of Regulation of the Minister of Finance of the Republic of Indonesia Number 7 / PMK.07 / 2020 Concerning Use, Monitoring, and Evaluation of Tobacco Excise Profit Sharing Funds, which contain the effectiveness of using BDH CHT to overcome the negative effects of smoking. Particularly Article 8 and Article 9 which contain programs for the delivery of information on statutory provisions in the field of excise to the public and programs to eradicate the circulation of illegal excisable goods carried out by local governments in coordination with local customs. The purpose of this research is to find out what is the community participation in the eradication of illegal cigarette circulation and whether the local government efforts and Customs local in providing understanding to the community about the eradication of illegal cigarette circulation is running well in the field or not.

Types of this research is an empirical juridical research. Then the approach used is the sociological juridical approach. The research location in this study is Gondanglegi District, Malang Regency. Sources of data used in this research are obtained by means of observation, interviews and documentation, legislation, books, and written data sources. Related to customs and excise, and legal awareness.

The results of this study concluded that, the participation of the merchant community (shop owners) in Gondanglegi District in the eradication of the circulation of illegal cigarettes is still low, this is indicated by around 56% of the sample involved in the practice of distributing illegal cigarettes from the 50 samples that the author specified, and the efforts of the Malang Regency Government and Malang Intermediate Type KPPBC socializing the provisions in the excise sector and prosecuting violations in the excise sector in the form of information gathering, submission of information including face-to-face forums, socialization of sobo markets, dissemination of information in the form of pamphlets, billboards or through videotrone viewing, and action in the form of market operations and arrests aimed at creating awareness community law against the eradication of illegal cigarettes.

التنفيذ لائحة وزير المالية جمهورية إندونيسيا رقم ٧/ف م ك.٠٧/ ٢٠٢٠ فيما يتعلق باستخدام ومراقبة وتقييم أموال تقاسم الإنتاج الضريبي للتبغ الذي يحتوي على زيادة فعالية الاستخدام صندوق تقاسم أرباح الإنتاج الضريبي للتبغ لمعالجة الآثار السلبية للتدخين. لا سيما المادة ٨ والمادة ٩ اللتان تحتويان على برامج لإيصال المعلومات عن الأحكام القانونية في مجال المكوس إلى الجمهور وبرامج القضاء على تداول السلع غير المشروعة القابلة للانتقال التي تنفذها الحكومات المحلية بالتنسيق مع الجمارك المحلية. الغرض من هذا البحث هو معرفة ما هي المشاركة المجتمعية في القضاء على التوزيع غير القانوني للسجائر وما إذا كانت جهود الحكومة المحلية والجمارك المحلية والمكوس في توفير الفهم للمجتمع فيما يتعلق بالقضاء على تداول السجائر غير القانوني تعمل بشكل جيد في هذا المجال أم لا.

هذا النوع من البحث هو بحث قانوني تجريبي. ثم النهج المستخدم هو النهج القانوني الاجتماعي. موقع البحث المستخدم في هذه الدراسة هو منطقة جوندانجليجي ، ريجنسي مالانج. يتم الحصول على مصادر البيانات المستخدمة في هذا البحث من خلال الملاحظة والمقابلات والتوثيق والتشريعات والكتب ومصادر البيانات المكتوبة المتعلقة بالجمارك والمكوس والوعي القانوني.

وخلصت نتائج هذه الدراسة إلى أن مشاركة مجتمع التجار (أصحاب المحلات) في مقاطعة جوندانجليجي في القضاء على تداول السجائر غير المشروعة لا تزال منخفضة٬ تم تمييزه بحوالي ٥٦٪ من العينة المشاركة في ممارسة تداول السجائر غير القانونية من بين ٥٠ عينة حددها المؤلفون، وجهود حكومة مالانج ريجنسي ومكتب مراقبة الجمارك والضرائب والخدمات من النوع الأوسط مالانج تنفيذ التنشئة الاجتماعية لأحكام في مجال المكوس وملاحقة المخالفات في قطاع المكوس في شكل جمع المعلومات وتقديم المعلومات التي تشمل المنتديات وجها لوجه٬ التنشئة الاجتماعية لأسواق السوبو ، ونشر المعلومات في شكل كتيبات أو لوحات إعلانية أو من خلال المشاهدة عبر الفيديو ، والمقاضاة في شكل عمليات السوق والاعتقالات التي تهدف إلى تحقيق الوعي القانوني العام للقضاء على السجائر غير المشروعة.
