Pelaksanaan Peraturan Pemerintah nomor 48 Tahun 2014 tentang tarif nikah: Studi di Kantor Urusan Agama Kota Kediri

Tesis dengan judul: Pelaksanaan Peraturan Pemerintah Nomor 48 Tahun 2014 Tentang Tarif Nikah (Studi di Kantor Urusan Agama Kota Kediri). Peraturan ini berisi tentang ketentuan tariff perkawinan di KUA sebesar Rp0,00 (nol rupiah) dan ketika melaksanakan perkawinan di luar KUA atau di luar jam kerja dikenakan tarif sebesar Rp600.000,00. (enam ratus ribu rupiah). Akan tetapi di Kota Kediri dalam pelaksanaannya masih terdapat pungutan lain selain tarif yang sudah ditentukan dalam PP. Nomor 48 Tahun 2014.

Penelitian ini bertujuan untuk menganalisis: (1) Bagaimana pandangan Kepala KUA, penghulu dan calon pengantin atas berlakunya Peraturan Pemerintah Nomor 48 Tahun 2014 tentang tarif nikah di Kantor Urusan Agama Kota Kediri (2) Bagaimana pelaksanaan Peraturan Pemerintah Nomor 48 Tahun 2014 menurut Kepala KUA, penghulu dan calon pengantin di Kantor Urusan Agama Kota Kediri.

Penelitian ini menggunakan deskriptif kualitatif dengan metode pengumpulan data berupa wawancara yang mendalam, observasi dan dokumentasi. Kemudian dianalisis menggunakan teori hubungan hukum dengan pendekatan budaya.

Hasil dari penelitian ini adalah : (1).Pandangan Kepala KUA, penghulu dan calon pengantin atas berlakunya PP. Nomor 48 Tahun 2014 adalah menyambut baik. Keresahan yang dirasakan selama ini menjadi reda. Selama ini Kepala KUA serta penghulu takut dianggap menerima gratifikasi dengan menerima pemberian dari calon pengantin. Di sisi lain Kepala KUA serta penghulu kurang puas dengan aturan sebelumnya yaitu PP Nomor 47 Tahun 2004 karena dianggap belum mencukupi. Sedangkan pandangan calon pengantin merasa senang karena biaya perkawinan menjadi jelas sehingga masyarakat bebas memilih. (2).Pelaksanaan PP. Nomor 48 Tahun 2014 menurut Kepala KUA, penghulu dan calon pengantin telah terjadi perbedaan. Dari pihak KUA menyatakan biaya perkawinan sudah sesuai dengan PP. Nomor 48 Tahun 2014 tanpa ada tambahan tarif apapun. Sedangkan menurut calon pengantin masih diharuskan membayar tarif tambahan. Tarif tambahan ini bukan untuk pihak KUA, tetapi untuk pembantu pegawai pencatat nikah (P3N). Tarif tersebut oleh P3N digunakan sebagai biaya administrasi dan akomodasi. Masyarakat Kota Kediri tidak mempersalahkan adanya tarif tambahan dalam kepengurusan persyaratan perkawinan, karena dianggap sebagai bentuk balas jasa. Masyarakat menganggap tarif tambahan tersebut sebagai bentuk shodaqoh.

This thesis entitled The Implementation of Government Regulation Number 48 of 2014 Concerning Wedding Expense ( A Study Case in the Office of Religious Affairs in Kediri) . This regulation concerns about zero wedding expense, but if the wedding is held outside the Office of Religious Affairs or outside the working hours, the expense will be Rp 600.000,00 (six-hundred thousand rupiahs). However, the study found that in the real implementation in Kediri, there are still some additional expenses that should be paid despite the government regulation number 48 of 2014.

First of all, this study aims to analyze how the point of view of the head of Office of Religious Affairs, headman, and the couple is toward government regulation number 48 of 2014 in Office of Religious Affairs in Kediri. Furthermore, this study aims to analyze how the implementation of government regulation number 48 of 2014 is according to the head of Office of Religious Affairs, headman, and the couple in Office of Religious Affairs in Kediri.

The method used in this study was descriptive qualitative. Data were collected through in- depth interview, observation, and documentation. Later, the data was analyzed using theory of relation between law and cultural approach.

The study found that the head of Office of Religious Affairs, headman, and the couple really welcome the implementation of government regulation number 48 of 2014. The anxiety felt was disappeared. Before the regulation was implemented, the head of Office of Religious Affairs and the headman were anxious to be seen as receiving gratification by the couple. On the other hand, they are not satisfied with the last government regulation number 47 of 2004 because they think it is not sufficient. Meanwhile, the couple feels content because of this clear regulation of wedding expense so that people may choose freely. The result also showed that there is different point of view among the head of Office of Religious Affairs, the headman, and also the couple concerning the implementation of government regulation number 48 of 2014. The Office of Religious Affairs stated that there is no additional charge for the wedding. However, the bride and groom stated that there is additional charge that they need to pay. This additional charge is not for Office of Religious Affairs. But, it is for the assistant of wedding registry. It is used for administration and accommodation expense. People in Kediri do not mind to pay additional charge because they consider it as retribution or some people consider it as shodaqoh.
