Pengawasan peredaran produk makanan tanpa label informasi nilai gizi perspektif hukum positif dan Maqashid Syariah: Studi di Balai Besar Pengawas Obat dan Makanan Surabaya

Peredaran produk pangan olahan tanpa label Informasi Nilai Gizi (ING) masih ditemukan secara nyata di minimarket Kota Malang, sebagaimana dibuktikan oleh temuan lima produk bermasalah pada observasi Oktober 2025. Kondisi ini mengindikasikan lemahnya kepatuhan pelaku usaha dan belum optimalnya pengawasan pangan, yang secara langsung mengancam hak konsumen atas informasi yang benar, jelas, dan jujur sebagaimana dijamin oleh Pasal 4 huruf c Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Penelitian ini bertujuan untuk menganalisis mekanisme pengawasan Balai Besar Pengawasan Obat dan Makanan (BBPOM) Surabaya terhadap peredaran produk pangan tanpa label ING di minimarket Kota Malang dalam perspektif hukum positif, serta mengkaji pengawasan tersebut dalam perspektif maqashid syariah.
Penelitian ini menggunakan metode yuridis empiris dengan pendekatan sosiologis. Data primer diperoleh melalui wawancara dengan petugas BBPOM Surabaya dan observasi lapangan, sedangkan data sekunder bersumber dari peraturan perundang-undangan, literatur ilmiah, dan dokumen resmi BBPOM. Data yang terkumpul dianalisis secara deskriptif-analitis untuk mengungkap gap antara norma hukum yang berlaku dan realitas implementasi pengawasan di lapangan.
Hasil penelitian menunjukkan bahwa dalam perspektif hukum positif, BBPOM Surabaya telah memiliki landasan normatif yang komprehensif berdasarkan UU No. 18 Tahun 2012 tentang Pangan, UU No. 8 Tahun 1999 tentang Perlindungan Konsumen, dan Peraturan BPOM No. 26 Tahun 2021, serta telah menjalankan mekanisme pengawasan pre-market dan post-market secara prosedural. Namun demikian, pengawasan tersebut masih terhambat oleh defisit sumber daya manusia, belum optimalnya koordinasi lintas instansi, dan masih beredarnya produk tanpa izin edar di pasaran. Adapun dalam perspektif maqashid syariah, kewajiban pelabelan ING merupakan perwujudan maslahah darurriyah yang secara langsung melindungi jiwa (hifz al-nafs) dan akal (hifz al-'aql) konsumen, sementara peredaran produk tanpa ING mengandung mafsadah berupa unsur gharar yang dilarang dalam hukum Islam berdasarkan kaidah al-dhararu yuzal. Penelitian ini menyimpulkan bahwa sinergi antara penguatan kapasitas pengawasan, koordinasi lintas instansi, pembinaan aktif pelaku usaha UMK, dan konsistensi penegakan sanksi merupakan prasyarat terwujudnya sistem pengawasan pangan yang berkeadilan dan selaras dengan nilai-nilai maqashid syariah.

The circulation of processed food products without the Nutritional Value Information (ING) label is still found in Malang City minimarkets, as evidenced by the findings of five problematic products in October 2025 observations. This condition indicates weak compliance of business actors and non-optimal food supervision, which directly threatens consumers' rights to true, clear, and honest information as guaranteed by Article 4 letter c of Law Number 8 of 1999 concerning Consumer Protection. This study aims to analyze the supervision mechanism of the Surabaya Food and Drug Control Center (BBPOM) over the circulation of food products without ING labels in Malang City minimarkets in a positive legal perspective, as well as to examine the supervision from the perspective of sharia maqashid.
This study uses an empirical juridical method with a sociological approach. Primary data was obtained through interviews with BBPOM Surabaya officers and field observations, while secondary data was sourced from laws and regulations, scientific literature, and official BBPOM documents. The collected data was analyzed descriptive-analytically to reveal the gap between the applicable legal norms and the reality of the implementation of supervision in the field.
The results of the study show that from a positive legal perspective, BBPOM Surabaya already has a comprehensive normative foundation based on Law No. 18 of 2012 concerning Food, Law No. 8 of 1999 concerning Consumer Protection, and BPOM Regulation No. 26 of 2021, and has implemented pre-market and post-market supervision mechanisms procedurally. However, this supervision is still hampered by a deficit of human resources, suboptimal coordination across agencies, and the circulation of products without distribution permits in the market. As for the perspective of sharia maqashid, the obligation to label ING is a manifestation of maslahah darurriyah which directly protects the soul (hifz al-nafs) and intellect (hifz al-'aql) of consumers, while the circulation of products without ING contains mafsadah in the form of gharar elements which are prohibited in Islamic law based on the rules of al-dhararu yuzal. This study concludes that the synergy between strengthening supervisory capacity, cross-agency coordination, active coaching of MSE business actors, and consistency in sanctions enforcement is a prerequisite for the realization of a food supervision system that is fair and in line with the values of sharia maqashid.

