Abstract
INDONESIA:
Pada saat ini dengan perkembangan ilmu pengetahuan dan teknologi yang semakin canggih, ternyata juga menimbulkan kekhawatiran baru bagi kualitas produk jika ditinjau dari segi kehalalannya. Seperti halnya kehalalan dalam penyembelihan ayam sering dipertanyakan dan diragukan seiring dengan banyaknya tata cara penyembelihan sehingga muncul beragam model penyembelihan. Ada yang diproduksi dengan tradisional ada pula yang modern menggunakan alat mesin. Namun kebanyakan kurang mengerti standarisasi penyembelihan maupun pengolahannya dan juga tidak banyak para mengusaha sadar akan pentingnya mendaftarkan sertifikat halal.
Penulis melakukan penelitian terhadap masalah Kesadaran Hukum Pengusaha Rumah Potong Ayam di Kota Malang Terhadap Sertifikat Halal perspektif Fiqih Muamalah dan Undang-Undang No.33 Tahun 2014 Tentang Jaminan Produk Halal. Rumusan masalah dari penelitian ini adalah 1) Bagaimana tingkat pemahaman hukum pengusaha rumah potong ayam di Kota Malang terhadap kewajiban sertifikat halal perspektif fiqih muamalah? 2) Bagaimana tingkat pemahaman hukum pengusaha rumah potong ayam di Kota Malang terhadap kewajiban sertifikat halal Perspektif Undang-Undang No. 33 Tahun 2014 Tentang Jaminan Produk Halal?
Penelitian ini merupakan penelitian field research (penelitian lapangan) dan menggunakan pendekatan kualitatif. Sedangkan pengumpulan datanya observasi dan wawancara. Kemudian terdapat lima tahap dalam pengolahan data diantaranya tahap pemeriksaan data, klasifikasi, verifikasi, analisis data dan kesimpulan.
Hasil penelitian ini menunjukkan bahwasanya tingkat pemahaman hukum pengusaha rumah potong ayam di Kota Malang terhadap kewajiban sertifikat halal perspektif fiqih muamalah terbilang tinggi dikarenakan sudah memahami ketentuan penyembelihan secara syar’i. Sedangkan tingkat pemahaman hukum pengusaha rumah potong ayam di Kota Malang terhadap kewajiban sertifikat halal perspetif Undang-undang no 33 tahun 2014 tentang jaminan produk halal masih dapat dikatakan rendah. Hai ini dikarenakan kurangnya pemahaman mengenai isi dari regulasi sertifikat halal dan tata cara mendaftarkan sertifikat halal.

Nowadays, the development of science and technology is increasingly sophisticated; this causes the new worries for the quality of some products, if they are reviewed from the warranty of halal product, for the example, the law of chicken slaughter. The chicken slaughter process is often questioned because there are many ways to slaughter the chickens. The chicken slaughtering usually is carried out by traditional and modern way. The modern way is by using machine. Unfortunately, many entrepreneurs don not understand how to slaughter and process the chicken. Besides, they also are not aware to the importance of registering their business to get halal certificate.
The researcher carries out the research about the legal awareness of slaughterhouse entrepreneur in malang city toward the obligation of halal certificate based on fiqih muamalah perspective and law number 33 year 2014 about warranty of halal product. The research questions are: 1) how is the level of understanding of slaughterhouse entrepreneur in Malang city toward the obligation of halal certificate based on fiqih muamalah perspective? 2) How is the legal understanding of slaughterhouse entrepreneur in Malang city toward the obligation of halal certificate based law number 33 year 2014 about warranty of halal product?
This research is field research with the approach of qualitative. However, the data collection is carried out by observation and interview. Then, the data analysis is carried out by checking data, classifying data, verifying data, analyzing data, and drawing conclusion.
The results of this study indicate that the level of legal understanding of chicken slaughterhouse enterpreneurs in Malang towards the obligation of halal certificate of muamalah fiqh perspective is fairly high because it already understands the terms of slaughter in a shar’i manner. While the level og legal understanding of chicken slaughterhouse entrepreneurs in the city of Malang on the requirement of a persistent halal certificate Act No.33 of 2014 concerning the guarantee of halal products can still be said to be low. This is due to a lack of understanding of the content of halal certificate regulations and procedures for registering halal certificates.
