Implementasi surat edaran nomor: 45/Pk.03.03/KESRA tentang 9 langkah pembangunan pendidikan Jawa Barat menuju terwujudnya Gapura Panca Waluya: Studi di Barak Militer Resimen Armed 1 Kostrad Purwakarta Jawa Barat

ABSTRAK

Surat Edaran Nomor: 45/Pk.03.03/Kesra Tentang 9 Langkah Pembangunan Pendidikan Jawa Barat Menuju Terwujudnya Gapura Panca Waluya, point ke 8 mengenai kebijakan baru bertujuan untuk mendorong program penempatan anak ke barak militer. Melalui Program ini Pemerintah Provinsi Jawa Barat menunjukkan komitmen nyata dalam menangani persoalan kenakalan remaja dengan mengalokasikan anggaran sebesar Rp 6 miliar dari Anggaran Pendapatan dan Belanja Daerah (APBD) Tahun 2025. Dari keterangan surat edaran tersebut memiliki tujuan yaitu Gapura Panca Waluya yang mengandung arti filosofis yakni ”5 Jalan Menuju Pendidikan yang Sejahtera” lima nilai inti dari makna tersebut yaitu, Cageur (sehat secara fisik dan mental), Bageur (berakhlak baik), Bener (jujur), Pinter (cerdas) dan Singer (sigap). Namun Program tersebut banyak menuai kritik karena dinilai berpotensi menjadi pemborosan anggaran daerah, terutama dari lembaga perlindungan anak dan kalangan akademisi. Kritik tersebut berpandangan bahwa penerapan barak militer bagi pelajar berisiko mengesampingkan prinsip-prinsip perlindungan anak serta nilai-nilai hak asasi manusia. Perbedaan antara konstruksi hukum dan fakta-fakta yang terungkap di lapangan memunculkan pertanyaan mengenai kesesuaian hak anak dengan ketentuaan Surat Edaran, serta prinsip Maqashid Al Usrah.

Penelitian ini merupakan penelitian hukum Empiris dengan pendekatan Deskriptif Kualitatif, Data diperoleh berdasarkan norma-norma atau peraturan yang mengikat, dengan pola kualitatif yang bertumpu pada data deskriptif-analitis, baik yang diperoleh melalui wawancara dengan responden maupun dari pengamatan langsung terhadap perilaku mereka untuk menilai kesesuaian surat edaran dengan praktik dan prinsip maqaṣid al usrah.

Hasil penelitian menunjukkan bahwa Upaya implementasi serta tinjauan Maqashid Al Usrah Surat Edaran Nomor: 45/PK.03.03/KESRA oleh Resimen Armed 1 Kostrad Purwakarta dilaksanakan melalui program pembinaan barak militer yang melibatkan kerja sama antara Pemerintah Daerah, Dinas Pendidikan, TNI, pihak sekolah, dan orang tua peserta. Program ini dirancang sebagai respons atas meningkatnya kasus kenakalan pelajar dan bertujuan untuk membentuk kembali disiplin, karakter, dan moral peserta melalui pembinaan fisik, mental, kerohanian, serta tetap mempertahankan kegiatan belajar mengajar selama masa pembinaan 15 hari, implementasi dan tinjauan Maqashid Al Usrah sudah sejalan, namun belum sepenuhnya optimal dan harus ada evaluasi terkait pelatih dalam pendekatan pembinaan anak dan menghilangkan kekerasan pada peserta.

Circular Letter Number: 45/Pk.03.03/Kesra Regarding 9 Steps for West Java Education Development Towards the Realization of the Panca Waluya Gate, point 8 regarding the new policy aims to encourage the program of placing children in military barracks. Through this program, the West Java Provincial Government has shown a real commitment to dealing with the problem of juvenile delinquency by allocating a budget of Rp 6 billion from the 2025 Regional Revenue and Expenditure Budget (APBD). From the information of the circular, the circular has a purpose, namely Gapura Panca Waluya which contains a philosophical meaning, namely "5 Paths Towards Prosperous Education" the five core values of the meaning, namely, Cageur (physically and mentally healthy), Bageur (good morals), Bener (honest), Pinter (intelligent) and Singer (Laughter). However, the program has received a lot of criticism because it is considered to have the potential to be a waste of the regional budget, especially from child protection institutions and academics. The critics argued that the implementation of military barracks for students risked overriding child protection principles and human rights values. The difference between the legal construction and the facts revealed in the field raises questions about the conformity of children's rights with the provisions of the Circular, as well as the principles of Maqashid Al Usrah.

This research is an Empirical legal research with a Qualitative Descriptive approach, Data is obtained based on binding norms or regulations, with a qualitative pattern that relies on descriptive-analytical data, both obtained through interviews with respondents and from direct observation of their behavior to assess the suitability of the circular letter with the practices and principles of maqaṣid al usrah.

The results of the study show that the implementation and review of Maqashid Al Usrah Circular Letter Number: 45/PK.03.03/KESRA by the Armed Regiment 1 Kostrad Purwakarta was carried out through a military barracks development program involving cooperation between the Regional Government, the Education Office, the TNI, the school, and the parents of the participants. This program is designed in response to the increasing cases of student delinquency and aims to reshape the discipline, character, and morals of participants through physical, mental, and spiritual coaching, as well as maintaining teaching and learning activities during the 15-day coaching period, the implementation and review of Maqashid Al Usrah has been in line, but it is not fully optimal and there must be an evaluation related to coaches in the approach to child development and eliminating violence in the participants.

تظهر نتائج الدراسة أن تنفيذ ومراجعة التعميم رقم الرسالة التعريفية لمقتل العسرة: 45/PK.03.03/KESRA من قبل الفوج المسلح الأول كوستراد بورواكرتا تم من خلال برنامج تطوير الثكنات العسكرية الذي شمل التعاون بين الحكومة الإقليمية، ومكتب التعليم، والجيش الوطني الإسلامي، والمدرسة، وأولياء أمور المشاركين. تم تصميم هذا البرنامج استجابة لتزايد حالات انحراف الطلاب ويهدف إلى إعادة تشكيل الانضباط والشخصية والأخلاق للمشاركين من خلال التدريب الجسدي والذهني والروحي، بالإضافة إلى الحفاظ على أنشطة التعليم والتعلم خلال فترة التدريب التي تستمر 15 يوما، وقد تم تنفيذ ومراجعة مقاشد العسرة بشكل جيد، لكنه ليس مثاليا بالكامل ويجب إجراء تقييم متعلق بالمدربين في نهج تنمية الطفل والقضاء على العنف في المشاركون.
