Pengawasan Dinas Pariwisata Kota Batu dalam Mitigasi Kecelakaan yang disebabkan kelalaian pelaku usaha wisata perspektif Perda Kota Batu no. 1 tahun 2013 tentang Kepariwisataan dan Maqashid Syariah

Kota Batu sebagai ikon destinasi wisata di Jawa Timur mengalami pertumbuhan yang masif, namun diiringi risiko keselamatan serius, dibuktikan dengan kasus kecelakaan di wahana Jatim Park 1 yang mengindikasikan lemahnya pengawasan Dinas Pariwisata terhadap standar keamanan penyelenggara usaha wisata. Kondisi ini bertentangan dengan amanat hukum positif maupun prinsip Hifdz an-Nafs (perlindungan jiwa) dalam Maqashid Syariah. Penelitian ini bertujuan untuk menjelaskan pelaksanaan pengawasan dalam mitigasi kecelakaan oleh Dinas Pariwisata Kota Batu ditinjau dari perspektif Perda Kota Batu Nomor 1 Tahun 2013 dan perspektif Maqashid Syariah.
Penelitian ini menggunakan metode yuridis-empiris dengan pendekatan yuridis-sosiologis, berlokasi di Dinas Pariwisata Kota Batu dan Jatim Park 1. Data primer diperoleh melalui wawancara mendalam dengan pihak Dinas Pariwisata dan manajemen Jatim Park 1, sedangkan data sekunder bersumber dari peraturan perundang-undangan dan literatur hukum terkait. Seluruh data dianalisis secara kualitatif melalui tahap pemeriksaan, klasifikasi, dan penarikan kesimpulan.
Hasil penelitian menunjukkan bahwa pengawasan Dinas Pariwisata Kota Batu masih bersifat administratif dan berfrekuensi rendah, yakni hanya sekali dalam setahun tanpa inspeksi teknis berkala, sehingga bertentangan dengan Pasal 77 Perda Kota Batu No. 1 Tahun 2013, Pasal 26 UU No. 10 Tahun 2009 tentang Kepariwisataan, dan Pasal 4 huruf a UU No. 8 Tahun 1999 tentang Perlindungan Konsumen. Ditinjau dari perspektif Maqashid Syariah, lemahnya pengawasan tersebut merupakan pembiaran terhadap dharar (bahaya) yang bertentangan dengan kaidah ad-dararu yuzalu serta mengabaikan prinsip Hifdz an-Nafs dan Hifdz al-Mal. Dinas Pariwisata belum menjalankan fungsi al-hisbah secara optimal sehingga hak wisatawan atas keselamatan belum terpenuhi secara maksimal.

Batu City, as an iconic tourist destination in East Java, has experienced massive tourism growth accompanied by serious safety risks, evidenced by an accident incident at Jatim Park 1 that indicated weak supervision by the Tourism Office over the safety standards of tourism business operators. This condition is inconsistent with positive law mandates and the principle of Hifdz an-Nafs (protection of life) in Maqashid Syariah. This study aims to explain the implementation of supervision in accident mitigation by the Batu City Tourism Office from the perspective of Batu City Regional Regulation No. 1 of 2013 and from the perspective of Maqashid Syariah.
This research employs a juridical-empirical method with a juridical-sociological approach, conducted at the Batu City Tourism Office and Jatim Park 1. Primary data were gathered through in-depth interviews with Tourism Office officials and Jatim Park 1 management, while secondary data consisted of relevant legislation and legal literature. All data were analyzed qualitatively through examination, classification, and conclusion drawing.
The findings reveal that the Batu City Tourism Office’s supervision remains administrative in nature and infrequent, conducted only once a year without periodic technical inspections, which is inconsistent with Article 77 of Regional Regulation No. 1 of 2013, Article 26 of Law No. 10 of 2009 on Tourism, and Article 4(a) of Law No. 8 of 1999 on Consumer Protection. From the perspective of Maqashid Syariah, the weak technical supervision constitutes tolerance toward dharar (harm), contradicting the maxim ad-dararu yuzalu and neglecting the principles of Hifdz an-Nafs and Hifdz al-Mal. The Tourism Office has not optimally fulfilled its al-hisbah function, leaving tourists’ rights to safety unfulfilled.

تعدّ مدينة باتو وجهةً سياحيةً بارزةً في جاوة الشرقية، شهدت نموًا سياحيًا متسارعًا رافقته مخاطر سلامةٌ جسيمة، تجلّت في حادثة جاتيم بارك 1 التي كشفت عن ضعف إشراف ديوان السياحة على معايير السلامة. ويتعارض ذلك مع متطلبات القانون الوضعي ومبدأ حفظ النفس في مقاصد الشريعة. تهدف هذه الدراسة إلى بيان آليات الإشراف في تخفيف الحوادث من منظور اللائحة المحلية رقم 1 لسنة 2013 ومقاصد الشريعة.
استخدمت الدراسة المنهج القانوني التجريبي بالمقاربة الاجتماعية القانونية، أُجريت في ديوان السياحة بمدينة باتو وجاتيم بارك 1. جُمعت البيانات الأولية عبر مقابلات معمقة مع مسؤولي الديوان وإدارة جاتيم بارك 1، فيما اشتملت البيانات الثانوية على التشريعات والأدبيات القانونية ذات الصلة، وجرى تحليلها نوعيًا عبر مراحل الفحص والتصنيف والاستنتاج.
أظهرت النتائج أنّ إشراف ديوان السياحة بمدينة باتو لا يزال ذا طابعْ إداريّ متدنّي التكرار، يٌجرى مرةً واحدةً في السنة دون رقابةٍ تقنيةٍ دورية، مما يتعارض مع المادة 77 من اللائحة المحلية رقم 1 لسنة 2013 والمادة 26 من قانون السياحة والمادة 4(أ) من قانون حماية المستهلك. ومن منظور مقاصد الشريعة، يمثّل هذا الضعف تسامحًا مع الضرر، مخالفًا لقاعدة "الضرر يُزال" ومُهملاً لمبدأي حفظ النفس وحفظ المال، ودلّ على أنّ الديوان لم يؤدِ وظيفته كجهة حسبة بالصورة المثلى، مما أدى إلى عدم تحقق حقوق السياح في الأمن والسلامة على النحو الأمثل
