Pandangan Hakim Pengadilan Agama Magetan terhadap syarat perceraian akibat perselisihan secara terus menerus dalam SEMA Nomor 3 Tahun 2023 perspektif teori keadilan John Rawls

ABSTRAK

Salah satu penyebab terjadinya perceraian yaitu adanya perselisihan secara terus menerus sebagaimana diatur dalam Surat Edaran Mahkamah Agung (SEMA) Nomor 3 Tahun 2023. Aturan ini memberikan penegasan bahwa perceraian akibat perselisihan secara terus menerus dapat dikabulkan apabila telah memenuhi syarat-syarat sebagaimana yang telah ditentukan. Penelitian ini berfokus pada pandangan hakim terhadap syarat perceraian akibat perselisihan secara terus menerus dalam SEMA Nomor 3 Tahun 2023. Kemudian syarat perceraian akibat perselisihan secara terus menerus dalam SEMA Nomor 3 Tahun 2023 tersebut dianalisis menggunakan teori keadilan John Rawls.

Metode penelitian yang digunakan yaitu penelitian yuridis empiris dengan pendekatan yuridis sosiologis, dimana peneliti melakukan pengumpulan data melalui wawancara secara terstruktur dengan teknik purposive samping yaitu kepada hakim Pengadilan Agama Magetan serta studi dokumen yang relevan dengan fokus penelitian. Sumber data dalam penelitian ini terdiri dari sumber data primer dan sekunder. Kemudian metode pengolahan data meliputi pemeriksaan data, klasifikasi, verifikasi, analisis, dan kesimpulan.

Hasil penelitian menunjukkan bahwa hakim Pengadilan Agama Magetan memiliki pandangan yang sama dan setuju dengan ketentuan syarat perceraian akibat perselisihan secara terus menerus dalam SEMA Nomor 3 Tahun 2023. Aturan tersebut bertujuan untuk mengurangi angka perceraian dan memastikan adanya keadilan bagi kedua belah pihak serta selaras dengan asas mempersulit perceraian. Kemudian berdasarkan perspektif teori keadilan John Rawls, syarat perceraian akibat perselisihan secara terus menerus dalam SEMA Nomor 3 Tahun 2023 telah mencerminkan prinsip keadilan, terutama dalam memastikan bahwa kedua belah pihak memiliki kesempatan yang sama untuk mengajukan perkara perceraian, adanya perlindungan bagi pihak yang kurang beruntung dan adanya waktu pisah tempat tinggal enam bulan untuk memberikan kesempatan bagi para pihak melakukan upaya damai.

ABSTRACT

One of the causes of divorce is the existence of continuous disputes as stipulated in the Supreme Court Circular Letter (SEMA) Number 3 of 2023. This rule provides an affirmation that divorce due to continuous disputes can be granted if the conditions have been met as predetermined. This study focuses on the judge's view of divorce requirements due to continuous disputes in SEMA Number 3 of 2023. Then the conditions for divorce due to continuous disputes in SEMA Number 3 of 2023 are analyzed using John Rawls' theory of justice.

The research method used is empirical juridical research with a sociological juridical approach, where the researcher collects data through structured interviews with side purposive techniques, namely to the judges of the Magetan Religious Court and the study of documents relevant to the focus of the research. The data sources in this study consist of primary and secondary data sources. Then the data processing method includes data examination, classification, verification, analysis, and conclusion.

The results of the study show that the judge of the Magetan Religious Court has the same view and agrees with the provisions of the terms of divorce due to continuous disputes in SEMA Number 3 of 2023. The regulation aims to reduce the number of divorces and ensure fairness for both parties and is in line with the principle of making divorce difficult. Then based on the perspective of John Rawls' theory of justice, the conditions for divorce due to continuous disputes in SEMA Number 3 of 2023 have reflected the principle of justice, especially in ensuring that both parties have the same opportunity to file a divorce case, there is protection for the less fortunate parties and there is a six-month separation period for the parties to make peace efforts.

أحد أسباب الطلاق هو وجود نزاعات مستمرة كما هو منصوص عليه في الخطاب المعمم للمحكمة العليا (SEMA) رقم ٣ لسنة ٢٠٢٣. تقدم هذه القاعدة تأكيدا على أنه يمكن منح الطلاق بسبب النزاعات المستمرة إذا تم استيفاء الشروط على النحو المحدد سلفا. تركز هذه الدراسة على وجهة نظر القاضي لمتطلبات الطلاق بسبب الخلافات المستمرة في SEMA رقم ٣ لسنة ٢٠٢٣. ثم يتم تحليل شروط الطلاق بسبب الخلافات المستمرة في SEMA رقم ٣ لسنة ٢٠٢٣ باستخدام نظرية جون رولز للعدالة.

طريقة البحث المستخدمة هي البحث القضائي التجريبي بنهج فقهي اجتماعي، حيث يقوم الباحث بجمع البيانات من خلال مقابلات منظمة بتقنيات هادفة جانبية ، أي لقضاة محكمة ماغيتان الدينية ودراسة الوثائق ذات الصلة بمحور البحث. تتكون مصادر البيانات في هذه الدراسة من مصادر بيانات أولية وثانوية. ثم تتضمن طريقة معالجة البيانات فحص البيانات وتصنيفها والتحقق منها وتحليلها والاستنتاج.

وأظهرت نتائج الدراسة أن قاضي محكمة ماغيتان الدينية له نفس الرأي ويتفق مع أحكام شروط الطلاق بسبب الخلافات المستمرة في SEMA رقم ٣ لسنة ٢٠٢٣. تهدف اللائحة إلى تقليل عدد حالات الطلاق وضمان العدالة لكلا الطرفين وتتماشى مع مبدأ جعل الطلاق صعبا. ثم بناء على منظور نظرية جون رولز للعدالة، عكست شروط الطلاق بسبب الخلافات المستمرة في SEMA رقم ٣ لسنة ٢٠٢٣ مبدأ العدالة، خاصة في ضمان حصول الطرفين على نفس الفرصة لرفع دعوى الطلاق، وهناك حماية للأطراف الأقل حظا وهناك فترة انفصال مدتها ستة أشهر للأطراف لبذل جهود السلام.
