حقوق الطفل بين الشريعة الإسلامية والمواثيق الدولية: دراسة مقارنة

ABSTRAK

Tujuan penelitian ini adalah pembahasan terhadap undang-undang tentang hak-hak anak dalam Islam dan Konvensi Internasional dengan metode analisis komparatif, yaitu menjelaskan bagaimana Islam terhadap manusia dan anak pada khususnya, hal ini juga bertujuan untuk mengidentifikasi kesamaan dan perbedaan antara masalah Fiqh dan hukum-Hukumnya dalam hak-hak anak.

Pentingnya Penelitian Penelitian atas hak-hak pada umumnya dan hak-hak atas anak-anak pada khususnya ini penting karena anak anak tidak mampu untuk melindungi dirinya sendiri dan untuk mendapatkan haknya di usia muda dan diabaikannya hidup mereka, rendahnya persepsi, tanggung jawab, umum/masyarakat.

Selain itu penelitian ini juga penting untuk meneliti adanya realitas pelanggaran resmi atas hak-hak dan dampaknya pelanggaran hak anak tersebut dimana realitas anak tersebut muncul sebelum era Islam. Telah ditunjukkan kepada kita ( telah kita ketahi ) ketidak adilan menimpa mereka dan perusakan semangat mereka, ini merampas hak mereka untuk memilih ibunya, siapa dan dari mana itu bisa membunuhnya dan menghilangkan nyawa dalam masa kekekalan.

Datanglah hukum Allah yang kekal dan mengangkat /menarik mereka dari kondisi itu. Hukum Allah telah ini mengangkat mereka dari puncak kehidupan dan berisi tentang pendidikan dan orang tua. Semua itu terkait dengan penelusuran undang-undang anak, dan terinspirasi dari ketetapan-ketetapan mengarah pada tujuan pencapaian akhir yaitu memperoleh gambaran tentang realitas hak dan kewajiban anak.

Studi/penelitian ini menemukan beberapa hasil yang dapat diidentifikasikan sebagai berikut :
1. Hukum Islam mengatur semua aspek kehidupan, mengatur seluruh kehidupan termasuk hak — hak dan kewajiban. System kehidupan anggota keluarga dan masyarakat dengan digambarkan secara baik. Selain itu juga mengatur aspek kehidupan pribadi manusia dan pengobanannya untuk orang lain.
2. Arti Islam untuk pria adalah makluk ini menguasai perawatan termasuk terhadap hidupnya mulai menjadi janin dalam Rahim ibunya kemudian menyusu sampai dewasa.
3. Deklarasi dan konvensi international, menetapkan hukum hak —hak anak yang sesuai dengan kebutuhan hak paling dasar bagi anak.
4. Islam menentapkan hak-hak bagi orang pada umumnya dan hak-hak anak pada khususnya. Memang tidak mutlak tetapi diperlukan control disiplin untuk menjamin atau memastikan kelangsungan hidupyang benar kapan pun dan di manapun bagi semua orang dan tidak terjadi penyingpangan.

Peneliti merekomendasikan sejumlah rekomendasi / saran sebagai berikut:
1. Perlu dipublikasikan hak—hak anak dikalangan masyarakat melalui media : Koran, majalah, televise,TV salelit.
2. Negara ngara melalui pemerintah harus berkontribusi untuk meningkatkan tunjangan Finasial / keuangan bagi anak-anak, sehingga seriap orang / anak yang lahir memiliki sejumlah uang setiap bulan dibayar oleh negara di dunia.
3. Harus ada komite/badan memantau hak-hak anak untuk mengambil tindakan yang lebih ketat pada Negara-negara yang melanggar hak-hak anak. Misalnya menerbitkan laporan
tahunan yang mengekspos pelanggaran hak-hak anak ketika hak Yang dilakukan di Negara Amerika dan sebutan hukum kaku yang menyerukan untuk memboikot Negara — Negara
