Dampak tradisi belis dalam perkawinan adat perspektif 'urf dan teori utilitarian: Studi perkawinan adat di Kota Kupang

Penelitian ini membahas dampak tradisi belis dalam perkawinan adat di Kota Kupang, Nusa Tenggara Timur, dengan menggunakan perspektif ‘urf dan teori utilitarian. Tradisi belis, yang merupakan pemberian mahar dari pihak laki-laki kepada pihak perempuan, memiliki makna yang dalam sebagai simbol penghormatan dan keseriusan dalam hubungan pernikahan. Penelitian ini bertujuan untuk mengetahui bagaimana pelaksanaan tradisi belis dalam perspekti ‘urf dan menganalisis dampak positif dan negatif dari tradisi belis terhadap keberlangsungan perkawinan di masa mendatang. Penelitian ini merupakan jenis penelitian hukum empiris dan metode penelitian yang digunakan adalah pendekatan kualitatif dengan pengumpulan data melalui wawancara, observasi, dan dokumentasi. Hasil penelitian dalam perspektif ‘urf menunjukan bahwa belis dianggap sebagai budaya yang mencerminkan nilai-nilai luhur dan norma sosial yang telah ada sejak lama. Pelaksanaan tradisi belis di Kota Kupang masih kuat dipertahankan oleh masyarakat, meskipun terdapat tantangan terhadap perubahan sosial. Belis tidak hanya berfungsi sebagai syarat dalam perkawinan, tetapi juga sebagai simbol penghormatan terhadap perempuan dan keluarganya, serta pengikat hubungan antara dua keluarga. Namun tingginya nilai belis dapat menjadi beban ekonomi bagi pihak laki-laki, yang berpotensi menghambat pernikahan dan menyebabkan masalah sosial seperti kehamilan di luar nikah. Sedangkan dampak positifnya mencakup penghargaan terhadap perempuan, penguatan ikatan sosial. Belis berfungsi sebagai jaminan keamanan dan kesejahteraan bagi perempuan setelah menikah, serta menciptakan rasa saling menghargai antara kedua belah pihak. Namun, dampak negatif yang muncul adalah potensi konflik dan ketidakadilan, terutama jika belis yang diminta terlalu tinggi, yang dapat mengakibatkan penundaan atau bahkan pembatalan pernikahan. Di satu sisi, belis dapat meningkatkan status sosial dan martabat keluarga laki-laki, serta menciptakan rasa saling menghargai antara kedua belah pihak. Penelitian ini mengambil kesimpulan bahwa tradisi belis memiliki nilai-nilai luhur, dan perlu adanya penyesuaian dalam praktiknya agar tidak memberatkan pihak laki-laki dan tetap menghormati martabat perempuan. tradisi belis ini dapat terus dilestarikan sebagai bagian dari warisan budaya yang positif, asalkan disertai dengan kesepakatan yang adil antara kedua belah pihak.

This study discusses the impact of the belis tradition in traditional marriages in Kupang City, East Nusa Tenggara, using the perspective of 'urf and utilitarian theory. The belis tradition, which is a dowry from the man to the woman, has a deep meaning as a symbol of respect and seriousness in the marriage relationship. This study aims to determine how the belis tradition is implemented in the perspective of 'urf and to analyze the positive and negative impacts of the belis tradition on the sustainability of marriages in the future. This study is a type of empirical legal research and the research method used is a qualitative approach with data collection through interviews, observations, and documentation. The results of the study in the perspective of 'urf show that belis is considered a culture that reflects noble values and social norms that have existed for a long time. The implementation of the belis tradition in Kupang City is still strongly maintained by the community, despite challenges to social change. Belis not only functions as a requirement in marriage, but also as a symbol of respect for women and their families, as well as a bond between two families. However, the high value of the belis can be an economic burden for the man, which has the potential to hinder marriage and cause social problems such as pregnancy outside of marriage. While the positive impacts include respect for women, strengthening social ties. Belis functions as a guarantee of security and welfare for women after marriage, and creates a sense of mutual respect between the two parties. However, the negative impact that arises is the potential for conflict and injustice, especially if the belis requested is too high, which can result in delays or even cancellation of the marriage. On the one hand, belis can increase the social status and dignity of the man's family, and create a sense of mutual respect between the two parties. This study concludes that the belis tradition has noble values, and there needs to be adjustments in its practice so as not to burden the man and still respect the dignity of women. This belis tradition can continue to be preserved as part of a positive cultural heritage, as long as it is accompanied by a fair agreement between the two parties.
