Pemenuhan hak penyandang Disabilitas dalam Peraturan Daerah Kabupaten Bondowoso nomor 6 Tahun 2021 perspektif Siyasah Dusturiyah: Studi di Dinas Pendidikan Kabupaten Bondowoso

ABSTRAK

Perda Kabupaten Bondowoso Nomor 6 Tahun 2021 mengatur tentang pemenuhan hak penyandang disabilitas salah satunya dalam bidang Pendidikan di Kabupaten Bondowoso. Penelitian ini menganalisis implementasi pemenuhan hak penyandang disabilitas di Kabupaten Bondowoso berdasarkan Perda Kabupaten Bondowoso Nomor 6 Tahun 2021. Pengkajian pemenuhan hak penyandang disabilitas dianalisis menggunakan perspektif Siyasah Dusturiyah menurut Al-Ghazali. Jenis Penelitian ini adalah yuridis empiris dengan pendekatan sosiologis melalui pengamatan langsung dan wawancara yang mendalam. Sumber data yang digunakan yaitu sumber data primer berupa data hasil wawancara. Tujuan penelitian ini untuk menganalisis pemenuhan hak pendidikan penyandang disabilitas berdasarkan Perda Kabupaten Bondowoso Nomor 6 Tahun 2021 dan dianalisis perspektif siyasah dusturiyah Al-Ghazali. Metode pengumpulan data dilakukan dengan wawancara dan penyusunan dokumentasi penelitian. Hasil penelitian ini menyatakan bahwa 1). Secara normatif pemenuhan hak siswa penyandang disabilitas di Kabupaten Bondowoso sudah diatur dalam Perda Kabupaten Bondowoso Nomor 6 Tahun 2021, namun dalam implementasi di lapangan masih banyak yang belum terlaksana, seperti halnya pengadaan fasilitas ramah disabilitas dan metode pembelajaran khusus siswa disabilitas di sekolah Kabupaten Bondowoso yang terbilang belum ramah disabilitas. 2). Pemenuhan hak penyandang disabilitas dianalisis Perspektif Siyasah Dusturiyah Al-Ghazali dapat dipahami bahwa belum memenuhi prinsip kemaslahatan, keadilan, dan kesejahteraan. Fakta lapangan masih banyak infrastruktur atau sarana prasana di lingkungan pendidikan yang belum ramah disabilitas, masih adanya diskriminasi yang dirasakan oleh siswa penyandang disabilitas serta belum mendapatkan hak-haknya baik dalam hal infrastruktur atau metode pembelajaran.

Regional Regulation of Bondowoso Regency Number 6 of 2021 regulates the fulfillment of the rights of persons with disabilities, one of which is in the field of education in Bondowoso Regency. This study analyzes the implementation of the fulfillment of the rights of persons with disabilities in Bondowoso Regency based on Bondowoso Regency Regional Regulation Number 6 of 2021. The assessment of the fulfillment of the rights of persons with disabilities is analyzed using the perspective of Siyasah Dusturiyah according to Al-Ghazali. This type of research is empirical juridical with a sociological approach through direct observation and in-depth interviews. The data sources used are primary data sources in the form of interview data. The purpose of this research is to analyze the fulfillment of the educational rights of persons with disabilities based on Bondowoso Regency Regional Regulation Number 6 of 2021 and analyzed from the perspective of Al-Ghazali's siyasah dusturiyah. The data collection method was carried out by interviewing and compiling research documentation. The results of this study state that 1). Normatively, the fulfillment of the rights of students with disabilities in Bondowoso Regency is regulated in Bondowoso Regency Regulation Number 6 of 2021, but in practice, many things have not been implemented, such as the provision of disability-friendly facilities and special learning methods for students with disabilities in schools in Bondowoso Regency, which are still not disability-friendly. 2). The fulfillment of the rights of persons with disabilities analyzed from the perspective of Siyasah Dusturiyah Al-Ghazali can be understood as not yet fulfilling the principles of benefit, justice, and welfare. The fact is that there is still a lot of infrastructure or facilities in the educational environment that are not disability-friendly, there is still discrimination felt by students with disabilities, and they have not obtained their rights in terms of infrastructure or learning methods.

ينظم قانون مقاطعة بوندووسو رقم 6 لعام 2021 إعمال حقوق الأشخاص ذوي الإعاقة، ومن بينها الحق في التعليم في مقاطعة بوندووسو. تحلل هذه الدراسة تنفيذ إعمال حقوق الأشخاص ذوي الإعاقة في مقاطعة بوندووسو استنادًا إلى قانون مقاطعة بوندووسو رقم 6 لعام 2021. يتم تحليل تقييم إعمال حقوق الأشخاص ذوي الإعاقة باستخدام منظور السياسة الدستورية وفقًا للغزالي.هذا البحث هو بحث قانوني تجريبي يتبع نهجًا سوسيولوجيًا من خلال الملاحظة المباشرة والمقابلات المتعمقة. مصدر البيانات المستخدم هو البيانات الأولية في شكل بيانات المقابلات. الغرض من هذه الدراسة هو تحليل إعمال حق الأشخاص ذوي الإعاقة في التعليم استنادًا إلى لائحة مقاطعة بوندووسو رقم 6 لعام 2021 وتحليلها من منظور سياسة الغزالي الدستورية. تم جمع البيانات من خلال المقابلات وتجميع وثائق البحث..تشير نتائج هذه الدراسة إلى ما يلي: 1) من الناحية النظرية، ينظم حق الطلاب ذوي الإعاقة في مقاطعة بوندووسو بموجب لائحة مقاطعة بوندووسو رقم 6 لعام 2021، ولكن من الناحية العملية، لا يزال هناك العديد من الأمور التي لم يتم تنفيذها، مثل توفير مرافق ملائمة لذوي الإعاقة وأساليب تعليمية خاصة للطلاب ذوي الإعاقة في المدارس في مقاطعة بوندووسو، والتي لا تزال غير ملائمة لذوي الإعاقة. 2). إن إعمال حقوق الأشخاص ذوي الإعاقة، من منظور سياسة دستورية الغزالي، يمكن فهمه على أنه لا يفي بعد بمبادئ المنفعة والعدالة والرفاهية. الواقع على الأرض هو أنه لا يزال هناك نقص في البنية التحتية أو المرافق الملائمة للأشخاص ذوي الإعاقة في البيئة التعليمية، ولا يزال الطلاب ذوو الإعاقة يعانون من التمييز، ولم يحصلوا على حقوقهم من حيث البنية التحتية أو أساليب التعلم.
