Perlindungan hukum hak Spiritualitas masyarakat adat Bayan menurut Perda Kabupaten Lombok Utara nomor 6 tahun 2020 dan Maqashid Syariah As Syaitibi

Penelitian ini dilatarbelakangi oleh pentingnya pengakuan dan perlindungan terhadap hak spiritualitas masyarakat adat yang semakin terancam akibat modernisasi, marginalisasi, dan kurangnya pemahaman hukum. Fokus penelitian ini adalah masyarakat adat Bayan di Kabupaten Lombok Utara yang memiliki sistem kepercayaan dan ritual adat yang khas. Tujuan dari penelitian ini adalah untuk menganalisis bentuk perlindungan hukum terhadap hak spiritualitas masyarakat adat Bayan menurut Peraturan Daerah Kabupaten Lombok Utara Nomor 6 Tahun 2020 serta meninjau kesesuaiannya dengan prinsip Maqashid Syariah menurut As Syaitibi.
Jenis penelitian ini adalah yuridis empiris dengan pendekatan yuridis sosiologis. Lokasi penelitian di Desa Bayan Kecamatan Bayan Kabupaten Lombok Utara NTB. Metode pengambilan sampel dilakukan melalui purposive sampling dengan sumber data yang terdiri dari data primer dan sekunder.Analisis data dalam penelitian ini menggunakan metode deskriptif analisis
Hasil penelitian menunjukkan: 1) Perlindungan hukum terhadap masyarakat adat Bayan telah diakomodasi dalam Perda No. 6 Tahun 2020 yang memberikan pengakuan terhadap sistem kepercayaan, ritual, dan upacara adat masyarakat sebagai bentuk perlindungan preventif. 2) Dalam perspektif Maqashid Syariah, perlindungan tersebut sejalan dengan prinsip hifz al-din, hifz al-nafs, hifz al-‘aql, hifz al-nasl, dan hifz al-mal. Perlindungan hukum perlu terus diperkuat melalui implementasi nyata dengan menambahkan pasal sanksi (punishment) serta meningkatkan pemberdayaan dan edukasi budaya untuk menghilangkan stigma terhadap masyarakat adat Bayan. Selain itu, perlu adanya kolaborasi antara pemerintah desa, tokoh adat, pemuka agama, dan akademisi untuk menyusun Peraturan Desa yang lebih spesifik guna menciptakan perlindungan hak spiritual yang ideal.

This research is motivated by the importance of recognizing and protecting the spiritual rights of indigenous communities, which are increasingly threatened by modernization, marginalization, and a lack of legal understanding. The focus of this research is the Bayan indigenous community in North Lombok Regency, which has a distinctive system of beliefs and traditional rituals. The purpose of this study is to analyze the form of legal protection for the spiritual rights of the Bayan indigenous community according to the North Lombok Regency Regional Regulation No. 6 of 2020, as well as to review its conformity with the principles of Maqashid Syariah according to As-Syatibi.
This type of research is empirical juridical with a sociological juridical approach. The research was conducted in Bayan Village, Bayan District, North Lombok Regency, West Nusa Tenggara (NTB). The sampling method used was purposive sampling, with data sources consisting of primary and secondary data. Data analysis in this study employed a descriptive analytical method.
The research findings indicate: 1) Legal protection for the Bayan indigenous community has been accommodated in Regional Regulation No. 6 of 2020, which provides recognition of the community's belief systems, rituals, and traditional ceremonies as a form of preventive protection. 2) From the perspective of Maqashid Syariah, this protection is in line with the principles of hifz al-din, hifz al-nafs, hifz al-‘aql, hifz al-nasl, and hifz al-mal. Legal protection needs to be continuously strengthened through concrete implementation by adding articles on sanctions (punishment), as well as enhancing empowerment and cultural education to eliminate the stigma against the Bayan indigenous community. Furthermore, there is a need for collaboration between the village government, traditional leaders, religious figures, and academics to draft a more specific Village Regulation to create ideal protection for spiritual rights.

ينطلق هذا البحث من أهمية الاعتراف بالحقوق الروحية للمجتمعات الأصلية وحمايتها، وهي حقوق تتعرض للتهديد بشكل متزايد بسبب التحديث والتهميش ونقص الفهم القانوني. يركز هذا البحث على مجتمع بايان الأصلي في منطقة شمال لومبوك، الذي يمتلك نظامًا مميزًا من المعتقدات والطقوس التقليدية. الهدف من هذه الدراسة هو تحليل شكل الحماية القانونية للحقوق الروحية لمجتمع بايان الأصلي وفقًا للائحة الإقليمية لمنطقة شمال لومبوك رقم 6 لعام 2020، بالإضافة إلى مراجعة مدى توافقها مع مبادئ مقاصد الشريعة عند الشاطبي.
هذا البحث هو بحث قانوني تجريبي ذو منهج قانوني اجتماعي. أُجري البحث في قرية بايان، مديرية بايان، منطقة شمال لومبوك، نوسا تينجارا الغربية (NTB). تم استخدام أسلوب أخذ العينات القصدية، مع مصادر بيانات تتكون من بيانات أولية وثانوية. استخدم تحليل البيانات في هذه الدراسة المنهج الوصفي التحليلي.
تشير نتائج البحث إلى ما يلي: ١) تم استيعاب الحماية القانونية لمجتمع بايان الأصلي في اللائحة الإقليمية رقم 6 لعام 2020، والتي تنص على الاعتراف بنظم المعتقدات والطقوس والاحتفالات التقليدية للمجتمع كشكل من أشكال الحماية الوقائية. ٢) من منظور مقاصد الشريعة، تتوافق هذه الحماية مع مبادئ حفظ الدين، وحفظ النفس، وحفظ العقل، وحفظ النسل، وحفظ المال. تحتاج الحماية القانونية إلى تعزيز مستمر من خلال التنفيذ الملموس عبر إضافة مواد تتعلق بالعقوبات، بالإضافة إلى تعزيز التمكين والتثقيف الثقافي لإزالة الوصمة ضد مجتمع بايان الأصلي. علاوة على ذلك، هناك حاجة للتعاون بين حكومة القرية والزعماء التقليديين والشخصيات الدينية والأكاديميين لصياغة لائحة قروية أكثر تحديدًا بهدف توفير حماية مثالية للحقوق الروحية.
