Penyelesaian problematika wali mafqud di Kantor Urusan Agama Kota Batu tahun 2017-2019

Salah satu permasalahan utama dalam pernikahan adalah persoalan mengenai wali nikah. Ketika terjadi masalah yang berkaitan dengan wali, salah satu solusinya adalah wali hakim. Wali mafqud salah satu alasan berpindahnya hak kewalian kepada wali hakim. Sangat disayangkan dalam proses pengajuan dan penetapan wali mafqud terjadi beberapa masalah. Rumusan masalah pada penelitian ini yakni: Apa saja problematika yang dihadapi Kantor Urusan Agama Kota Batu berkaitan dengan wali mafqud? Bagaimana penyelesaian problematika yang dihadapi Kantor Urusan Agama Kota Batu terkait dengan wali mafqud?

Penelitian ini menggunakan jenis penelitian empiris dengan pendekatan case approach berbasis deskriptif analitis. Data primer diperoleh dari hasil wawancara dengan kepala KUA dan penghulu di setiap KUA di Kota Batu. Sementara data sekunder diperoleh dari buku-buku atau sumber lain yang berkaitan dengan materi penelitian seperti jurnal, UU, PMA dan KHI. Data yang diperoleh dari lapangan kemudian diperiksa, lalu diklasifikasi, kemudian diverifikasi dan dianalisis, terakhir diambil kesimpulan dari hasil analisis tersebut.

Hasil dari penelitian ini adalah, beberapa permasalahan yang berkaitan dengan wali mafqud diantaranya yaitu, adanya pemalsuan data dan tidak terbukanya para pihak dalam hal ini calon pengantin dan keluaga dalam memberikan keterangan pada saat pemeriksaan data oleh KUA. Lalu langkah-langkah yang dilakukan KUA menyikapi masalah wali mafqud adalah memanggil para pihak yang bersangkutan untuk datang ke kantor. Tujuannya adalah memberikan teguran dan arahan kepada semua pihak yang bersangkutan, membatalkan pengajuan wali hakim dan diganti dengan wali nasab serta meminta para pihak untuk memperbaiki data yang salah. Kemudian ketika diketaui terjadi permasalahan keluarga yang mengakibatkan adanya pemalsuan data, KUA berupayah menjadi pihak penengah.

One of the main problems in marriage is the issue of marriage guardians (wali nikah). When there are problems relating to guardians, one solution is the magistrate guardian (wali hakim). Wali mafqud is one of the reasons for the transfer of guardianship rights to the magistrate guardian. Unfortunately, the process of filing and establishing wali mafqud contains several problems. The problem in this research is: what are the problems faced by KUA of Batu City in related to wali mafqud? How is the settlement problematics faced by KUA of Batu City in related to wali mafqud?

This study used empirical research with a descriptive-analytical case approach. Primary data were obtained from interviews with the head of the KUA and the headman (penghulu) of each KUA in Batu City. While secondary data was obtained from books or other sources related to research material such as journals, laws, PMA, and KHI. Data obtained from the field were then checked, classified, verified, and analyzed. Finally, conclusions were drawn from the results of the analysis.

The results of this research related to issues regarding wali mafqud includes the existence of data falsification and the non-disclosure of the parties, in this case is the bride and groom, in providing information when data checking is conducted by KUA. Then the steps taken by KUA to address the issue of wali mafqud are to call the parties concerned to come to the office. The aim is to give a reprimand and direction to all parties concerned, cancel the submission of the magistrate guardian and be replaced with the family guardian (wali nasab), and ask the parties to correct the wrong data. Then, when it was discovered that a family problem occurred which resulted in the falsification of the data, KUA tried to become a mediator.

واحدة من المشاكل الرئيسية في الزواج هي قضية ولي الزواج. عند ما تكون شاكل تتعلق ولي الزواج، فحله هو ولي القاضي.يسمى بولي المفقود وهو أحد الأسباب نقل حقوق الوصاية لولي القاضي. ولكن في عملية التقديم وتكوين ولي المفقو هناك بعض المشاكل .المشكلة في هذا البحث هي: ما هي المشاكل التي يواجهها مكتب الشؤون الدينية بمدينة باتو فيما يتعلق بالولى مفقود؟ كيف حل المشاكل التي يواجهها مكتب الشؤون الدينية بمدينة باتو فيما يتعلق بالولى مفقود؟

تستخدم الباحثة في هذا البحث هو البحث التجريبي بمنهج وصفي تحليلي، تحصل الباحثة البيانات الأولية من المقابلات مع الرأس و رئيس في كل مكتب الشؤون الدينية بمدينة باتو. وأما البيانات الثانوية تحصل الباحثة من الكتب أو المصادر الأخرى المتعلقة بمواد البحث مثل المجلات و القانون، و تنظيم وزير الدين و تجميع الشريعة الإسلامية. البيانات التي حصل من الميدان، ثم فحصها، ثم تضيفها، ثم التحقق منها و تحليليها، و أخيرا يتم النتائج من نتائج التحليل

أما نتائج هذا البحث هو، بعض المشكلات المتعلقة بولي مفقود هو يكون تزوير البيانات ولم تفتح الأطراف يعني العروس والعريس والأسراة في تقديم المعلومات في وقت فحص البيانات من مكتب الشؤون الدينية. ثم الخطوات التي اتخذها مكتب الشؤون الدينية في الرد مشكلة ولي مفقود هي دعوه الأطراف المعنية للحضور إلى المكتب. والهدف من ذلك هو إعطاء تحذير والتوجيه لجميع الأطراف المعنية. وإلغاء تقديم ولي القضي واستبدالها بولي النصاب، و اسأل الأطراف لتصحيح البيانات الخطاء. ثم عندما تحدث مشاكل عائلية تؤى إلى تزوير البيانات، ثم يسعى مكتب الشؤون الدينية ليصبح وسيطا.
