Variasi penentuan wali hakim di KUA Kecamatan Gempol Kabupaten Pasuruan tahun 2016-2018 perspektif Kompilasi Hukum Islam

Di Kantor Urusan Agama Kecamatan Gempol Kabupaten Pasuruan sering sekali terjadi pelaksanaan perkawinan dengan wali hakim. Bahkan tiap tahun dari tahun 2016-2018 terjadi peningkatan angka. Tidak hanya itu, namun juga alasan-alasan yang digunakan sebagai dasar penunjukan wali hakim pun beragam dan apakah sudah sesuai dengan yang ditetapkan dalam undang-undang yang telah mengaturnya atau justru sebaliknya.

Dalam penelitian ini terdapat dua rumusan masalah yaitu: apa faktor yang melatarbelakangi pernikahan menggunakan wali hakim di KUA Kecamatan Gempol Kabupaten Pasuruan, dan penentuan wali hakim di KUA Kecamatan Gempol Kabupaten Pasuruan perspektif KHI. Penelitian ini menggunakan metode jenis penelitian yuridis empiris dan pendekatan deskriptif-kualitatif. Kemudian dalam memperoleh data di lapangan melalui wawancara dan dokumentasi. Sedangkan dalam proses pengolahan data menggunakan teknik edit, verifikasi, klasifikasi, analisis, dan kesimpulan.

Dari hasil penelitian ini dapat dipahami bahwa faktor yang menjadi penyebab banyaknya pernikahan menggunakan wali hakim di KUA Kecamatan Gempol Kabupaten Pasuruan adalah karena calon pengantin wanita yang tidak punya wali nasab, walinya tidak diketahui keberadaannya, wali yang sedang berada dalam jarak jauh, di luar nikah, wali nonmuslim, wali adhal, dan wali yang sakit ingatan. Dari tahun 2016-2018 pun terjadi peningkatan angka pernikahan menggunakan wali hakim. Di tahun 2016 ada 43 kasus, tahun 2017 ada 52 kasus, dan di tahun 2018 ada 64 kasus. Pernikahan dengan wali hakim tidak jauh berbeda, yang membedakan hanya wali yang menikahkan saat ijab qabul dan nama wali hakim tersebut tercatat di dalam buku nikah. Pelaksanaan perkawinan menggunakan wali hakim di Kantor Urusan Agama Kecamatan Gempol Kabupaten Pasuruan dalam penetapannya pun telah sesuai dengan Kompilasi Hukum Islam.

In the Office of Religious Affairs, Gempol District, Pasuruan Regency, marriages often take place using the magistrate guardian. Even during year 2016 until 2018 there was an increase in the number of marriages. The reasons used as the basis for appointing the magistrate guardian are various and whether that implementation have accordance with those stipulated in the laws or quite the opposite.

In this study the focus of the problem determined is: what is the factors cause the marriage using the magistrate guardian in KUA Gempol District of Pasuruan Regency and analysis of the application of KHI in the determination of the magistrate guardian. This type of research is empirical juridical and uses a descriptive-qualitative approach. Source of research data obtained from the field through interviews and documentation. The data processing uses the techniques of editing, verification, classification, analysis and conclusions.

The results of this study indicate that the factors that cause the number of marriages using a guardian judge in KUA Gempol Subdistrict Pasuruan Regency is because the prospective bride does not have the marriage guardian, the guardian of the bride is not known to exist, the guardian is at a distance, the woman marries outside marriages, non-Muslim guardians, guardians adhal, and guardians who are mentally ill. From year 2016 until year 2018 there has also been an increase in the number of marriages using the magistrate guardian. In 2016 there were 43 cases, in 2017 there were 52 cases and in 2018 there were 64 cases. Marriages performed with the magistrate guardian are not much different from ordinary marriages. The one of difference is the guardian who marries the bride at the consent ijab qobul and the name of the magistrate guardian is recorded in the marriage book. The implementation of the marriage using the magistrate guardian at the Office of Religious Affairs in the Gempol District of Pasuruan Regency in its determination was in accordance with the Compilation of Islamic Law.

كثير من المجتمع في مقاطعة غيمبول يعملون عقد النكاح باستخدام ولي الحاكم. بل وجود ارتفاع جدول بين سنة 2016 حتى 2018. و الحجات الذين استخدموا المجتمع متفرقة، و السؤال هنا هل هذه الحجات من المجتمع يعادلون بالقوانين المعالقة أو العكس؟.

بذلك أخذت الباحثة مشكلة البحث بهذه الواقعة إلى مشكلتين: 1) ما الأسباب عقد النكاح باستخدام بولي الحاكم بهذه المقاطعة؟ 2) كيف تحليل عملية مجموعة الأحكام الإسلامية على تحديد ولي الحاكم في المجتمع؟. هذا البحث الجامعي نوع من البحث الميداني بتقريب الوصفي النوعي. كان المقابلة و التوثيق منهجا لأخذ البيانات في الميدان. و أما تحليل البيانات استخدمت الباحثة عن طريق تدقيق، تصنيف، تحليل، و أخذ الاستنباط.

الاستنباط من هذا البحث الجامعي أن الأسباب يجعلون عقد النكاح باستخدام ولي الحاكم في هذه المقاطعة هو عدم ولي النسب عند الزوجة، عدم المعرفة عن موقع ولي النسب، وجود الولي بمسافة بعيدة، ولدت بالزنى، الولي ليس مسلما، ولي الأضل، الولي مرض الأقل. بوجود هذه الأسباب وجود ارتياق الجدول عن استخدام ولي الحاكم منذ سنة 2016 حتى 2018 . كما كتب في الوثائق 43 مشكلة في السنة 2016، و 52 مشكلة في السنة 2017، و 64 مشكلة في السنة 2018. و النكاح بولي الحاكم ليس فيه التفريق بولي النسب إلا عاقد النكاح مكتوبا كاالولي النسب. و عملية النكاح بولي الحاكم بهذه المقاطعة يعادل بالقوانين و مجموعة الأحكام الإسلامية.
