Pemberian Air Susu Ibu terhadap anak perspektif Wahbah Az-Zuhaili dan Undang-Undang No. 4 tahun 2024 tentang kesejahteraan Ibu dan Anak

ABSTRAK

Pemberian Air Susu Ibu (ASI) merupakan amanah dan tanggung jawab besar yang diberikan Allah SWT kepada para ibu sebagai bentuk pemenuhan hak dasar anak. Dalam Islam, kewajiban menyusui tercantum dalam Al-Qur’an, seperti dalamSurat Al-Baqarah ayat 233, serta diperkuat oleh pendapat ulama fiqh seperti Wahbah Az-Zuhaili yang menegaskan bahwa menyusui adalah kewajiban dalam kondisi tertentu. Penelitian ini bertujuan untuk mengkaji pemberian ASI dari dua perspektif hukum, yaitu hukum nasional melalui hukum Islam menurut pandangan Wahbah Az-Zuhaili dan Undang-Undang No. 4 Tahun 2024 tentang Kesejahteraan Ibu dan Anak.

Penelitian ini menggunakan metode yuridis normatif dengan pendekatan deskriptif kualitatif, dan data diperoleh melalui studi pustaka, berupa bahan hukum primer dan sekunder. Bahan hukum primer berupa Fiqh Wahbah Az-Zuhaili dan Undang-Undang No. 4 Tahun 2024 tentang Kesejahteraan Ibu dan Anak. Sedangkan bahan hukum sekunder berupa buku air susu ibu, buku dukungan ibu menyusui, dan juga Tafsir Al-Munir. Air Susu Ibu (ASI) memiliki manfaat penting bagi bayi, ibu, dan keluarga, serta peran sentral dalam menunjang tumbuh kembang anak secara fisik, mental, dan emosional.

Hasil analisis menunjukkan bahwa Wahbah Az-Zuhaili berpendapat mengenai pentingnya pemberian ASI selama dua tahun, peran sentral ibu dalam proses menyusui, hak anak untuk memperoleh ASI, serta menekankan aspek moral dan syar’i. Undang-Undang No. 4 Tahun 2024 Tentang Kesejahteraan Ibu dan Anak membahas bahwa pemberian ASI sangat penting dilakukan selama dua tahun, juga membahas peran sentral ibu dalam proses menyusui, hak anak untuk memperoleh ASI, tidak ada status wajib dan hanya anjuran dalam pemberian ASI. Regulasi di Indonesia juga menekankan perlindungan hukum, kesejahteraan ibu-anak, dan dukungan sistemik melalui peran negara dan masyarakat.

ABSTRACT

Breastfeeding is a trust and a great responsibility given by Allah SWT to mothers as a fulfillment of the basic rights of children. In Islam, the obligation to breastfeed is stated in the Qur'an, such as in Surah Al-Baqarah verse 233, and is reinforced by the opinions of fiqh scholars such as Wahbah Az-Zuhaili, who asserts that breastfeeding is mandatory under certain conditions. This study aims to examine breastfeeding from two legal perspectives: Islamic law according to the views of Wahbah Az-Zuhaili and national law through Law No. 4 of 2024 on the Welfare of Mothers and Children.

This study employs a normative juridical method with a descriptive qualitative approach, and the data is obtained through a literature review consisting of primary and secondary legal materials. The primary legal materials include Fiqh by Wahbah Az-Zuhaili and Law No. 4 of 2024 concerning Maternal and Child Welfare. The secondary legal materials consist of books on breast milk, breastfeeding support, and Tafsir Al-Munir. Breast milk (ASI) has significant benefits for infants, mothers, and families, and plays a central role in supporting the physical, mental, and emotional development of children.

The analysis results show that Wahbah Az-Zuhaili emphasized the importance of breastfeeding for two years, the central role of the mother in the breastfeeding process, the child’s right to receive breast milk, and highlighted the moral and sharia aspects. Law No. 4 of 2024 concerning the Welfare of Mothers and Children discusses the importance of providing breast milk for two years, the central role of the mother in breastfeeding, and the child’s right to receive breast milk. However, it does not mandate breastfeeding, presenting it instead as a recommendation. Regulations in Indonesia also emphasize legal protection, the welfare of mothers and children, and systemic support through the roles of the state and society.

يُعدّ إرضاع الطفل من حليب الأم أمانة ومسؤولية عظيمة منحها الله سبحانه وتعالى للأمهات، باعتباره حقاً أساسياً من حقوق الطفل. وقد وردت فريضة الرضاعة في القرآن الكريم، كما في سورة البقرة الآية ٢٣٣، وأكد عليها فقهاء الشريعة مثل وهبة الزحيلي الذي يرى أن الرضاعة واجبة في ظروف معينة. تهدف هذه الدراسة إلى بحث مسألة الرضاعة من منظورين قانونيين: القانون الوطني من خلال القانون رقم ٤ لسنة ٢٠٢٤ بشأن رفاه الأم والطفل، والفقه الإسلامي من خلال رأي وهبة الزحيلي.

تستخدم هذه الدراسة المنهج القانوني النظري مع المقاربة الوصفية النوعية، وقد تم الحصول على البيانات من خلال دراسة مكتبية، تتكون من مواد قانونية أساسية وثانوية. تشمل المواد القانونية الأساسية كتاب الفقه لوهبةالزحيلي وقانون رقم ٤ لسنة ٢٠٢٤ بشأن رفاهية الأم والطفل. أما المواد القانونية الثانوية فتشمل كتبًا عن حليب الأم، ودعم الأمهات المرضعات، وتفسير المنير. يعدّ حليب الأم (الرضاعة الطبيعية) ذا فوائد كبيرة للرضيع، والأم، والأسرة، كما يلعب دورًا محوري في دعم النمو الجسدي والعقلي والعاطفي للطفل.

تُظهر نتائج التحليل أن وهبة الزحيلي يرى أهمية الرضاعة الطبيعية لمدة عامين، والدور المركزي للأم في عملية الإرضاع، وحق الطفل في الحصول على حليب الأم، كما يؤكد على الجوانب الأخلاقية والشرعية. أما القانون رقم ٤ لسنة ٢٠٢٤ بشأن رفاهية الأم والطفل، فيتناول أهميةالرضاعة الطبيعية لمدة عامين، والدور المركزي للأم في هذه العملية، وحق الطفل في الحصول على حليب الأم، لكنه لا يجعل الرضاعة إلزامية، بل يوصي بها فقط. كما تؤكد اللوائح في إندونيسيا على الحماية القانونية، ورفاهية الأم والطفل، والدعم المنهجي من خلال دور الدولة والمجتمع.