لا يزال تداول المنتجات الغذائية المصنعة بدون علامة معلومات القيمة الغذائية (ING) موجودا في أسواق مدينة مالانغ المصغرة، كما يتضح من نتائج خمسة منتجات إشكالية في ملاحظات أكتوبر 2025. تشير هذه الحالة إلى ضعف الامتثال للجهات التجارية والإشراف الغذائي غير الأمثل، مما يهدد مباشرة حقوق المستهلكين في الحصول على معلومات صحيحة وواضحة وصادقة كما يكفلها المادة 4 من الحرف ج من القانون رقم 8 لعام 1999 المتعلق بحماية المستهلك. تهدف هذه الدراسة إلى تحليل آلية الإشراف التي ينظمها مركز مراقبة الغذاء والدواء في سورابايا (BBPOM) على تداول المنتجات الغذائية بدون ملصقات ING في متاجر مدينة مالانغ الصغيرة من منظور قانوني إيجابي، بالإضافة إلى فحص الإشراف من منظور الشريعة المقشيد.تستخدم هذه الدراسة منهجا فقهيا تجريبيا مع نهج اجتماعي. تم الحصول على البيانات الأولية من خلال مقابلات مع ضباط بوكيت بوكيت سورابايا والملاحظات الميدانية، بينما تم الحصول على البيانات الثانوية من القوانين والأنظمة، والأدبيات العلمية، والوثائق الرسمية للبوك. تم تحليل البيانات المجمعة وصفيا-تحليليا لكشف الفجوة بين المعايير القانونية المعمول بها وواقع تنفيذ الإشراف في الميدان.
تظهر نتائج الدراسة أنه من منظور قانوني إيجابي، لدى BBPOM سورابايا بالفعل أساس معياري شامل يستند إلى القانون رقم 18 لعام 2012 المتعلق بالغذاء، والقانون رقم 8 لعام 1999 بشأن حماية المستهلك، ولائحة حماية المستهلك رقم 26 لعام 2021، وقد نفذ آليات إشراف قبل وبعد السوق إجرائيا. ومع ذلك، لا تزال هذه الإشراف تعاني من نقص الموارد البشرية، والتنسيق غير الأمثل بين الوكالات، وتداول المنتجات بدون تصاريح توزيع في السوق. أما من منظور مشروع الشريعة، فإن واجب تصنيف ING هو تجسيد للمصالحة دارورية التي تحمي مباشرة الروح (حفظ النفس) والعقل (حفظ العقل) للمستهلكين، بينما تداول المنتجات بدون ING يحتوي على مفسادات على شكل عناصر غرر محظورة في الشريعة الإسلامية وفقا لقواعد الدليل اليدوي. خلصت هذه الدراسة إلى أن التآزر بين تعزيز القدرة الإشرافية، والتنسيق بين الوكالات، والتدريب النشط لفاعلي الأعمال في قطاع الاقتصاد، والاتساق في تنفيذ العقوبات هو شرط أساسي لتحقيق نظام إشراف غذائي عادل ومتوافق مع قيم الشريعة المقشدة.
