Praktik gadai di Desa Morosunggingan Kabupaten Jombang menurut kitab Undang-undang hukum perdata dan kompilasi hukum ekonomi syariah

Aktifitas gadai yang berlaku pada masyarakat umumnya ialah penjaminan atas suatu utang dari pihak debitur pada pihak kreditur dengan sebab pihak kreditur mengabulkan permohonan utang oleh debitur. Namun lain halnya di Desa Morosunggingan, adalah dengan tidak memindah tangankan objek gadai dari debitur pada kreditur yang mana hal tersebut berbeda dengan definisi gadai secara teori, baik menurut KUHPerdata maupun menurut KHES.

Mengacu pada penjelasan diatas, terdapat permasalahan yang membutuhkan penjelasan lebih inti. Pertama bagaimana pandangan KUHPerdata terhadap kegiatan tersebut ? Kedua, bagaimana pandangan KHES terhadap kegiatan tersebut ?

Penelitian ini menggunakan jenis penelitian yuridis empiris dengan menggunakan metode pendekatan yuridis sosiologis. Dalam hal ini, penulis ingin mengkaji ketentuan hukum yang berlaku serta apa yang terjadi dalam kenyataanya pada masyarakat. Metode pendekatan tersebut menekankan penelitian yang bertujuan memperoleh pengetahuan hukum secara empiris dengan jalan terjun langsung pada objeknya. Setelah itu, barulah penulis mengkomparasikan keduanya.

Penelitian ini berkesimpulan bahwa Pertama, menurut Pasal 1150 KUHPerdata menjelaskan bahwa aktifitas gadai yang terjadi pada lokasi penelitian adalah tidak dibenarkan. Kedua, telah jelas disebutkan bahwa akad gadai dalam KHES mengatakan marhun berada pada tangan murtahin ketika akad sedang berlangsung, yang terjadi pada lokasi adalah bertolak belakang dengan perngertian gadai prespektif KHES.

Fiduciary activities which apply to the general public is the guarantee of a debt from the debtor to the creditors because the creditor side granted the debt application by the debtor. But it is different with what happened in Morosunggingan Village, Jombang Regency is by not transferring the fiduciary object from the debtor to the creditor which is different from the theoretical definition of fiduciary, either according to KUHPerdata or fiduciary according to KHES.

Referring to the above explanation, there are problems which require more core explanation. First, how does the Civil Code view these fiduciary activities? And Second, what is KHES’s view on such fiduciary activities?

This research uses a kind of juridical empirical research using sociological juridical approach method. In this case, the author wants to review the applicable legal provisions as well as what happens in reality to the public. The method of this approach emphasizes research that aims to gain knowledge of the law empirically by jumping directly on the object. After that, the author compiles the fiduciary perspective of the Civil Code with the fiduciary perspective of Islamic Law on the location of research.

This study concludes that First, according to Article 1150 of the Civil Code explains that the activities of fiduciary that occurred in Morosunggingan Village, Peterongan Sub-district, Jombang Regency is not justified because the fiduciary in the perspective of the Civil Code emphasizes the object of the fiduciary is on the hands of creditors when the fiduciary agreement is in progressing. Secondly, it has been clearly stated that the fiduciary agreement in KHES says that marhun is in the hands of murtahin when the contract is underway, but what happens to Morosunggingan Village is contrary to the perspective of KHES perspective in other words that occur in illegitimate locations.
