Pelaksanaan corporate social responsibility (CSR) dalam pengelolaan lingkungan hidup di PTPN XII Kebun Mumbul Mumbulsari, Jember perspektif maqashid syariah

Kegiatan usaha industri mempunyai dampak positif dan negatif. Salah satu dampak negatifnya yaitu dapat mencemari lingkungan hidup. PTPN XII Kebun- Mumbul sebagai Perseroan Terbatas yang dalam kegiatan usahanya menghasilkan limbah, wajib melaksanakan tanggung jawab sosial dan lingkungan. Selain hukum positif, hukum Islam juga mewajibkan untuk tidak merusak bumi dengan mencemari lingkungan. Sehingga integrasi bagaimana sebenarnya syariat Islam mengatur ranah bisnis sangat diharapkan agar para pelaku bisnis bisa lebih berinstrospeksi diri, sebagaimana yang kita pahami bahwa dalam syariat terdapat konsep maqashid syariah. Dengan konsep tersebut, maka para pelaku bisnis diharapkan juga memperhatikan kemaslahatan masyarakat dan lingkungan.

Mengacu pada latar belakang di atas, ada beberapa masalah yang memerlukan pembahasan yang intensif. Pertama, bagaimana pelaksanaan Corporate Social Responsibility (CSR) dalam pengelolaan lingkungan hidup di PTPN XII Kebun Mumbul-Mumbulsari, Jember? Dan Kedua, bagaimana efektifitas pelaksanaan Corporate Social Responsibility (CSR) dalam pengelolaan lingkungan hidup di PTPN XII Kebun Mumbul-Mumbulsari, Jember perspektif maqasid syariah ?

Penelitian ini merupakan penelitian yuridis empiris, yaitu melihat aspek- aspek hukum dalam interaksi sosial di dalam masyarakat. Penulis menggunakan pendekatan kualitatif dengan di dukung oleh data-data hasil wawancara serta dokumentasi.

Sehingga dalam penelitian ini dapat disimpulkan Efektifitas pelaksanaan Corporate Social Responsibility (CSR) dalam pengelolaan lingkungan hidup di PTPN XII Kebun Dampar-Mumbulsari, Jember belum terlaksana dengan baik. Kegiatan-kegiatan yang dilaksanakan di PTPN XII Kebun-Mumbul ada yang terprogram dan ada yang tidak terprogram dengan baik sesuai dengan pedoman CSR dari Kementerian Lingkungan Hidup. Sehingga akan mengurangi konsistensi dalam pelaksanaan CSR. Sedangkan menurut perspektif maqashid syariah yaitu hifd din dengan cara memberi fasilitas masjid untuk warga sekitar, hifd nafs dan hifd mal dengan memberi lapangan pekerjaan kepada masyarakat, hifd akl dengan memberi fasilitas pendidikan TK, hifd nasl dengan menciptakan lingkungan yang sehat, dan hifd irdh dengan menjalin hubungan baik yaitu silaturrahmi.

Industrial business activities have positive and negative impacts. One of the negative impacts that can pollute the environment. PTPN XII Gardens Mumbul as a Limited Company in its business activities generate waste, must carry out social and environmental responsibility. In addition to the positive law, Islamic law also requires to not destroy the earth with polluting the environment. So how the actual integration of Islamic law regulate the business sphere is expected that business people can be more introspection, as we know that in Islamic law there is the concept of maqashid sharia. With this concept, the business people are expected to also pay attention to the benefit of society and the environment.

Referring to the above background, there are some problems that require intensive discussion. First, how the implementation of Corporate Social Responsibility (CSR) in environmental management in PTPN XII-Mumbulsari Mumbul Gardens, Jember? And two, how the effectiveness of the implementation of Corporate Social Responsibility (CSR) in environmental management in PTPN XII-Mumbulsari Mumbul Gardens, Jember maqasid sharia perspective?

This research is empirical juridical, which saw the legal aspects of social interaction in the community. The author uses a qualitative approach is supported by the data of the interviews and documentation.

Thus, in this study it can be concluded that effectiveness of the implementation of Corporate Social Responsibility (CSR) in environmental management in PTPN XII-Mumbulsari Dampar Gardens, Jember has not done well. The activities carried out in PTPN XII Gardens Mumbul no programmed and there is not programmed properly in accordance with the guidelines of the Ministry of Environment CSR. So will reduce the consistency in the implementation of CSR. Meanwhile, according to maqashid sharia perspective are hifd din by giving a mosque facilities for local residents, hifd nafs and hifd mall to give jobs to the community, hifd akl to provide preschool education facilities, hifd nasl to create a healthy environment, and hifd irdh with braid good relationship is silaturrahmi.
