Efektivitas penerapan pelestarian tradisi Bau Nyale di Lombok Tengah Perspektif Maqashid Syari'ah

ABSTRAK

Bau nyale sebagai tradisi yang luhur eksistensinya diakui bahkan dijaga serta dilestarikan oleh masyarakat Lombok Tengah, namun pada dekade akhir realita masyarakat menunjukkan penurunan partisipasi dalam pelaksanaan tradisi tersebut. Padahal menurut Pasal 12 Ayat (4) Peraturan Daerah Nomor 16 Tahun 2021 bahwa budaya itu harus dipelihara atau
dilestarikan. Fakta ini mendorong peneliti untuk mengkaji efektivitas, faktor penghambat serta tinjauan maqashid syari‟ah Imam Al-Syatibi terhadap pelestarian tradisi bau nyale. Jenis penelitian ini adalah yuridis empiris dengan pendekatan yuridis sosiologis. Sumber data penelitian
meliputi primer, sekunder dan tersier. Data diperoleh melalui teknik wawancara dengan teknik pengambilan sampel purposive sampling dan dianalisis menggunakan yuridis kualitatif. Hasil penelitian menunjukkan bahwa dalam penerapan pelestarian tradisi bau nyale di Lombok tengah
terkategorikan efektif, namun menyisakan faktor masyarakat yang belum taat secara menyeluruh. Hal itu disebabkan karena penurunan pemahaman, minimnya sosialisasi dan edukasi serta pengaruh modernisasi. Adapun upaya yang dilakukan oleh Dinas Pariwisata dan Kebudayaan sudah selaras dengan maqashid syari‟ah Imam Al-Syatibi dalam pelestarian tradisi bau nyale

ABSTRACT

Bau nyale as a noble tradition, its existence is recognized and even maintained and preserved by the people of Central Lombok, but in the last decade the reality of society has shown a decline in participation in implementing this tradition. In fact, according to Article 12 Paragraph (4) of Regional Regulation Number 16 of 2021, culture must be maintained or preserved. This fact encourages researchers to study the effectiveness, inhibiting factors and review of the maqashid sharia of Imam Al-Syatibi regarding the preservation of the bau nyale tradition. This type of research is empirical juridical with a sociological juridical approach. The sources of research data include primary, secondary and tertiary. Data were obtained through interview techniques with purposive sampling techniques and analyzed using qualitative juridical. The results of the study show that the implementation of the preservation of the bau nyale tradition in Central Lombok is categorized as effective, but leaves behind factors that the community has not fully obeyed. This is due to a decrease in understanding, minimal socialization and education and the influence of modernization. The efforts made by the Department of Tourism and Culture are in line with the maqashid syari'ah of Imam Al-Syatibi in preserving the smell of nyale tradition.

يعد باو نيالي تقليدًا نبيلًا يتم الاعتراف بوجوده بل ويحرسه ويحافظ عليه سكان وسط لومبوك، ولكن في العقد الماضي أظهر واقع المجتمع تراجعًا في المشاركة في تنفيذ هذا التقليد. في الواقع، وفقًا للمادة 12 الفقرة (4) من اللائحة الإقليمية رقم 16 لسنة 2021، يجب الحفاظ على الثقافة أو الحفاظ عليها. وهذا الأمر يشجع الباحثين على دراسة مدى فعالية مقاصد شريعة الإمام السياطيبي وعواملها المثبطة ومراجعتها في الحفاظ على التقليد البونيالي. هذا النوع من البحث قانوني تجريبي ذو منهج قانوني اجتماعي. تشمل مصادر بيانات البحث الابتدائي والثانوي والثالث. تم الحصول على البيانات من خلال تقنيات المقابلة مع تقنيات أخذ العينات الهادفة وتم تحليلها باستخدام التقنيات القانونية النوعية. تظهر نتائج البحث أن تنفيذ الحفاظ على تقليد باو نيالي في وسط لومبوك يُصنف على أنه فعال، ولكن هناك عوامل لم يلتزم بها المجتمع ككل. ويرجع ذلك إلى انخفاض الفهم ونقص التنشئة الاجتماعية والتعليم وتأثير التحديث. وتتوافق الجهود التي تبذلها دائرة السياحة والثقافة مع مقاصد شريعة الإمام السياطيبي في الحفاظ على رائحة التقليد النيالي.
