الحقوق العينية للأسير في الفقه الإسلامي والقانون الدولي: القانون المدني المصري

ABSTRAK

Topik mengenai tahanan adalah pokok bahasan yang telah menjadi perhantian bagi pemerintah dan masyarakat. Para tahanan mempunyai hak-hak yang dilimdungi oleh Hukum dan Konvensi Internasional, yang mempunyai kesamaam dengan Hukum Islam. Dalam hukum, hak para tahanan telah diatur dengan baik. Namun studi ini mengungkapkan fakta adanya hak-hak para tahanan yang telah terabaikan, diluar Hak Politis dan Hak Asasi Manusia.

Hak-hak itu tercangkum dalam Hak Pribadi, antara lain Hak Finansial dan Hak Kepemilikan oleh para tahanan.

Penelitian ini ditulis bedasarkan pendekatan analitis dengan rumusan masalah sebagai berikut: 1) Hak Kepemilikan apa yang dimiliki oleh Tahanan Perang berdasarkan Hukum Islam?; 2) Hak Kepemilikan apa yang dimiliki oleh Tahanan Perang berdasarkan Hukum Sipil Mesir?; 3)APakah persamaan dan perbedaan antara Hukum Islam dan Hukum SIpil Mesir yang mengatur tentang Hak Kepemilikan oleh tahanan Perang?.

Berdasarkan hasil yang didapatkan oleh studi komparatif, hasil penelitian yang paling penting adalah bahwa Hukum Islam telah mencakup semua aspek hak para tahanan yang terdapat pada semua sistem dan Hukum Internasional.

Hukum Islam melindungi Hak Kepemilikan para tahanan perang dengan seksama. Hukum Sipil Mesir juga mencakup hak para tahanan yang berkaitan dengan hak kependudukan secara penuh, yang tidak membatasi hak para tahanan atas kepemilikan harta benda.

Saran yang diberikan oleh studi ini adalah menekankan peran Hukum Islam dalah menjaga hak-hak para tahanan, dengan mencari dan mempublikasikan Hak Kepemilikan para tahanan yang akan menjadi dokumen penting bagi para tahanan tersebut.

ABSTRACT

The issue of prisoners is of topics of concern to rulers and officials at all levels and all segments of the general public, hence we shall show the rights of prisoners in the laws and international conventions, and the closeness of these conventions with Islamic jurisprudence, which protected the right of the prisoner in the best picture but when searching, reflection and review of the research presented in this subject, seems that part of the prisoners’ rights has neglected in the study of, a non-political, and not linked to human rights, these rights are private rights, namely: (the financial rights of the prisoner), and financial rights of rights in rem (original and consequential).
1. What are the rights in rem of Prisoner of War Included by Islamic jurisprudence?
2. What the rights in rem are of Prisoner of War included by Egyptian civil law?
3. What the differences and the agreement between which included in Islamic jurisprudence and Egyptian civil law with regard to the rights in rem of Prisoner?

This study was using the analytical approach, historical comparative study concluded the findings and recommendations, among them the most important results that Islamic law was upfront all systems and international laws in taking into account the stated rights of prisoners.

The Islamic approach took into account the captive and keeping his civil rights (rights in rem) is a large part of the prisoner and all actions carried out by in-kind indigenous rights, and subordination.

Also the Egyptian civil law took into account the right of the prisoner and kept in his actions on civil and enjoy the full civil capacity, is not entitled to captivity state that restricting these rights, including rights in rem and accessory.

We recommend highlighting the role of Islamic law in preserving the rights of prisoners, and to continue research and show the special rights of prisoners and be published, and delivery of such research to those responsible for the files of prisoners.

ملخص

موضوع الأسرى من المواضيع التي تهم أولو الأمر والمسئولين على جميع المستويات وعموم الناس بكافة شرائحهم، فلهذا وجب إظهار حقوق الأسرى في الشرائع والاتفاقيات الدولية،

ومدى تقارب هذه الاتفاقيات مع الفقه الإسلامي الذي صان حق الأسير في أحسن صوره.لكن عند البحث والتأمل والمراجعة للأبحاث التي قدمت في هذا الموضوع ، تبين أن جانبا قد أهمل في دراسة حقوق الأسرى ،وهو غير سياسي، وغير مرتبط بحقوقالإنسان،

وهذه الحقوق هي الحقوق الخاصة وهي( الحقوق المالية للأسير)، ومن الحقوق المالية الحقوق العينية ( الأصلية والتبعية ) وموضوعنا كان مقصوراً على هذا الجزء من الحق العيني للأسير .
أسئلة البحث:
1- ﻣﺎهي الحقوق العينية لآﺳﻴﺮاﻟﺤﺮب التى تضمنها الفقه الاسلامي ؟
2- ﻣﺎهي الحقوق العينية لآﺳﻴﺮاﻟﺤﺮب التي تضمنتها القانون المدني المصري ؟
3- ﻣﺎ أوﺟﻪ اﻻﺧﺘﻼف واﻻﺗﻔﺎق ﺑﻴﻦ ﻣﺎ ﺟﺎء ﻓﻲ الفقهالاسلاميوالقانون المدني المصريﻓيما يخص الحقوق العينية لآسرى اﻟﺤﺮب؟

وجاءت هذه الدراسة باستخدام المنهج التأريخي الوثائقي التحليلي المقارن، وخلصت الدراسة إلىنتائج وتوصيات نذكر منها أهم النتائج :
أن الشريعة الإسلامية قد سبقت كل النظم والقوانين الدولية في مراعاة وذكر حقوق الأسرى .
فالشارع الإسلامي راعي الأسير مراعاة عظيمة وحفظ له حقوقه المدنية ( الحقوق العينية ) بشكل كبير، وضمن للأسير كل التصرفات التي يقوم بها في حقوقه العينية الأصلية والتبعية.
كما أن القانون المدني المصري راع وحفظ حق الأسير في تصرفاته المدنية والتمتع بكامل الأهلية المدنية، ولا يحق للدولة الآسرة أن تقيض هذه الحقوق التي من ضمنها الحقوق العينية الأصلية والتبعية.
فنوصي بإبراز دور الشريعة الإسلامية في المحافظة على حقوق الأسرى، والاستمرار بالبحث وإظهار حقوق الأسرى الخاصة ونشرها، وتوصيل هذه البحوث إلى المسئولين عن ملفات الأسرى.
