Implikasi Isbat Nikah dan dispensasi kawin sebagai akibat Tradisi Kabin Mashok di kelurahan Bugih dalam perspektif Hakim Pengadilan Agama Pamekasan

ABSTRAK

Indonesia merupakan daerah kepulauan yang memiliki beberapa tradisi yang biasa dilakukan salah satunya yaitu perkawinan yang merupakan tradisi lokal di pulau Madura terletak di Kabupaten Pamekasan, tradisi lokal itu berupa tradisi perkawinan yang di kenal dengan tradisi kabin mashok yang memiliki tujuan untuk mempercepat proses perkawinan yang ada di kelurahan Bugih Pamekasan.
Sementara tujuan penelitian ini a) Untuk mendiskripsikan pelaksanaan tradisi kabin mashok di Kelurahan Bugih Kabupaten Pamekasan.b) Untuk menganalisis implikasi isbat nikah dan dispensasi kawin sebagai akibat tradisi kabin mashok di Kelurahan Bugih dalam perspektif hakim Pengadilan Agama Pamekasan.

Jenis penelitian yang digunakan adalah studi empiris, dengan menggunakan
pendekatan diskriptif kualitatif . Sedangkan sumber data yang digunakan adalah data primer, sekunder dan tersier. Pengumpulan data melalui wawancara, observasi dan dokumentasi, sedangkan metode pengolahan data melalui editing, classifying, data analysis, dan conclusion.

Hasil dari penelitian ini, pertama tentang pelaksanaan tradisi kabin mashok, merupakan pernikahan yang dilaksanakan tanpa proses tunangan terlebih dahulu, sehingga proses pernikahan ini setelah proses ta’aruf, saling mengenal kedua belah pihak, kemudian menetapkan tanggal pernikahan, setelah disetujui oleh kedua belah pihak baru kemudian proses akad nikah dengan memberikan seserahan sirih pinang atau le-taleh ke pihak perempuan. Sementara hasil penelitian ini yang kedua, adalah ada 2 komponen yaitu, bahwa tradisi kabin mashok menurut perspektif hakim PA memiliki dua pandangan, a) Pelaksanaan tradisi kabin mashokmemenuhi syarat dan rukun perkawinan, prosesnya tanpa melalui pertunangan dan dilaksanakan secara sirri (disembunyikan) dan, negara tidak dilibatkan (KUA) b) Pelaksanaan dari tradisi kabin mashok, memenuhi syarat dan rukunnya perkawinan dan negara dilibatkan (KUA) dengan memiliki akte nikah. Kesimpulannya, pelaksanaan dari tradisi kabin mashok, proses pelaksanaannya mulai dari taaruf sampai akad nikah sama, yang membedakan dari proses ini dari hasil temuan yang pertama, tanpa melibatkan negara (KUA), sedangkan yang kedua, KUA dilibatkan dengan bukti akte nikah.

ABSTRACT

Indonesia is an archipelago with several traditions commonly practiced, one of which is marriage, a local tradition on Madura Island, located in Pamekasan Regency. This local tradition is known as the Kabin Mashok tradition, which aims to expedite the marriage process in the Bugih Village, Pamekasan Regency. The objectives of this study are: a) To describe the implementation of the Kabin Mashoktradition in Bugih Village, Pamekasan Regency. b) To analyze the implications of the Kabin Mashok tradition and marriage dispensation as a result of the Kabin Mashok tradition in Bugih Village, Pamekasan Regency, from the perspective of Pamekasan Religious Court judges.

This research is an empirical study, employing a qualitative descriptive approach. The data sources used are primary, secondary, and tertiary data. Data collection was conducted through interviews, observation, and documentation. Data processing methods included editing, classification, data analysis, and conclusion drawing.

The results of this study, firstly about the implementation of the mashok kabin
tradition, is a marriage that is carried out without a prior engagement process, so that the marriage process is after the ta'aruf process, getting to know each other between the two parties, then setting the wedding date, after being agreed by both parties, then the marriage contract process is carried out by giving betel nut or letaleh to the woman. While the second result of this study, there are 2 components, namely, that the mashok kabin tradition according to the perspective of the PA judge has two views, a) The implementation of the mashok kabin tradition meets the requirements and pillars of marriage, the process is without going through an engagement and is carried out in a sirri (hidden) and, the state is not involved (KUA) b) The implementation of the mashok kabin tradition, meets the requirements and pillars of marriage and the state is involved (KUA) by having a marriage certificate. In conclusion, the implementation of the mashok kabin tradition, the implementation process from ta'aruf to the marriage contract is the same, what distinguishes this process from the first finding, without involving the state (KUA), while the second, KUA is involved with proof of a marriage certificate.

أما نتائج هذه الدراسة، فتتعلق أوالًبتطبيق تقليد "الماشوك كابين"، وهو زواج يتم دون خطوبةمسبقة، حيث تتم إجراءات الزواج بعد التعارف بين الطرفين، ثم تحديد موعد الزفاف، وبعد
موافقة الطرفين، يتم إبرام عقد الزواج بتقديم جوزة التنبول أو "التله" للمرأة. أما النتيجة الثانية للدراسة، فتتألف من عنصرين: أولهما، أن تقليد "الماشوك كابين" من وجهة نظر قاضي
، المحكمة الشرعية له وجهان: أ( تطبيق تقليد "الماشوك كابين" يستوفي شروط وأركان الزواج (. ب( تطبيق تقليد "الماشوك KUA ويتم دون خطوبة وفي سر )سري(، ودون تدخل الدولة )( من خالل الحصول على KUA كابين" يستوفي شروط وأركان الزواج، وتتدخل الدولة ) شهادة زواج. في الختام، فإن تطبيق تقليد خيمة الماشوك، وعملية التنفيذ من التعارف إلى عقد (، KUA وما يميز هذه العملية عن العملية األولى هو عدم تدخل الدولة ) الزواج هي نفسها،مع إثبات شهادة الزواج.
