Pertimbangan hakim Pengadilan Agama Mojokerto tentang pengalihan hak asuh anak dari ayah ke ibu dalam putusan nomor 1050/Pdt.G/2020/PA.Mr.

ABSTRAK

Anak merupakan bagian dari kehidupan yang tidak dapat dipisahkan. Termasuk dalam kehidupan berbangsa dan bernegara. Setiap anak harus mendapatkan kesempatan untuk tumbuh dan berkembang secara optimal dan holistik. Mulai dari aspek fisik, motorik, gizi, sosial, emosi dan mental. Pada kasus yang terjadi di Mojokerto, peneliti menemukan pihak orang tua yang memperebutkan perihal hak asuh terhadap anak mereka. Maka dari itu pada penelitian ini mempunyai tujuan untuk menelaah tentang pertimbangan Hakim dalam memutuskan perkara tersebut dengan rumusan masalah 1. Bagaimana Putusan Hakim Pengadilan Agama Mojokerto dalam pengalihan hak asuh anak dari ayah ke ibu pada perkara nomor 1050/Pdt.G/2020/PA.Mr? 2. Bagaimana Implikasi Putusan Hakim Pengadilan Agama Mojokerto dalam pengalihan hak asuh anak pada perkara nomor 1050/Pdt.G/2020/PA.Mr. terhadap anak dan orangtua?.
Penelitian ini menggunakan jenis penelitian hukum empiris, dan memakai pendekatan diskriptif kualitatif. Penelitian ini memperoleh data dengan wawancara dan dokumentasi terhadap informan yang berkaitan dengan tema yang diteliti. Jenis dan sumber data yang dipakai adalah menggunakan sumber data primer dan sekunder. Sedangkan dalam proses pengolahan data memakai teknik pemeriksaan data, klasifikasi, verifikasi, analisis, dan kesimpulan.
Hasil dari penelitian ini adalah Putusan Hakim pengadilan Agama Mojokerto menolak pengalihan hak asuh anak dari Ayah ke Ibunya, karena Ibu tidak bisa menjamin akan hak – hak anaknya. Seperti kesehatan, pendidikan, kesejahteraan, perlindungan terhadap hukum, dan akidah anak. Sedangkan Implikasi putusan hakim tersebut dapat berpengaruh kepada anak terutama kondisi emosional dan psikologis dikarenakan adanya perubahan lingkungan yang berbeda dan dapat berpengaruh bagi kondisi emosional orang tua karena terpisah dari sang anak.

Children are an inseparable part of life. Including in the life of the nation and state. Every child must get the opportunity to grow and develop optimally and holistically. Starting from physical, motoric, nutritional, social, emotional and mental aspects. In the case that occurred in Mojokerto, researchers found parents fighting over custody of their children. Therefore, this study aims to examine the Judge's considerations in deciding the case with the formulation of the problem 1. How is the Decision of the Judge of the Mojokerto Religious Court in the transfer of child custody from father to mother in case number 1050 / Pdt.G / 2020 / PA.Mr? 2. What are the Implications of the Decision of the Judge of the Mojokerto Religious Court in the transfer of child custody in case number 1050 / Pdt.G / 2020 / PA.Mr. for children and parents?
This study uses empirical legal research type, and uses qualitative descriptive approach. This study obtains data through interviews and documentation of informants related to the theme being studied. The types and sources of data used are primary and secondary data sources. While in the data processing process using data examination techniques, classification, verification, analysis, and conclusions.
The result of this research is that the Mojokerto Religious Court's ruling rejected the transfer of child custody from the father to the mother because the mother could not guarantee her children's rights. Such as health, education, welfare, legal protection, and the child's faith. Meanwhile, the implications of the judge's decision may impact the child, especially emotionally and psychologically, due to changes in their environment and may also affect the emotional condition of the parents due to being separated from their child.
