Keadilan persyaratan tinggi badan dalam seleksi CPNS Kejaksaan perspektif Maqashid Syariah dan prinsip Non Diskriminasi

ABSTRAK

Penelitian ini mengkaji problematika persyaratan tinggi badan dalam rekrutmen CPNS Kejaksaan yang berpotensi membatasi hak atas pekerjaan. Tujuannya adalah menganalisis implementasi syarat tersebut di Kejari Kota Malang dan Batu, implikasinya terhadap persamaan hak, serta merumuskan rekonstruksinya berdasarkan Maqashid Syariah. Jenis penelitian ini adalah yuridis empiris dengan pendekatan sosiologis. Data primer dikumpulkan melalui wawancara di Kejari Malang, Kejari Batu, dan praktisi hukum, didukung data sekunder, kemudian dianalisis secara deskriptifkualitatif. Hasil penelitian menunjukkan syarat tinggi badan tidak relevan dengan kompetensi intelektual Jaksa, sehingga bertentangan dengan sistem merit serta pilar Hifz al-'Aql dan Hifz al-Nafs dalam Maqashid Syariah. Rekonstruksinya adalah mengalihkan kriteria fisik ke standar medical check-up. Sebagai implikasi perbaikan, pemerintah diwajibkan merevisi regulasi utamanya, yaitu Peraturan Jaksa Agung Republik Indonesia Nomor: PER-048/A/J.A/12/2011 tentang Pengadaan Pegawai Negeri Sipil Kejaksaan Republik Indonesia, agar rekrutmen berjalan proporsional dan non-diskriminatif.

ABSTRACT

This research examines the problematic height requirements in the recruitment of Prosecutor's Office civil servant candidates (CPNS) that potentially limit the constitutional right to work. The objective is to analyze the implementation of this requirement at the District Prosecutor's Offices of Malang and Batu, its implications for equal rights, and to formulate its reconstruction based on Maqasid al-Shari'ah. This is an empirical juridical research utilizing a sociological approach. Primary data were collected through interviews at the Malang and Batu District Prosecutor's Offices, and with legal practitioners, supported by secondary data, then analyzed descriptively and qualitatively. The results indicate that the height requirement is irrelevant to the intellectual competence of a Prosecutor, thus contradicting the merit system as well as the pillars of Hifz al-'Aql and Hifz al-Nafs in Maqasid al-Shari'ah. The proposed reconstruction is to shift from physical criteria to medical check-up standards. As an implication for improvement, the government is obliged to revise its main regulation, namely the Attorney General's Regulation of the Republic of Indonesia Number: PER-048/A/J.A/12/2011 concerning the Procurement of Civil Servants of the Indonesian Prosecutor's Office, to ensure a proportional and non-discriminatory recruitment process.
