Pandangan tokoh agama terhadap larangan kehadiran wali dalam akad nikah pasca Taukil: Studi di Dusun Mbean Desa Pandanwangi Kabupaten Jombang

ABSTRAK

Pernikahan dalam Islam mempunyai makna ibadah, oleh karena itu perlu adanya persyaratan dan rukun tertentu agar tujuan pernikahan dapat tercapai. Hadirnya Wali merupakan salah satu rukun nikah yang kehadirannya mutlak yang diterangkan pada Kompilasi Hukum Islam pasal 14, dimana indikatornya harus diketahui oleh Kepala Kantor Urusan Agama dari segi tekstual maupun kontektual. Karena banyak dari masyarakat yang belum faham terhadap konsep hadirnya Wali pasca Taukil dalam pernikahan.
Fokus dari penelitian ini adalah pandangan Tokoh Agama mengenai Hadirnya Wali dalam satu majlis pasca Taukil dalam akad pernikahan dalam pencapaian pasal 14 Kompilasi Hukum Islam.
Penelitian ini termasuk kedalam penelitian empiris dengan pendekatan kualitatif. Sedangkan data yang dikumpulkan berupa data primer dan sekunder yang dilakukan dengan teknik wawancara dan dokumentasi yang kemudian data tersebut diolah dengan diedit, dan dianalisis.
Dari hasil penelitian, secara umum keseluruhan tertuju kepada pandangan Tokoh Agama dan Kantor Urusan Agama Kecamatan Diwek dalam pelaksanaan akad yang dihadiri oleh Orangtua mempelai perempuan dalam satu majlis pasca Taukil berdasarkan pendapat Tokoh Agama yang menitik beratkan kesimpulan banyak kitab dan kondisi masyarakat tentang pemahaman larangan wali yang hadir dalam satu majlis pasca Taukil. Dalam prosesnya Tokoh Agama tersebut melakukan sosialisasi terhadap masyarakat tentang pentingnya seorang Wali dan larangan pasca taukil, hal ini menurut beliau didasarkan pada banyak kitab salah satunya kitab yang sudah tak asing lagi kita dengar, yakni Kifayatul Akhyar, dan Nihayatuz Zain, selain itu pihak Kantor Urusan Agama sendiri juga menjelaskanbahwa adanya larangan dalam kitab namun tidak pada aturan pemerintah yakni di Undang-undang No.1 Tahun 1974 maupun Kompilasi Hukum Islam. Dalam proses verifikasi peneliti ingin membuktikan tentang adanya dasar pada dua kitab tersebut dengan mengkombinasikan aturan-aturan pemerintah yang ada.

ABSTRACT

Marriage in Islam has the meaning of worship, therefore it is necessary to have certain requirements and harmony so that the purpose of marriage can be achieved. The presence of Wali is one of the pillars of marriage whose absolute presence is explained in Article 14 of the Compilation of Islamic Law, where the indicators must be known by the Head of the Office of Religious Affairs in textual and contextual terms. Because many of the people who do not understand the concept of the presence of post Taukil Guardians in marriage.
The focus of this research is the view of the Religious Leaders regarding the presence of a Guardian in a post-Taukil assembly in the marriage contract in the attainment of article 14 of the Compilation of Islamic Law.
This research belongs to an empirical study with a qualitative approach. While the data collected in the form of primary and secondary data are carried out by interview and documentation techniques and then the data is processed by editing, and analyzed.
From the results of the study, in general the overall focus was on the views of the Religious Leaders and the Office of Religious Affairs in the District of Diwek in the implementation of the contract which was attended by the parents of the bride and groom in a post-Taukil assembly based on the opinion of the Religious Leaders which emphasized the conclusions of many books and the condition of the community regarding the understanding of the guardian prohibition that present in one post Taukil assembly. In the process, the Religious Leaders conducted socialization to the public about the importance of a Guardian and post Taukil prohibitions, according to him, based on many books, one of which was a familiar book, Kifayatul Akhyar, and Nihayatuz Zain, besides that the Office of Affairs Religion itself also explains that there is a prohibition in the book but not on government regulations namely in Law No.1 of 1974 or the Compilation of Islamic Law. In the verification process the researcher wants to prove the existence of a basis in the two books by combining existing government rules.

النكاح عبادة في الإسلام، لذلك له الشروط والأركان المعينة حتى وصلنا في أهداف النكاح. وحضور الولي من أركان النكاح، وجب حضوره كما في تأليف حكم الإسلام في فصل ١٤، بمعرفة رَئِيْس مَجْلِسِ اْلإِدَارَةِ وِزارة الشؤونِ الدِينِيّة، حرفيا كانت أو سيقيا. لأن أكثر من المجتمع لا يفهمون بوجوب حضور الولي بعد توكيل النكاح.
و هدف هذا البحث رأي العلماء عن حضور الولي في المجلس بعد توكيل عبد النكاح في تأليف حكم الإسلام في فصل ١٤.
و هذا البحث من البحوث التجريبية بالمدخل الكيفي. وبيناته رئيسية و ثانوية، بتقنية جمع البيانات المقابلة والوثائق. و في التحليل بتصليح البيانات وتصنيف البيانات وتصحيح البيانات.
ونتيجة البحث تدلّ أن رأي العلماء و مجلس الإدارة وزارة الشؤون الدينية في النواحي ديويك في عملية العقد مع حضور الولي في المجلس بعد التوكيل، رأى العالم أن كثير الكتب أجازوا ذلك، والمجتمع لا يفهمون منع حضور الولي في المجلس بعد التوكيل. وحينئذ العالم أعلن أن أهمية الولي و منع حضوره بعد التوكيل، كما في كفاية الأخيار و نهاية الزين. وبيّن موظف من مجلس الإدارة وزارة الشؤون الدينية أن منع حضور الولي في الكتاب فحسب، ولكن لا يوجد في تنظيم الحكومة، أي في القانون رقم ١ سنة ١٩٧٤، أو في تأليف حكم الإسلام. وفي عملية التصحيح، أثبت الباحث وجود الدليل من الكتابان المذكوران، يقارنهما بتنظيم الحكومة.
