Implementasi regulasi bimbingan perkawinan prespektif teori sistem hukum Lawrence M. Friedman: Studi KUA Kabupaten Nganjuk

Bimbingan Perkawinan adalah dalah sebuah nasehat perkawinan yang dikemas sebagai pelayanan sosial yang titik fokusnya terletak pada urusan keluarga, tujuan dari pembekalan pra nikah ini adalah agar tercapainya keluarga yang bahagia. Pembekalan pra nikah ini juga untuk mengarahkan serta memberikan pendidikan kepada calon pengantin sebelum dilaksanakanya proses pernikahan yang didalamnya mencakup materi mengenai kebijakan pemerintah dalam perkawinan. Tujuan penelitian ini untuk mengetahui dan memahami mengenai implementasi bimbingan perkawinan bagi setiap calon pengantin yang dianalisis menggunakan teori sistem hukum Lawrence M. Friedman.

Penelitian ini termasuk dalam jenis penelitian hukum empiris dengan pendekatan yuridis sosiologis. Bahan hukum yang digunakan adalah bahan hukum primer berupa peraturan Menteri Agama Republik Indonesia Nomor 22 Tahun 2024, hasil wawancara dari pihak KUA serta masyarakat yang terkait dan bahan hukum sekunder berupa yang mencakup sumber dari buku, artikel jurnal, tesis, regulasi dan media lain yang relevan untuk penelitian ini. Metode pengumpulan bahan hukum dilakukan dengan cara wawancara dan dokumentasi. Analisis bahan hukumnya dilakukan dengan metode deduktif.

Hasil penelitian ini menunjukan bahwa (1) Impelemntasi bimbingan perkawinan di KUA Ngronggot, Tanjunganom dan Prambon belum dapat dilaksanakan kembali sesuai regulasi yang mengaturnya dikarenakan adanya kendala yang melatarbelaknginya yaitu tidak adanya anggaran dana dan belum memiliki fasilitator bimbingan perkawinan yang tersertifikasi. Namun KUA Ngronggot tetap berupaya untuk tetap memberikan pesan dan nasehat seputar perkawinan bagi setiap calon pengantin meskipun dalam pelaksanaanya belum sesuai dengan regulasi bimbingan perkawinan, sedangkan KUA Tanjunganom dan KUA Prambon masih berusaha mencari jalan terbaik agar segera dapat menyelenggarakan program bimbingan perkawinan; (2) bahwasanya implementasi bimbingan perkawinan di ketiga KUA belum sesuai dengan teori sistem hukum Lawrence M. Friedman karena struktur hukum yaitu KUA belum menjalankan amanah dalam melaksanakan bimbingan perkawinan sehingga ketiga komponen teori sistem hukum belum berjalan bersama dan belum saling berkesinambungan.

Marriage Guidance is a marriage advice packaged as a social service whose focal point lies in family affairs, the purpose of this pre-marriage briefing is to achieve a happy family. This pre-marriage briefing is also to direct and provide education to the bride-to-be before the implementation of the marriage process which includes material on government policies in marriage. The purpose of this study is to find out and understand the implementation of marriage guidance for each prospective bride and groom which is analyzed using the theory of the legal system of Lawrence M. Friedman.

This research is included in the type of empirical legal research with a sociological juridical approach. The legal materials used are primary legal materials in the form of regulations of the Minister of Religion of the Republic of Indonesia Number 22 of 2024, the results of interviews from the KUA and related communities, and secondary legal materials in the form of sources from books, journal articles, theses, regulations and other media relevant to this research. The method of collecting legal materials is carried out by means of interviews and documentation. The analysis of the legal material is carried out by a deductive method.

The results of this study show that (1) The implementation of marriage guidance in KUA Ngronggot, Tanjunganom and Prambon has not been able to be implemented again in accordance with the regulations that govern it due to the obstacles that surround it, namely the absence of a budget and the lack of a certified marriage guidance facilitator. However, KUA Ngronggot still strives to continue to provide messages and advice about marriage for each bride-to-be even though its implementation is not in accordance with marriage guidance regulations, while KUA Tanjunganom and KUA Prambon are still trying to find the best way to immediately be able to organize marriage guidance programs (2) that the implementation of marriage guidance in the three KUA has not been in accordance with the theory of the legal system Lawrence M. Friedman because the legal structure, namely the KUA, has not carried out its mandate in carrying out marriage guidance so that the three components of the legal system theory have not run together and have not been sustainable with each other.

إرشادات الزواج هي نصيحة زواج معبأة كخدمة اجتماعية تكمن نقطة محورها في شؤون الأسرة ، والغرض من هذا الإحاطة قبل الزواج هو تحقيق أسرة سعيدة. وتهدف هذه الإحاطة الإعلامية قبل الزواج أيضا إلى توجيه وتوفير التعليم للعروس قبل تنفيذ عملية الزواج التي تتضمن مواد عن السياسات الحكومية في مجال الزواج. الغرض من هذه الدراسة هو معرفة وفهم تنفيذ إرشادات الزواج لكل عروس وعريس محتملين والتي يتم تحليلها باستخدام نظرية النظام القانوني للورانس إم فريدمان.

يتم تضمين هذا البحث في نوع البحث القانوني التجريبي بنهج قانوني اجتماعي. المواد القانونية المستخدمة هي مواد قانونية أولية في شكل لوائح وزير الشؤون الدينية في جمهورية إندونيسيا رقم 22 لعام 2024 ، ونتائج المقابلات من KUA والمجتمعات ذات الصلة ، ومواد قانونية ثانوية في شكل مصادر من الكتب والمقالات الصحفية والرسائل واللوائح وغيرها من وسائل الإعلام ذات الصلة بهذا البحث. تتم طريقة جمع المواد القانونية عن طريق المقابلات والتوثيق. يتم تحليل المواد القانونية بطريقة استنتاجية.

تظهر نتائج هذه الدراسة أن (1) لم يتم تنفيذ الإرشاد الزوجي في KUA Ngronggot و Tanjunganom و Prambon مرة أخرى وفقا للأنظمة التي تحكمه بسبب العقبات التي تحيط به ، وهي عدم وجود ميزانية وعدم وجود ميسر معتمد للإرشاد الزوجي. ومع ذلك ، لا تزال KUA Ngronggot تسعى جاهدة لمواصلة تقديم الرسائل والمشورة حول الزواج لكل عروس على الرغم من أن تنفيذها لا يتوافق مع لوائح إرشادات الزواج ، بينما لا تزال KUA Tanjunganom و KUA Prambon تحاولان إيجاد أفضل طريقة لتكون قادرة على الفور على تنظيم برامج التوجيه للزواج (2) أن تنفيذ إرشادات الزواج في KUA الثلاثة لم يكن متوافقا مع نظرية النظام القانوني لورانس م. فريدمان لأن الهيكل القانوني ، أي KUA ، لم ينفذ ولايته في تنفيذ إرشادات الزواج بحيث لا تعمل المكونات الثلاثة لنظرية النظام القانوني معا ولم تكن مستدامة مع بعضها البعض.
