Perbantuan TNI kepada Polri dalam Harkamtibmas ( Pemeliharaan, Keamanan, dan Ketertiban Masyarakat): Studi MoU Nomor: B/2/I/2018

ABSTRAK

Penelitian ini difokuskan untuk mengkaji status bantuan TNI kepada POLRI dalam Harkamtibmas yang tertuang dalam Nota Kesepahaman Nomor: B/2/I/2018 ditinjau melalui peraturan perundang-undangan di Indonesia. Pembuatan nota kesepahaman atau MoU Nomor: B/2/I/2018 yang dilakukan oleh Panglima TNI dan Panglima POLRI pada tahun 2018 menuai berbagai pro dan kontra karena dianggap tidak sesuai dengan peraturan perundang-undangan. Bahkan nota kesepahaman ini masih diperpanjang hingga saat ini. Oleh karena itu, penelitian ini bertujuan untuk mengkaji bagaimana status bantuan TNI kepada POLRI dalam HARKAMTIBMAS yang tertuang dalam Nota Kesepahaman Nomor: B/2/I/2018 ditinjau dari peraturan perundang-undangan di Indonesia, serta implikasi MoU tersebut terhadap kinerja TNI-POLRI. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan konseptual dan pendekatan perundang-undangan. Proses pengumpulan data dalam penelitian ini dilakukan melalui studi kepustakaan. Sumber kepustakaan diperoleh dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Hasil penelitian ini menunjukkan bahwa Nota Kesepahaman (MoU) bukanlah dasar hukum yang kuat untuk mengadakan perjanjian dan substansi MoU yang dibentuk oleh TNI-POLRI tidak sejalan dengan apa yang tercantum dalam peraturan perundang-undangan yang berlaku. Selain itu, terkait tugas membantu TNI kepada POLRI yang tercantum dalam MoU ini, kinerja TNI dan POLRI semakin tumpang tindih dan menyebabkan TNI terlalu terlibat dalam ranah sipil sehingga kinerja TNI menjadi kurang profesional. Dalam penelitian ini dapat disimpulkan bahwa apa yang dilakukan POLRI terhadap TNI dengan maksud membantu tugas POLRI dalam Harkamtibmas melalui MoU B/2/I.2018 merupakan kesepakatan melalui keputusan pribadi hanya antara kedua belah pihak, perlu ada instrumen penting lainnya yang harus dilibatkan juga.

ABSTRACT

This research focuses on examining the status of the Indonesian National Armed Forces (TNI)'s assistance to the Indonesian National Police (POLRI) in maintaining public order and security (Harkamtibmas), as outlined in Memorandum of Understanding Number B/2/I/2018, as reviewed through Indonesian laws and regulations. The Memorandum of Understanding (MoU) Number B/2/I/2018, signed by the TNI Commander and the POLRI Commander in 2018, has drawn considerable controversy due to its perceived non-compliance with laws and regulations. This memorandum of understanding has even been extended to date. Therefore, this research aims to examine the status of the TNI's assistance to the POLRI in maintaining public order and security (HARKAMTIBMAS), as outlined in Memorandum of Understanding Number B/2/I/2018, as reviewed through Indonesian laws and regulations, and the implications of this MoU on the performance of the TNI and POLRI. This research uses a normative legal research method with a conceptual and statutory approach. Data collection in this study was conducted through a literature review. The literature sources were obtained from primary, secondary, and tertiary legal materials.

The results of this study indicate that the Memorandum of Understanding (MoU) is not a strong legal basis for entering into an agreement, and the substance of the MoU established by the Indonesian National Armed Forces (TNI) and the Indonesian National Police (POLRI) does not align with applicable laws and regulations. Furthermore, regarding the TNI's task of assisting the POLRI as stipulated in this MoU, the performance of the TNI and POLRI increasingly overlaps, causing the TNI to become overly involved in civilian matters, resulting in its performance becoming less professional. This study concludes that the POLRI's actions toward the TNI, with the intention of assisting the POLRI in maintaining public order and security, through MoU B/2/I.2018, constitute an agreement made through a personal decision between the two parties. Other important instruments must also be involved.

يركز هذا البحث على دراسة حالة مساعدة القوات المسلحة الإندونيسية للشرطة الوطنية الإندونيسية في الحفاظ على النظام العام والأمن (Harkamtibmas)، على النحو المنصوص عليه في مذكرة التفاهم رقم B/2/I/2018، كما تمت مراجعتها من خلال القوانين واللوائح الإندونيسية. وقد أثارت مذكرة التفاهم رقم B/2/I/2018، التي وقعها قائد القوات المسلحة الإندونيسية وقائد الشرطة الوطنية الإندونيسية في عام 2018، جدلاً كبيراً لأنها تعتبر غير متسقة مع القوانين واللوائح. في الواقع، تم تمديد مذكرة التفاهم هذه حتى الآن. لذلك، يهدف هذا البحث إلى دراسة حالة مساعدة القوات المسلحة الإندونيسية للشرطة الوطنية الإندونيسية في الحفاظ على النظام العام والأمن (Harkamtibmas)، على النحو المنصوص عليه في مذكرة التفاهم رقم B/2/I/2018، كما تمت مراجعتها من خلال القوانين واللوائح الإندونيسية، وآثار مذكرة التفاهم هذه على أداء القوات المسلحة الإندونيسية والشرطة الوطنية الإندونيسية. يستخدم هذا البحث أسلوب بحث قانوني معياري بنهج مفاهيمي وقانوني. أُجريت عملية جمع البيانات في هذه الدراسة من خلال مراجعة الأدبيات. وقد تم الحصول على مصادر الأدبيات من المواد القانونية الأولية والمواد القانونية الثانوية والمواد القانونية من الدرجة الثالثة. وتشير نتائج هذه الدراسة إلى أن مذكرة التفاهم لا تشكل أساسًا قانونيًا قويًا لإبرام الاتفاقيات، وأن جوهر مذكرة التفاهم التي أبرمتها القوات المسلحة الإندونيسية والشرطة الوطنية الإندونيسية لا يتماشى مع القوانين واللوائح المعمول بها. وعلاوة على ذلك، فإن مساعدة القوات المسلحة الإندونيسية للشرطة الوطنية الإندونيسية على النحو المنصوص عليه في مذكرة التفاهم هذه قد أدت إلى تداخل في أداء القوات المسلحة الإندونيسية والشرطة الوطنية الإندونيسية، وأدت إلى تدخل القوات المسلحة الإندونيسية المفرط في الشؤون المدنية، مما أدى إلى أداء أقل احترافية. وتخلص هذه الدراسة إلى أن اتفاقية الشرطة الوطنية الإندونيسية (POLRI) مع القوات المسلحة الوطنية الإندونيسية (TNI) لمساعدة الشرطة الوطنية الإندونيسية في الحفاظ على النظام العام والأمن من خلال مذكرة التفاهم B/2/I.2018 تشكل اتفاقية تستند فقط إلى قرار شخصي بين الطرفين. وينبغي أيضًا إشراك أدوات مهمة أخرى.
