Pandangan hakim tentang kedudukan saksi Non-Muslim di Pengadilan Agama: Studi kasus di Pengadilan Agama Blitar

Saksi dalam Hukum Acara Perdata termasuk dalam hukum pembuktian. Pembuktian diperlukan oleh Hakim untuk mencari kebenaran fakta dan peristiwa yang dijadikan dalil gugat oleh penggugat dalam menentukan haknya. Pembuktian diperlukan apabila terdapat perselisihan terhadap suatu permasalahan di muka pengadilan di mana seorang mengaku bahwa suatu hal tersebut adalah haknya sedangkan pihak lain menyangkal terhadap pengakuan yang dikemukakan oleh seseorang.

Adapun fokus penelitian ini yaitu kedudukan saksi non-muslim menurut pandangan Hakim Pengadilan Agama Blitar dan perlakuan Hakim Pengadilan Agama Blitar di Ruang Persidangan terhadap saksi non-muslim. Tujuan diadakannya penelitian ini yaitu untuk mengetahui bagaimana pandangan Hakim Pengadilan Agama Blitar tentang kedudukan saksi non-muslim dan untuk mendeskripsikan perlakuan Hakim Pengadilan Agama Blitar di ruang persidangan.

Penelitian ini termasuk kedalam jenis penelitian yuridis empiris. Pendekatan yang digunakan dalam penelitian ini pendekatan kualitatif. Dalam metode pengumpulan data penulis menggunakan metode observasi, wawancara dan dokumentasi. Adapun pengolahahan data melalui tahap-tahap yaitu pemeriksaan data, pengelompokan data dan, verifikasi data.
Hasil penelitian ini menunjukkan bahwa pandangan Hakim Pengadilan Agama Blitar tentang kedudukan saksi non-muslim di sini adalah sama, yaitu tidak membedakan suku, ras dan agama. Semua saksi itu sama, adapun dalam memperlakukan saksi di ruang sidang, hakim tidak membedakan status saksi non-muslim. Agar terciptanya keadilan saksi di ruang sidang, hakim memberikan sumpah menurut agama dan keyakinan masing-masing saksi, karena dari setiap pengucapan sumpah itu berarti mereka bersumpah kepada Tuhan mereka masing-masing.

The witness in the Civil Procedure Code is included in the evidentiary law. Proof is needed by the Judge to find out the truth of the facts and events that were made as arguments by the plaintiff in determining his rights. Proof is needed if there is a dispute over a problem in front of the court where a person claims that something is his right while the other party denies the acknowledgment put forward by someone.

The focus of this study is the position of non-muslim witnesses in the view of the Blitar Religious Court Judges and the treatment of Judges of the Blitar Religious Court in the Courtroom against non-muslim witnesses. The purpose of this research is to find out how the views of the Blitar Religious Court Judges regarding the position of non-Muslim witnesses and to describe the treatment of Judges of the Blitar Religious Court in the courtroom.

This research belongs to the type of empirical juridical research. The approach used in this study is a qualitative approach. In the method of data collection the author uses the method of observation, interviews and documentation. The processing of data through the stages of checking data, grouping data and verifying data.

The results of this study indicate that the views of the Blitar Religious Court Judges about the position of non-Muslim witnesses here are the same, that does not distinguish ethnicity, race and religion. All witnesses are the same, as for treating witnesses in the courtroom, the judge did not distinguish the status of non-Muslim witnesses. In order to create witness justice in the courtroom, the judge gave an oath according to the beliefs and beliefs of each witness, because of each oath it meant they swore to their respective Gods.
