Buying and selling of Joox vip account under prespective of Indonesian civil code and compilation of sharia economic law

Adanya aplikasi streaming musik membuat mayoritas penikmat musik lebih memilih melakukan streaming musik daripada membeli album fisik. Salah satu aplikasi streaming musik populer ialah program aplikasi JOOX yang dapat diakses melalui smartphone. Program JOOX tidak hanya menyediakan layanan streaming musik saja tetapi juga tersedia saluran radio, podcast, live streaming acara musik dan fitur karaoke. Harga yang relatif mahal dijadikan peluang oleh pelaku bisnis yang mencoba mencari keuntungan berlipat dari penjualan akun JOOX VIP tersebut. pelaku menjual akun JOOX VIP dengan harga lebih murah.

Rumusan masalah dalam penelitian ini yaitu: 1) Bagaimana jual beli akun JOOX VIP prespektif Pasal 1365 dan 1320 Kitab Undang-Undang Hukum Perdata? 2) Bagaimana jual beli akun JOOX VIP prespektif Pasal 24 dan 26 Kompilasi Hukum Ekonomi Syariah?.

Penelitan ini merupakan penelitian normatif dengan menggunakan pendekatan perundang-undangan (statute approach) bahan hukum primer penelitian ini diambil dari KUH Perdata dan Kompilasi Hukum Ekonomi Syariah (KHES). Teknik pengumpulan bahan hukum dalam penelitian ini mengunakan studi kepustakaan antara lain dengan melakukan penentuan bahan hukum, inventarisasi bahan hukum yang relevan, dan pengkajian bahan hukum dalam Kitab Undang-Undang Hukum Perdata dan Kompilasi Hukum Ekonomi Syariah.

Hasil penelitian menunjukan bahwa penjualan akun JOOX VIP merugikan pihak JOOX sebagai pencipta program sehingga berdasarkan Kitab Undang-Undang Hukum Perdata Pasal 1365, penjual akun harus membayar ganti rugi kepada pihak JOOX sedangkan menurut Pasal 1320 status jual beli akun JOOX VIP bahwa batal demi hukum karena tidak memenuhi syarat objektif perjanjian yaitu causa halal. Selain itu berdasarkan Pasal 26 KHES, akad jual beli akun JOOX VIP tidak sah karena tidak bertentangan dengan hukum Islam dan Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta.

The existence of a music streaming application makes the majority of music lovers prefer to stream music rather than buying a physical album. One popular music streaming application is the JOOX application program that can be accessed via a smartphone. The JOOX program not only provides music streaming services but also available radio channels, podcasts, live streaming music shows and karaoke features. The relatively high price is made an opportunity by s people who try to gain multiple profits from the sale of the JOOX VIP account. they sell JOOX VIP accounts at lower prices.

The formulation of the problem in this research are: 1) How is buying and selling JOOX VIP account based on Article 1365 and 1320 of the Civil Code perspective? 2) How is buying and selling JOOX VIP accounts based on Article 24 and 26 of the Compilation of Sharia Economic Law perspective ?.

This research is a normative juridical research using a statue approach, the primary legal material of this study taken from the Civil Code and the Compilation of Sharia Economic Laws (KHES). The technique of collecting legal materials in this research uses a literature study by determining the legal material, inventarization of relevant legal materials, and studying of legal materials in the Civil Code and Compilation of Sharia Economic Laws.

The results showed that the sale of the JOOX VIP account harm to the JOOX party as the creator of the program so according to the Civil Code Article 1365, the seller of the account must pay compensation to the JOOX party while according to Article 1320 the sale and purchase status of the JOOX VIP account is null and void because it does not meet the objective conditions of the agreement, namely causa halal. Besides that, based on Article 26 of KHES, the akad of buying and selling agreement of the JOOX VIP account is invalid because its conflict with Islamic law and Law Number 28 of 2014 about Copyright.
