Implementasi konversi sepeda motor listrik berdasarkan Peraturan Menteri Perhubungan Nomor 39 tahun 2023: Studi di bengkel konversi Malang

ABSTRAK

Penelitian ini bertujuan untuk menganalisis implementasi Peraturan Menteri Perhubungan Nomor 39 Tahun 2023 tentang konversi sepeda motor berbahan bakar minyak menjadi sepeda motor listrik berbasis baterai di bengkel konversi Malang Raya. Fokus penelitian ini adalah mengkaji penerapan regulasi serta kendala yang dihadapi bengkel dalam memperoleh sertifikasi resmi. Regulasi ini bertujuan untuk memastikan standar keselamatan dan kualitas kendaraan menghasilkan konversi, namun implementasinya di lapangan masih menghadapi berbagai tantangan.

Penelitian ini menggunakan metode yuridis empiris dengan pendekatan studi kasus. Data dikumpulkan melalui wawancara dengan pemilik dan teknisi bengkel konversi di Malang Raya. Analisis dilakukan untuk memahami proses sertifikasi, tingkat kepatuhan terhadap regulasi, serta hambatan yang dihadapi oleh pelaku usaha dalam memenuhi persyaratan yang ditetapkan pemerintah.

Hasil penelitian menunjukkan bahwa implementasi Peraturan Menteri Perhubungan Nomor 39 Tahun 2023 di empat bengkel konversi di Malang Raya masih menghadapi berbagai tantangan. Salah satu bengkel telah tersertifikasi dan menerapkan regulasi sesuai standar, sementara tiga bengkel lainnya masih dalam proses penyesuaian untuk memenuhi persyaratan sertifikasi. Kendala utama dalam implementasi regulasi ini meliputi tingginya biaya sertifikasi, keterbatasan fasilitas, kurangnya pemahaman teknis, serta prosedur birokrasi yang kompleks. Oleh karena itu, diperlukan kebijakan yang lebih mendukung seperti, insentif finansial dan penyederhanaan prosedur sertifikasi guna mempercepat legalitas bengkel dan mendorong pertumbuhan industri konversi sepeda motor listrik di Indonesia.

ABSTRACT

This study aims to analyze the implementation of the Regulation of the Minister of Transportation Number 39 of 2023 concerning the conversion of oil-fueled motorcycles into battery-based electric motorcycles at the Malang Raya conversion workshop. The focus of this research is to examine the implementation of regulations and obstacles faced by workshops in obtaining official certification. This regulation aims to ensure the safety and quality standards of vehicles resulting in conversions, but its implementation in the field still faces various challenges.

This study uses an empirical juridical method with a case study approach. The data was collected through interviews with the owners and technicians of conversion workshops in Malang Raya. The analysis was carried out to understand the certification process, the level of compliance with regulations, and the obstacles faced by business actors in meeting the requirements set by the government.

The results of the study show that the implementation of the Minister of Transportation Regulation Number 39 of 2023 in four conversion workshops in Malang Raya still faces various challenges. One of the workshops has been certified and implemented regulations according to standards, while the other three workshops are still in the process of adjusting to meet the certification requirements. The main obstacles in the implementation of this regulation include high certification costs, limited facilities, lack of technical understanding, and complex bureaucratic procedures. Therefore, more supportive policies, such as financial incentives and simplification of certification procedures, are needed to accelerate the legality of workshops and encourage the growth of the electric motorcycle conversion industry in Indonesia.

تظهر نتائج الدراسة أن تنفيذ لائحة وزير النقل رقم ٣٩ لعام ٢٠٢٣ في أربع ورش تحويل في مالانج رايا لا يزال يواجه تحديات مختلفة. تم اعتماد إحدى ورش العمل وتنفيذها وفقا للمعايير ، بينما لا تزال ورش العمل الثلاث الأخرى في طور التعديل لتلبية متطلبات الشهادة. تشمل العقبات الرئيسية في تنفيذ هذه اللائحة ارتفاع تكاليف إصدار الشهادات، ومحدودية المرافق، ونقص الفهم التقني، والإجراءات البيروقراطية المعقدة. لذلك ، هناك حاجة إلى سياسات أكثر دعما ، مثل الحوافز المالية وتبسيط إجراءات إصدار الشهادات ، لتسريع شرعية ورش العمل وتشجيع نمو صناعة تحويل الدراجات النارية الكهربائية في إندونيسيا.
