Abstract
INDONESIA:
Bank Garansi dalam bank syariah sendiri disebut dengan produk kafalah yaitu jaminan yang diberikan bank atas permintaan nasabah untuk memenuhi kewajibannya kepada pihak lain apabila nasabah yang bersangkutan tidak memenuhi kewajibannya. Bank garansi yang ada di bank konvensional tentunya mempunyai karakteristik yang berbeda dengan bank garansi syariah. Perjanjian dalam kafalah yang dilakukan oleh setiap bank syariah tergantung dari kesepakatan antara kedua belah pihak yang akan disepakati. Meskipun tujuan dari adanya bank garansi untuk meminimalisir terjadinya wanprestasi namun tidak dipungkiri problematika tentang bank garansi (kafalah) masih kerap muncul, salah satu sebabnya karena bank syariah tersebut kurang konsisten dalam menerapkan prinsip syariah, sehingga wanprestasi sering terjadi. Oleh karena itu, diperlukan penyelesaian perjanjian bank garansi akibat wanprestasi menurut KHES dan Fatwa DSN MUI.
Penelitian ini mendiskusikan tentang bagaimana penyelesaian perjanjian bank garansi syariah menurut Kompilasi Hukum Ekonomi Syariah dan Fatwa Dewan Syariah Nasional Majelis Ulama Indonesia dan bagaimana perbandingan penyelesaian perjanjian bank garansi syariah menurut Kompilasi Hukum Ekonomi Syariah dan Fatwa Dewan Syariah Nasional Majelis Ulama Indonesia
Penelitian ini tergolong pada penelitian hukum yuridis normatif dengan teknik pengumpulan data yang digunakan untuk memecahkan rumusan masalah yaitu dengan data kepustakaan yang diperoleh berdasarkan perundang-undangan dan literatur-literatur atau buku-buku.
Hasil penelitian ini menunjukkan bahwa Penyelesaian perjanjian bagi bank garansisyariah akibat wanprestasi berdasarkan analisis KHES dan Fatwa DSN MUI. Dalam KHES pasal 38 dan pasal 39, dijelaskan penyelesaian perjanjian bank garansi akibat wanprestasi adalah dengan dikeluarkannya sanksi berupa ganti rugi, denda, pembatalan akad. Sedangan dalam Fatwa DSN MUI Nomor 11/DSN-MUI/VI/2000 Tentang Kafalah bagian ketiga dijelaskan dapat dilakukan dengan musyawarah dan jika tidak terjadi kesepakatan makan dapat menyelesaikan di Badan Arbitrase Syariah. Sedangkan dalam Fatwa DSN MUI Nomor 74/DSN-MUI/VIII/2009 Tentang Penjaminan Syariah dijelaskan bahwa penyelesaiannya harus dilakukan berdasarkan peraturan perundang-undangan yang berlaku dan sesuai prinsip syariah serta ketentuan ganti rugi dan denda diatur dalam fatwa tentang ganti rugi.

Bank Guarantees in Islamic banks themselves are called kafalah products, namely guarantees provided by the bank at the customer's request to fulfill their obligations to other parties if the customer does not fulfill their obligations. Bank guarantees in conventional banks certainly have different characteristics from sharia bank guarantees. Agreements in kafalah carried out by every Islamic bank depend on the agreement between the two parties to be agreed upon. Although the purpose of the bank guarantee is to minimize the occurrence of defaults but is undeniable the problem of bank guarantees (kafalah) still often arises, one of the reasons is that Islamic banks are less consistent in applying sharia principles, so defaults often occur. Therefore, it is necessary to settle a bank guarantee agreement due to default according to the Compilation of Sharia Economic Law and the Fatwa of the National Sharia Council Indonesian Ulema Council.
This study discusses how to settle a sharia bank guarantee agreement according to the Compilation of Sharia Economic Law and the Fatwa of the National Sharia Council of the Indonesian Ulema Council and how the comparison of settlement of sharia bank guarantee agreements according to the Compilation of Sharia Economic Law and the Fatwa of the National Sharia Council Indonesian Ulema Council.
This research is classified as normative juridical legal research with data collection techniques used to solve the problem formulation, namely with library data obtained based on legislation and literature or books.
The results of this study indicate that the settlement of the agreement for bank Garansisyariah was due to default based on the KHES analysis and the MUI DSN Fatwa. In KHES article 38 and article 39, it is explained that the settlement of a bank guarantee agreement due to default is by issuing sanctions in the form of compensation, fines, cancellation of the contract. While in the MUI DSN Fatwa Number 11 / DSN-MUI / VI / 2000 concerning Kafalah the third part is explained can be done by deliberation and if there is no eating agreement can be completed in the Sharia Arbitration Board. Whereas in the MUI DSN Fatwa Number 74 / DSN-MUI / VIII / 2009 Concerning Sharia Guarantee, it was explained that the settlement must be carried out based on the applicable laws and regulations in accordance with sharia principles as well as compensation provisions and fines regulated in the fatwa concerning compensation.
