Efektivitas pasal 5 peraturan daerah kota Malang nomor 2 tahun 2012 perspektif maslahah mursalah (studi supeltas kecamatan Sukun)

ABSTRAK:

Keberadaan sukarelawan pengatur lalu lintas (SUPELTAS) memiliki peran yang penting terhadap sebuah ketertiban umum dan kelancaran lalu - lintas, sehingga dalam bertugas perlu memperhatikan sebuah regulasi yang mengikatnya yaitu Peraturan Daerah Kota Malang Nomor 2 Tahun 2012 tentang Ketertiban Umum dan Lingkungan. Tujuan dilakukan penelitian ini adalah untuk mengetahui efektivitas Pasal 5 Peraturan Daerah Kota Malang Nomor 2 Tahun 2012 terhadap eksistensi sukarelawan pengatur lalu-lintas (SUPELTAS) dan ditinjau berdasarkan maslahah mursalah.
Rumusan masalah yang diangkat adalah 1.) Bagaimana Efektivitas Pasal 5 Peraturan Daerah Kota Malang Nomor 2 Tahun 2012 terhadap eksistensi sukarelawan pengatur lalu-lintas (SUPELTAS)?; dan 2.) Apa pandangan maslahah mursalah terhadap Pasal 5 Peraturan Daerah Kota Malang Nomor 2 Tahun 2012 ?
Jenis penelitian yang digunakan dalam penelitian ini adalah penelitian yuridis empiris. Sedangkan pendekatan yang digunakan adalah pendekatan yuridis sosiologis. Lokasi penelitian dalam penelitian ini adalah Kecamatan Sukun Kota Malang. Data yang digunakan adalah data primer yang diperoleh melalui wawancara, dokumentasi dan observasi, serta data sekunder yang berupa buku ilmiah, hasil laporan penelitian, skripsi, dan jurnal.
Hasil penelitian ini menunjukkan bahwa efektivitas Pasal 5 Peraturan Daerah Kota Malang Nomor 2 Tahun 2012 terhadap eksistensi sukarelawan pengatur lalu-lintas (SUPELTAS) adalah dinilai sudah efektif. Ditinjau dari teori efektivitas hukum yang dikemukakan oleh Lawrence M Friedman keberadaan SUPELTAS secara substansi hukumnya yaitu Pasal 5 Peraturan Daerah Kota Malang Nomor 2 Tahun 2012 tentang Ketertiban Umum dan Lingkungan sudah baik, struktur hukumnya yaitu pihak kepolisian selaku penegak hukumnya juga baik, dan budaya masyarakat yang ada didalamnya juga sangat baik.

ABSTRACT:

The existence of traffic control volunteers (SUPELTAS) has an important role in a public order and traffic smoothness, so that they should pay attention to a binding regulation along they work. The regulation is Malang City Regional Regulation Number 2 of 2012 concerning Public Order and Environment. The purpose of this research is to determine the effectiveness of Article 5 of Malang City Regional Regulation Number 2 of 2012 on the existence of traffic control volunteers (SUPELTAS) which is viewed from maslahah mursalah.
The research problems are 1.) How is the effectiveness of Article 5 of Malang City Regional Regulation Number 2 of 2012 on the existence of traffic control volunteers (SUPELTAS)?; and 2.) What is the view of maslahah mursalah on Article 5 of Malang City Regional Regulation Number 2 of 2012?
The type of research used is empirical juridical research. Meanwhile, the approach used is a sociological juridical approach. The research location in this research is Sukun District, Malang City. The data used are primary data obtained through interviews, documentation and observation. However, the secondary data is in the form of scientific books, research reports, theses, and journals.
The results of this research indicate that the effectiveness of Article 5 of Malang City Regional Regulation Number 2 of 2012 on the existence of traffic control volunteers (SUPELTAS) is considered effective. Judging from the theory of legal effectiveness put forward by Lawrence M. Friedman, the existence of SUPELTAS in its legal substance is Article 5 of Malang City Regional Regulation Number 2 of 2012 concerning Public Order and the Environment is good. The legal structure is polices which are as law enforcers. They are also good. Then, the culture of the community there is also very good.

إن وجود متطوعي مراقبة حركة المرور (SUPELTAS) له دور مهم فى النظام العام وسلاسة حركة المرور، لذلك من الضروري الانتباه إلى القانون الملزم أثناء العمل، وهي قانون مدينة مالانج رقم 2 سنة 2012 عن النظام العام والبيئة.وغرض هذا البحث هو معرفة فعالية فصل 5 من قانون مدينة مالانج رقم 2 سنة 2012 عن وجود متطوعي مراقبة حركة المرور ومراجعتها بنظرية مصلحة مرسلة.
وصيغ مشاكل هذا البحث هي 1.) كيف فعالية فصل 5 من قانون مدينة مالانج رقم 2 سنة 2012 عن وجود متطوعي مراقبة حركة المرور؟. 2.) كيف نظرية مصلحة مرسلة عن فصل 5 من قانون مدينة مالانج رقم 2 سنة 2012؟.
والنوع المستخدم لهذا البحث هو بحث قانوني تجريبي. و نهج البحث المستخدم هو نهج اجتماعي قانوني. وموقع البحث هو منطقة سوكون، مدينة مالانج. البيانات المستخدمة هي البيانات الأولية المحصول من المقابلات والتوثيق والملاحظة، والبيانات الثانوية المحصول من كتب علمية وتقارير بحثية وبحوث ومجلات.
ونتائج هذا البحث هي أن فصل 5 من قانون مدينة مالانج رقم 2 سنة 2012 عن وجود متطوعي مراقبة حركة المرور تعتبر فعالة. انطلاقًا من نظرية فعالية القانون التي طرحها Lawrence M Friedman، فإن وجود متطوعي مراقبة حركة المرور في جوهر قانونه وهو فصل 5 من قانون مدينة مالانج رقم 2 سنة 2012 بما يتعلق بالنظام العام والبيئة قد كان جيدا، وكان هيكل قانونه وهو الشرطة كمنفذ القانون جيدا أيضًا، كما كانت ثقافة المجتمع فيها.
