Upaya orang tua pekerja dalam mencegah risiko kekerasan seksual pada anak di Game Roblox perspektif Hukum Positif dan Sadd Al Dhariah: Studi di RT 06 RW 05 Kelurahan Pisangcandi, Kota Malang

Kekerasan seksual terhadap anak di ruang digital kini merambah ke berbagai platform permainan daring seperti Roblox. Orang tua pekerja memegang tanggung jawab utama dalam melakukan tindakan preventif, meskipun dihadapkan pada tantangan keterbatasan waktu akibat aktivitas pekerjaan di luar rumah. Penelitian ini bertujuan untuk mengkaji secara mendalam bentuk upaya orang tua pekerja dalam mencegah kekerasan seksual anak pada game Roblox, serta efektivitas tindakan tersebut ditinjau dari konsep hukum Islam Sadd al-Dhariah dan perspektif hukum positif.

Penelitian ini merupakan penelitian yuridis empiris dengan pendekatan sosiologi hukum yang mengkaji hukum sebagai gejala sosial (law in action). Fokus kajian diarahkan pada bagaimana upaya pencegahan kekerasan seksual terhadap anak pada game Roblox dipahami dan dijalankan oleh orang tua pekerja di RT 06 RW 05 Kelurahan Pisangcandi, Kota Malang. Data primer diperoleh melalui wawancara mendalam dengan informan yang dipilih secara purposive sampling, sedangkan data sekunder mencakup peraturan perundang-undangan, kaidah sadd al-dhariah, buku, serta jurnal ilmiah relevan yang kemudian dianalisis secara kualitatif-sistematis.

Hasil penelitian menunjukkan bahwa upaya pencegahan oleh orang tua pekerja masih terbatas pada langkah teknis, seperti membatasi waktu gawai, menggunakan parental control, atau memblokir dan menghapus aplikasi Roblox. Dari perspektif hukum positif, ditemukan fakta bahwa tidak ada upaya hukum formal yang ditempuh untuk mempidanakan pelaku berdasarkan UU Perlindungan Anak, UU TPKS, maupun UU Pornografi. Hal ini dipicu oleh ketidakpahaman orang tua serta rendahnya sensitivitas hukum (legal sensitivity), sehingga menganggap pemutusan akses digital korban sudah cukup sebagai solusi. Ditinjau dari hukum Islam, tindakan menutup akses ini telah memenuhi esensi dasar Sadd al-Dhariah dalam mencegah kemudaratan (mafsadah), namun penerapannya masih bersifat pasif defensif, sehingga penting untuk meningkatkan sosialisasi dan literasi hukum masyarakat secara masif.

Child sexual abuse in the digital sphere has now expanded into various online gaming platforms, such as Roblox. Working parents hold the primary responsibility for taking preventive measures, despite facing the challenges of time constraints due to work activities outside the home. This study aims to deeply examine the preventive efforts made by working parents to prevent child sexual abuse on the Roblox game, as well as the effectiveness of these actions viewed from the perspective of Islamic law through the concept of Sadd al-Dhariah and positive law, which includes the Child Protection Law, the Sexual Violence Crime Law (UU TPKS), and the Pornography Law.

This study is an empirical legal research using a socio-legal approach that examines law as a social phenomenon (law in action). The focus of the study is directed at how efforts to prevent child sexual abuse on the Roblox game are understood and implemented by working parents in RT 06 RW 05 Pisangcandi Village, Malang City. Primary data were obtained through in-depth interviews with informants selected via purposive sampling, while secondary data included statutory regulations, the tenets of sadd al-dhariah, books, and relevant scientific journals, which were then analyzed qualitatively and systematically.

The results show that the preventive efforts made by working parents are still limited to technical-domestic steps, such as restricting screen time, using parental controls, or blocking and deleting the Roblox application. From the perspective of positive law, it was found that no formal legal measures were taken by parents to prosecute the perpetrators under the Child Protection Law, the UU TPKS, or the Pornography Law. This is triggered by the parents' lack of understanding regarding the substance of the three laws and their low legal sensitivity, leading them to consider cutting off the victim's digital access as an adequate solution. Viewed from Islamic law, the act of closing access has fulfilled the basic essence of Sadd al-Dhariah in preventing harm (mafsadah), yet its implementation remains passive-defensive, highlighting the importance of massively increasing public legal dissemination and literacy.

إنَّ تطوّرَ التكنولوجيا الرقمية عبر منصّات الألعاب الإلكترونية مثل Roblox قد أثّر بشكلٍ ملحوظ على أنماط تفاعل الأطفال، ولا سيّما في الأُسر التي يعمل فيها الوالدان ويعانيان من محدودية الوقت في الإشراف، الأمر الذي قد يفتح المجال أمام وصول الأطفال إلى محتويات غير لائقة، قد تصل إلى المواد الإباحية والعنف الجنسي القائم على البيئة الرقمية. وتهدف هذه الدراسة إلى تحليل دور الوالدين العاملين في مراقبة استخدام الأطفال للعبة Roblox، فضلًا عن دراسة جهود الوقاية من منظور القانون الوضعي ومبدأ سدّ الذرائع. وقد اعتمدت الدراسة على المنهج الكيفي باستخدام تقنيات جمع البيانات، وهي الملاحظة والمقابلة والتوثيق، وذلك على أُسر يعمل فيها كلا الوالدين في منطقة RT 06 RW 05 بيسانغكاندي بمدينة مالانغ.

وأظهرت نتائج الدراسة أن محدودية وقت الوالدين تؤدي إلى ضعف الإشراف على أنشطة الأطفال في Roblox، مما يزيد من احتمالية تعرّضهم للتفاعلات السلبية. ومن منظور القانون الوضعي، يرتبط هذا الوضع بواجب الوالدين في حماية الأطفال كما نصّ عليه القانون رقم 23 لسنة 2002 بشأن حماية الطفل، والمعدّل بالقانون رقم 35 لسنة 2014، والمدعوم كذلك بالقانون رقم 44 لسنة 2008 بشأن المواد الإباحية، والقانون رقم 12 لسنة 2022 بشأن جريمة العنف الجنسي. أمّا من منظور سدّ الذرائع، فإن تقييد الوصول إلى Roblox ومراقبته يُعدّ إجراءً وقائيًا يهدف إلى سدّ الطرق المؤدية إلى الفساد (المفسدة.

وخلاصة القول، فإن إشراف الوالدين العاملين على استخدام الأطفال للعبة Roblox يُعدّ مسؤولية قانونية وأخلاقية جوهرية لحماية الأطفال من الآثار السلبية للعالم الرقمي، مما يستلزم تحقيق التوازن بين متطلبات العمل وأساليب التربية الفعّالة
