Reformulasi resolusi konflik nusyūz dalam relasi suami-istri berbasis maqāṣid al-usrah Jamaluddin ‘Aṭiyyah: Integrasi fikih Syafi‘i dan hukum positif Indonesia

Nusyuz masih sering dipahami sebagai ketidakpatuhan istri dan diselesaikan melalui tindakan korektif sepihak yang berpotensi disalahgunakan sebagai pembenaran kekerasan dalam rumah tangga. Penelitian ini bertujuan menganalisis konstruksi nusyuz dalam fikih Syafi‘i, perlindungan terhadap KDRT dalam hukum positif Indonesia, serta mereformuasi resolusi konflik nusyuz berbasis Maqasid al-Usrah Jamaluddin ‘Athiyah. Penelitian ini merupakan penelitian kepustakaan (library research) dengan corak kualitatif dalam kerangka Studi Islam, menggunakan pendekatan filosofis-doktriner dan inter atau multidisipliner. Data diperoleh melalui teknik pengumpulan data kepustakaan, kemudian dianalisis secara kualitatif menggunakan analisis isi (content analysis), analisis tematik (thematic analysis), dan analisis kritis (critical analysis), yang selanjutnya disintesiskan untuk menghasilkan reformulasi resolusi konflik nusyuz. Hasil penelitian menunjukkan bahwa: 1) fikih Syafi‘i memandang nusyuz sebagai pengabaian kewajiban perkawinan yang dapat dilakukan oleh istri maupun suami. Nusyuz istri diselesaikan melalui nasihat, hajr, dan ta’dīb atau darb dengan batas ketat, sedangkan nusyuz suami diarahkan pada komunikasi, sulh, pemulihan hak, dan pelibatan otoritas; 2) hukum positif Indonesia berfungsi sebagai batas protektif yang melarang penyelesaian konflik yang menimbulkan penderitaan fisik, psikis, seksual, atau penelantaran; 3) reformulasi yang dihasilkan menempatkan fikih Syafi‘i sebagai landasan normatif, Maqasid al-Usrah sebagai instrumen evaluasi, dan hukum positif sebagai batas perlindungan. Modelnya diawali verifikasi timbal balik dan pemeriksaan indikator KDRT, kemudian diarahkan pada jalur restoratif apabila keadaan aman atau jalur protektif apabila terdapat kekerasan.

Nusyuz is frequently understood as a wife’s disobedience and addressed through unilateral corrective measures that may be misused to justify domestic violence. This study examines the construction of nusyuz in Shafi‘i jurisprudence, legal protection against domestic violence under Indonesian positive law, and the reformulation of nusyuz conflict resolution based on Jamaluddin ‘Athiyah’s Maqasid al-Usrah. This study employs qualitative library research within the framework of Islamic Studies, using philosophical-doctrinal and inter- or multidisciplinary approaches. The data were collected through systematic library-based data collection and qualitatively analysed through content analysis, thematic analysis, and critical analysis, followed by synthesis to develop a reformulated model of nusyuz conflict resolution. The findings show that: 1) Shafi‘i jurisprudence constructs nusyuz as the neglect of marital obligations by either spouse. A wife’s nusyuz is addressed through advice, hajr, and ta’dib or darb under strict limitations, while a husband’s nusyuz is resolved through communication, sulh, restoration of rights, and the involvement of legal authorities; 2) Indonesian positive law functions as a protective boundary prohibiting conflict-resolution measures that cause physical, psychological, or sexual suffering or household neglect; 3) the proposed reformulation positions Shafi‘i jurisprudence as the normative foundation, Maqasid al-Usrah as the evaluative instrument, and positive law as the protective boundary. The model begins with reciprocal verification and domestic-violence screening, followed by a restorative pathway when circumstances are safe or a protective pathway when violence is identified.

لا يزال النشوز يُفهم غالبا باعتباره عصيان الزوجة، ويُعالَج بإجراءات تقويمية أحادية قد تُستعمل لتبرير العنف الأسري. ويهدف هذا البحث إلى تحليل مفهوم النشوز وآليات معالجته في الفقه الشافعي، والحماية من العنف الأسري في القانون الوضعي الإندونيسي، و إعادة صياغة تسوية نزاع النشوز في ضوء مقاصد الأسرة عند جمال الدين عطية. يعتمد هذا البحث على الدراسة المكتبية ذات الطابع النوعي في إطار الدراسات الإسلامية، مستخدمًا المنهج الفلسفي-المذهبي والمنهج البيني أو متعدد التخصصات. وجُمعت البيانات من خلال جمع المصادر المكتبية بصورة منهجية، ثم حُلِّلت تحليلاً نوعيًّا باستخدام تحليل المحتوى، والتحليل الموضوعاتي، والتحليل النقدي، وأُتبعت عملية التحليل بتركيب النتائج من أجل صياغة نموذج مُعاد لتسوية نزاع النشوز. وتوصل البحث إلى أن: 1) الفقه الشافعي يعد النشوز إخلالا بالواجبات الزوجية يمكن أن يصدر من الزوجة أو الزوج. ويُعالَج نشوز الزوجة بالوعظ والهجر والتأديب أو الضرب ضمن قيود شديدة، بينما يُعالَج نشوز الزوج بالحوار والصلح واسترداد الحقوق وإشراك الجهة المختصة؛ 2) يؤدي القانون الوضعي الإندونيسي وظيفة الحد الحمائي الذي يمنع كل معالجة تسبب الأذى الجسدي أو النفسي أو الجنسي أو الإهمال الأسري؛ 3) تضع إعادة البناء صياغة الفقه الشافعي أساسا معياريا، ومقاصد الأسرة أداة للتقييم، والقانون الوضعي حدا للحماية. ويبدأ النموذج بالتحقق المتبادل وفحص مؤشرات العنف الأسري، ثم يتجه إلى المسار الإصلاحي عند توافر الأمان، أو المسار الحمائي عند وجود العنف.
