Implementasi Perda pengendalian dan pengawasan minuman Beralkohol terkait jarak penjualan minuman Beralkohol di Kota Malang perspektif Maqashid Syariah: Studi di Disnaker PMPTSP Kota Malang

ABSTRAK

Dalam penelitian ini membahas bagaimana implementasi Peraturan Daerah terkait kebijakan penetapan jarak penjualan minuman beralkohol dengan kadar alkohol tinggi dari tempat peribadatan, lembaga pendidikan dan rumah sakit di Kota Malang. Di Kota Malang sendiri terdapat beberapa tempat penjualan minuman beralkohol yang berdiri berdekatan dengan ketiga tempat tersebut. Hal tersebut mengindikasikan bahwa terjadi kesenjangan antara peraturan dengan fakta dilapangan. Penelitian ini bertujuan guna mengetahui bagaimana implementasi Perda terkait penerapan jarak antara menurut Dinas Tenaga Kerja, Penanaman Modal dan Pelayanan Terpadu Satu Pintu dan Peraturan Daerah Kota Malang. Selain itu, penelitian ini juga meninjau mengenai kebijakan penerapan jarak penjualan minuman beralkohol perspektif maqashid syariah.

Penelitian ini merupakan jenis penelitian yuridis empiris dengan menggunakan pendekatan yuridis sosiologis, sedangkan sumber data yang digunakan dalam penelitian ini adalah sumber data primer dan sekunder. Metode pengumpulan data yaitu wawancara, observasi langsung dan dokumentasi.

Hasil penelitian ini adalah peraturan terkait penerapan jarak penjualan minuman beralkohol dinilai tidak bisa diimplementasikan dengan baik karena berbagai faktor, seperti faktor wilayah yang kurang ideal, berdirinya tempat penjualan minuman beralkohol sebelum peraturan tersebut berlaku, pelaku usaha yang kurang memahami peraturan dan kurangnya komitmen dari aktor implementasi kebijakan. Sehingga peraturan terkait penerapan jarak penjualan minuman beralkohol belum berhasil dilaksanakan. Terjadi inkonsistensi terkait Perda ini tepatnya pada Pasal 8 Ayat (2) mengenai syarat dengan UU Nomor 12 Tahun 2011 Tentang Pembentukan Perundang-Undangan. Kebijakan terkait penerapan jarak penjualan minuman beralkohol dalam perspektif maqashid syariah tetap tidak diperbolehkan karena minuman beralkohol sendiri dengan tegas diharamkan dalam hukum islam.

ABSTRACT

This study discusses how the implementation of the Regional Regulation related to the policy of determining the distance of selling alcoholic beverages with high alcohol content from places of worship, educational institutions and hospitals in Malang City. In Malang City itself, there are several alcoholic beverage sales places that stand close to these three places. This indicates that there is a gap between regulations and facts in the field. This research aims to find out how the implementation of the Regional Regulation related to the application of distance between according to the Department of Manpower, Investment and One Stop Integrated Services and the Malang City Regional Regulation. In addition, this study also reviews the policy of implementing the distance of alcoholic beverage sales from the maqashid sharia perspective.

This research is a type of empirical juridical research using a sociological juridical approach, while the data sources used in this research are primary and secondary data sources. Data collection methods are interviews, direct observation and documentation.

The result of this study is that the regulations related to the implementation of alcoholic beverage sales distances are considered to be poorly implemented due to various factors, such as less than ideal area factors, the establishment of alcoholic beverage sales places before the regulation took effect, business actors who do not understand the regulations and the lack of commitment from policy implementation actors. Therefore, the regulation on alcohol sales distance has not been successfully implemented. There are inconsistencies related to this local regulation, precisely in Article 8 Paragraph (2) regarding the requirements with Law Number 12/2011 concerning the Formation of Legislation. Policies related to the application of alcoholic beverage sales distances in the maqashid sharia perspective are still not allowed because alcoholic beverages themselves are strictly prohibited in Islamic law.

يناقش هذا البحث تنفيذ اللائحة الإقليمية بشأن إبعاد المشروبات الكحولية التي تحتوي على نسبة عالية من الكحول عن أماكن العبادة والمؤسسات التعليمية والمستشفيات في مدينة مالانج. في مدينة مالانج نفسها، هناك العديد من أكشاك المشروبات الكحولية الموجودة بالقرب من هذه الأماكن الثلاثة. وهذا يشير إلى وجود فجوة بين اللوائح التنظيمية والحقائق على أرض الواقع. يهدف هذا البحث إلى معرفة كيفية تطبيق اللوائح الإقليمية المتعلقة بتطبيق المسافة بين وفقًا لإدارة القوى العاملة والاستثمار والخدمات المتكاملة ذات المحطة الواحدة واللائحة الإقليمية لمدينة مالانج. بالإضافة إلى ذلك، تبحث هذه الدراسة أيضًا في تنفيذ سياسة المسافة من منظور الشريعة المقاصدية.

نتيجة هذه الدراسة هي أن اللوائح الخاصة بمسافة بيع المشروبات الكحولية لم يتم تنفيذها بشكل جيد بسبب عوامل مختلفة، مثل المنطقة الأقل من المثالية، وإنشاء مبيعات المشروبات الكحولية قبل دخول اللوائح حيز التنفيذ، والجهات الفاعلة في مجال الأعمال التجارية التي لا تفهم اللوائح وعدم التزام الجهات الفاعلة في تنفيذ السياسات. ونتيجة لذلك، لم يتم تنفيذ اللائحة الخاصة ببيع المشروبات الكحولية بشكل ناجح. هناك تناقضات تتعلق بهذه اللائحة، وبالتحديد في الفقرة (2) من المادة 8 المتعلقة بالمتطلبات مع القانون رقم 12 لسنة 2011 بشأن تشكيل التشريعات. لا تزال السياسات المتعلقة بتنفيذ مسافات بيع المشروبات الكحولية في المنظور الشرعي المقاصدي غير مسموح بها لأن المشروبات الكحولية نفسها محرمة في الشريعة الإسلامية.
