Pengembangan kawasan strategis berbasis desa cerdas menurut peraturan daerah Kabupaten Sumenep no. 12 tahun 2013 perspektif Siyasah Dusturiyah: Studi di Kecamatan Ra’as Kabupaten Sumenep

ABSTRAK

Peraturan Daerah Kabupaten Sumenep No. 12 tahun 2013 yang mengatur mengenai Rencana Tata Ruang & Wilayah Kabupaten Sumenep mengisyaratkan bahwa pembangunan sebuah daerah menjadi syarat penting untuk mencapai kesejahteraan yang merata di Kabupaten Sumenep.Kabuapten Sumenep merupakan Kabupaten yang dipenuhi oleh pulau-pulau kecil yang menjadi bagian dari Kecamatan itu sendiri, hal ini menjadi tantangan tersendiri bagi Kabupaten Sumenep untuk memeratakan kesejahteraan masyarakatnya.
Tujuan Penelitian adalah untuk mengetahui sejauh mana Kecamatan Ra’as bisa dikembangkan dengan konsep Desa Cerdas (Smart VIllage) dengan penyesuaian Perda Kabupaten Sumenep No. 12 Tahun 2013 dan Peraturan Menteri Desa, Pembangunan Daerah Tertinggal, dan Transmigrasi Republik Indonesia Nomor 21 Tahun 2020 Tentang Pedoman Umum Pembangunan Desa.
Jenis penelitian pada skripsi ini adalah yuridis empiris dengan pendekatan yuridis sosiologis. Dengan proses pengambilan data melalui observasi, wawancara dan dokumentasi serta data sekunder berupa perundang-undangan, buku ilmiah, Skripsi, Tesis, Laporan Penelitian serta Jurnal yang sudah diuji kebenarannya.
Hasil penelitian menyebutkan bahwa banyaknya kendala-kendala dan tantangan Kecamatan Ra’as dalam mewujudkan Desa Cerdas terutama karena faktor posisi kecamatan yang berada di daerah kepulauan terpencil yang jauh dari pusat pemerintah pemerintahan kabupaten, dan medan transportasi, ketersediaan SDM berkualitas dan Minimnya pemberdayaan teknologi menjadi alasan penting untuk memastikan hukum guna keberlangsungan pembangunan berkelanjutan, tetapi Pemerintah Kecamatan Ra’as tetap memiliki pandangan, rencana ataupun strategi untuk menjadikan Kecamatan Ra’as lebih terkonsep sebagai Desa Cerdas. Strategi yang digunakan dengan pemberdayaan kecamatan dengan meningkatkan taraf ekonomi, sosial budaya dan daya lingkungan hidup yang lebih berkualitas dengan mengandalkan kearifan lokal sebagai kekuatan pengembangan daerah dengan tetap memerhatikan nilai-nilai dari Siyasah Dusturiyah.

ABSTRACT

The existence of Sumenep District Regulation No. 12 of 2013 which regulates the Spatial & Regional Plan of the Sumenep District implies that the development of a region is an important requirement to achieve equitable welfare in the Sumenep District.Sumenep District is a district filled with small islands that are part of the District itself, this is a challenge for the Sumenep District to equalize the welfare of its people
The research objective is to find out the extent to which Ra'as sub-district can be developed with the Smart Village concept by adjusting the Sumenep District Regulation No. 12 of 2013 and the Regulation of the Minister of Villages, Development of Disadvantaged Regions and Transmigration of the Republic of Indonesia Number 21 of 2020 concerning General Guidelines for Village Development.
The type of research in this thesis is empirical juridical with a sociological juridical approach. With the data collection process through observation, interviews and documentation as well as secondary data in the form of scientific books, theses, legistation research reports and journals which has been tested for truth.
The results of the study state that the many obstacles and challenges of Ra'as Sub-district in realizing Smart Villages are mainly due to the factor of the position of the sub-district which is in a remote island area far from the center of the district government government, and the transportation terrain, the availability of quality human resources and the lack of technological empowerment are the reasons, but the Ra'as Sub-district Government still has views, plans or strategies to make Ra'as Sub-district more conceptualized as a Smart Village. The strategy used by empowering sub-districts by increasing the level of economic, socio-cultural and environmental power that is more qualified by relying on local wisdom as a regional development force while still paying attention to the points of Siyasah Dusturiyah.

إن وجود لائحة منطقة سومنيب رقم ١٢ لعام ٣٠١٣ التي تنظم المخطط المكاني والإقليمي لمنطقة سومنيب يعني أن تنمية المنطقة مطلب مهم لتحقيق الرفاهية العادلة في منطقة سومنيب، حيث أن منطقة سومنيب هي منطقة مليئة بالجزر الصغيرة التي هي جزء من المنطقة نفسها، وهذا تحدٍ لمنطقة سومنيب لتحقيق المساواة في رفاهية سكانها.
هدف البحث هو معرفة إلى أي مدى يمكن تطوير منطقة رأس الفرعية بمفهوم القرية الذكية من خلال تعديل لائحة منطقة سومينيب رقم 12 لعام 2013 ولائحة وزير القرى وتنمية المناطق المحرومة والهجرة في جمهورية إندونيسيا رقم 21 لعام 2020 بشأن المبادئ التوجيهية العامة لتنمية القرى وتمكين المجتمع القروي.
إن نوع البحث في هذه الأطروحة هو بحث فقهي تجريبي بمنهج فقهي اجتماعي. مع عملية جمع البيانات من خلال الملاحظة والمقابلات والتوثيق وكذلك البيانات الثانوية في شكل كتب علمية وأطروحات وتقارير بحثية ومجلات.
تشير نتائج الدراسة إلى أن العقبات والتحديات العديدة التي تواجهها ناحية رأس الفرعية في تحقيق القرى الذكية ترجع بشكل أساسي إلى عامل موقع الناحية التي تقع في منطقة جزرية نائية بعيدة عن مركز حكومة الناحية، وتضاريس المواصلات وتوافر الموارد البشرية النوعية وعدم التمكين التكنولوجي هي الأسباب، ولكن لا تزال حكومة ناحية رأس الفرعية لديها وجهات نظر وخطط أو استراتيجيات لجعل ناحية رأس الفرعية أكثر تصوراً كقرية ذكية.
