Pola relasi pembagian nafkah keluarga poligami di era modern perspektif teori keadilan distributif dan komutatif Thomas Aquinas: Studi multi kasus di Kab. Mojokerto

Pola relasi dalam keluarga mencerminkan hubungan timbal balik antar anggota yang berperan penting dalam menjaga keharmonisan, khususnya antara suami dan istri yang idealnya menjalankan peran dan tanggung jawab secara seimbang. Hal ini juga berlaku dalam konteks keluarga poligami. Dalam konteks poligami, hukum Islam dan regulasi di Indonesia salah satu syarat utama poligami adalah kemampuan suami memberikan nafkah secara adil, baik lahir maupun batin. Namun, implementasi regulasi ini sering terkendala yang dilatarbelakangi oleh berbagai factor. Penelitian ini bertujuan menganalisis pola relasi serta penerapan prinsip keadilan distributif dan komutatif dalam pembagian nafkah istri dan anak pada keluarga poligami di wilayah Mojokerto.

Penelitian ini termasuk penelitian hukum empiris, dengan menggunakan pendekatan kasus (case approach) dan Yuridis sosiologis atau sosiologi hukum. Data dikumpulkan melalui metode wawancara mendalam, dan dokumentasi berupa arsip atau dokumen dari kantor Pengadilan Agama Mojokerto kelas 1A, selain itu juga dokumentasi terhadap keluarga-keluarga poligami yang dipilih secara purposif. Metode pengolahan data meliputi : pemeriksaan data, verifikasi, analisis, sistematisasi data, dan kesimpulan. Adapun analisis data yang digunakan oleh penulis dalam penelitian ini bersifat deskriptif analisis dengan pendekatan kualitatif.

Hasil penelitian menunjukkan bahwa praktik pembagian nafkah dalam keluarga poligami di era nmodern pada daerah Kab. Mojokerto belum sepenuhnya terpenuhi secara keadilan dari segi distributif (materil) maupun komutatifnya (immateril). Hal ini terbukti dari masih adanya ketimpangan dalam pemenuhan kebutuhan tiap keluarga poligami. Hal ini sebab dipengaruhi oleh faktor agama, pendidikan, ekonomi dan sumber penghasilan, relasi sosial dan psikologi istri, tempat tinggal dan jarak domisili. Temuan ini menegaskan pentingnya pemahaman yang lebih mendalam terhadap penerapan nilai keadilan dalam keluarga poligami, memerlukan penguatan regulasi internal keluarga, peningkatan kesadaran religius, serta intervensi edukatif yang menekankan pentingnya keadilan dalam relasi rumah tangga.

The pattern of relationships in the family reflects the reciprocal relationship between members who play an important role in maintaining harmony, especially between husband and wife who ideally carry out their roles and responsibilities in a balanced manner. This also applies in the context of polygamous families. In the context of polygamy, Islamic law and regulations in Indonesia, one of the main requirements for polygamy is the husband's ability to provide a fair living, both physically and mentally. However, the implementation of this regulation is often constrained by various factors. This study aims to analyze the pattern of relations and the application of the principles of distributive and commutative justice in the distribution of wife and child maintenance in polygamous families in the Mojokerto area.

This research includes empirical legal research, using a case approach and sociological juridical or legal sociology. Data were collected through in-depth interviews, and documentation in the form of archives or documents from the Mojokerto class 1A Religious Court office, as well as documentation on purposively selected polygamous families. Data processing methods include: data examination, verification, analysis, data systematization, and conclusions. The data analysis used by the author in this research is descriptive analysis with a qualitative approach.

The results of the study indicate that the practice of alimony distribution in polygamous families in the modern era in Mojokerto Regency has not been fully fulfilled in terms of distributive (material) and commutative (immaterial) justice. This is evident from the continuing inequality in meeting the needs of each polygamous family. This is influenced by factors such as religion, education, economy and income sources, social relations and the psychology of the wife, place of residence, and distance of domicile. These findings emphasize the importance of a deeper understanding of the application of justice values in polygamous families, requiring the strengthening of internal family regulations, increased religious awareness, and educational interventions that emphasize the importance of justice in domestic relations.

يعكس نمط العلاقات في الأسرة العلاقات المتبادلة بين أفرادها والتي تلعب دورًا مهمًا في الحفاظ على الانسجام، خاصة بين الأزواج والزوجات الذين يقومون بأدوارهم ومسؤولياتهم بشكل مثالي ومتوازن. وينطبق ذلك أيضًا في سياق الأسر متعددة الزوجات. في سياق تعدد الزوجات في إندونيسيا، فإن أحد المتطلبات الرئيسية لتعدد الزوجات في الشريعة الإسلامية واللوائح في إندونيسيا هو قدرة الزوج على توفير معيشة عادلة جسديًا وعقليًا. ومع ذلك، غالبًا ما يكون تنفيذ هذا النظام مقيدًا بعوامل مختلفة. تهدف هذه الدراسة إلى تحليل أنماط العلاقات وتطبيق مبادئ العدالة التوزيعية والتبادلية في توزيع نفقة الزوجة والطفل في الأسر متعددة الزوجات في منطقة موجوكيرتو..

نتائج البحث تظهر أن ممارسة توزيع النفقة في الأسر المتعددة الزوجات في العصر الحديث في منطقة مقاطعة موجوكيرتو لم تتحقق بشكل كامل من حيث العدالة التوزيعية (المادية) أو التبادلية (غير المادية). ويتضح ذلك من استمرار وجود تفاوت في تلبية احتياجات كل أسرة متعددة الزوجات. ويعزى ذلك إلى تأثير عوامل الدين والتعليم والاقتصاد ومصادر الدخل والعلاقات الاجتماعية والنفسية للزوجة ومكان الإقامة والمسافة بين أماكن الإقامة. وتؤكد هذه النتائج على أهمية فهم أعمق لتطبيق قيم العدالة في الأسرة المتعددة الزوجات، مما يتطلب تعزيز اللوائح الداخلية للأسرة، وزيادة الوعي الديني، والتدخل التربوي الذي يؤكد على أهمية العدالة في العلاقات الأسرية.
