Efektivitas Badan Penasihatan, Pembinaan, dan Pelestarian Perkawinan (BP4) Kota Malang dalam penyelesaian konflik keluarga perspektif teori sistem hukum Lawrance M Friedman

Badan Penasihatan, Pembinaan, dan Pelestarian Perkawinan (BP4) merupakan lembaga mitra Kementerian Agama (Kemenag) yang memiliki fungsi unruk memberikan nasihat, bimbingan, dan edukasi terkait pernikahan, talak, cerai, serta rujuk. Namun, efektivitas lembaga ini perlu ditinjau lebih lanjut. Oleh karena itu, penelitian bertujuan untuk mengetahui efektivitas progam, fungsi, dan keberadaan BP4 dalam membantu menyelesaikan konflik keluarga di lingkungan Kemenag Kota Malang, serta analisisnya dari perspektif teori sistem hukum Lawrance M Friedman.

Penelitian ini termasuk dalam jenis penelitian yuridis empiris. Lokasi penelitian berada di BP4 Kota Malang. Sumber data primer diperoleh dari informan dan data sekunder dari buku The Legal System A Social Science Perspective karya Lawrance M Friedman. Teknik pengumpulan data melalui wawancara dan studi dokumen. Pengolahan dan analisis data dilakukan dalam empat tahapan yaitu pengolahan data, klasifikasi data, analsis data, kesimpulan. Penelitian ini juga melalui tahap keabsahan data.

Hasil penelitian ini menunjukkan bahwa (1) BP4 Kota Malang masih belum efektif dalam menekan angka perceraian. Hal ini dapat dilihat dari jumlah klien yang ditangani di tahun 2023 sebanyak 140 orang, sementara angka perceraian di Kota Malang di tahun 2023 sebanyak 2.317 kasus. Ketidakefektifan ini berawal dari minimnya pengetahuan masyarakat tentang keberadaan dan peran BP4. Secara struktural, BP4 masih melebur dengan Bimas Islam Kemenag Kota Malang, yang berpotensi menghambat independensi dan optimalisasi kinerjanya. Dari segi program kerja, BP4 lebih bersifat pasif dengan menunggu pasangan bermasalah datang untuk mendapatkan layanan. (2) Berdasarkan tiga komponen sistem hukum Lawrence M. Friedman, BP4 Kota Malang masih belum sepenuhnya efektif dalam menjalankan fungsinya. Dari aspek struktur kelembagaan, BP4 masih bergantung pada Bimas Islam Kementerian Agama Kota Malang, yang membatasi fleksibilitas dan pengambilan keputusan strategisnya. Dari aspek substansi hukum, kendala utama terletak pada tidak adanya landasan hukum berupa peraturan perundang-undangan yang mengatur tugas pokok dan fungsi BP4. Pedoman pelaksanaan tugas pokok dan fungsi BP4 hanya bersumber dari AD/ART. Dari segi budaya hukum, kurangnya sosialisasi menyebabkan rendahnya kesadaran masyarakat terhadap keberadaan BP4, sehingga layanan yang disediakan belum dimanfaatkan secara optimal.

The Marriage Advisory, Development and Preservation Agency (BP4) is a partner institution of the Ministry of Religious Affairs (Kemenag) whose function is to provide advice, guidance and education related to marriage, divorce and reconciliation. However, the effectiveness of this institution needs to be further reviewed. Therefore, the research aims to determine the effectiveness of BP4's programs, functions, and existence in helping to resolve family conflicts within the Ministry of Religious Affairs of Malang City, as well as its analysis from the perspective of Lawrance M Friedman's legal system theory.

This research is included in the type of empirical juridical research. The research location is at BP4 Malang City. Primary data sources were obtained from informants and secondary data from the book The Legal System A Social Science Perspective by Lawrance M Friedman. Data collection techniques through interviews and document studies. Data processing and analysis are carried out in four stages, namely data processing, data classification, data analysis, conclusions. This research also goes through the data validity stage.

The results of this study indicate that (1) BP4 Malang City is still not effective in reducing the divorce rate. This can be seen from the number of clients handled in 2023 of 140 people, while the divorce rate in Malang City in 2023 was 2,317 cases. This ineffectiveness stems from the lack of public knowledge about the existence and role of BP4. Structurally, BP4 is still merged with Bimas Islam of the Ministry of Religious Affairs of Malang City, which has the potential to hamper the independence and optimization of its performance. In terms of work programs, BP4 is more passive by waiting for problematic couples to come to get services. (2) Based on the three components of Lawrence M. Friedman's legal system, BP4 Malang City is still not fully effective in carrying out its functions. From the aspect of institutional structure, BP4 is still dependent on the Islamic Guidance of the Ministry of Religious Affairs of Malang City, which limits its flexibility and strategic decision-making. From the legal substance aspect, the main obstacle lies in the absence of a legal basis in the form of laws and regulations governing the main tasks and functions of BP4. Guidelines for the implementation of the main duties and functions of BP4 only come from the bylaws. In terms of legal culture, the lack of socialization has led to low public awareness of the existence of BP4, so that the services provided have not been optimally utilized.

الوكالة الاستشارية للزواج والتنمية والمحافظة على الزواج (BP4) هي مؤسسة شريكة لوزارة الشؤون الدينية وتتمثل مهمتها في تقديم المشورة والتوجيه والتثقيف فيما يتعلق بالزواج والطلاق والمصالحة. ومع ذلك، تحتاج فعالية هذه المؤسسة إلى مزيد من المراجعة. ولذلك، يهدف البحث إلى تحديد مدى فعالية برامج ووظائف ووجود مؤسسة BP4 في المساعدة في حل النزاعات الأسرية داخل وزارة الشؤون الدينية في مدينة مالانج، وكذلك تحليلها من منظور نظرية النظام القانوني لورانس م. فريدمان.
